CATEGORIES The land use categories as shown on the Aspen Land Use Plan have the following as their intent and purpose. Central Area-To allow the primary use of land for tourist commercial activity that is essential to the com- munity's economic vitality in an area that relates well to the proposed public transportation system. the ski area and existing tourist oriented businesses. Ordered yet diversified land uses. such as resident related commercial. residential and professional office uses. should be located on the fringe of the central area. Urban design consideration is an essential element of future development or redevelopment of the central area and is necessary to take advantage of the unusual opportunities presented by its historic heritage and the relationship of the central area and Aspen Mountain. This design element incluCles as primary concerns the preservation of historic sites. structures and mountain views. implementation of tree planting programs. as well as expansion of the pedestrian oriented mall area. Recreation/ Accommodations-To allow for the recreation and accommodation needs of the visitor to Aspen in an area that is especially suited for this because of its unity with. and identity to. the proposed transportation system. the ski area and the central area. Site plan review for significant development is es- sential to permit consideration of the impact that will result and the crucial issues relating to adequacy of public facilities. Recreation/Accommodations Transition-To permit recreation and accommodation development of limited height. bulk and scale to occur in an area that relates well physically to the ski area. The concept of construction should provide for a suitable physical and aesthetic transition between the intensive recreation/ accommodation areas to the north and the slopes of the mountain on the south. Townhomes currently under construction. REQUEST: Approval to condominiumize two townhomes currently under construction. APPLICANT: L.T.T. Townhomes LOCATION: 611 and 615 East Hopkins, Lots C, D, and E, Block 99 ZONING: C-1, Commercial DESCRIPTION OF THE PROPOSAL: The applicants are currently constructing two townhomes, each containing approximately 4,600 sq. ft., four (4) bedrooms per unit. (See attached map.) REFERRAL COMMENTS: Engineering: In a memo dated January ll, 1989, Jim Gibbard from the Engineering Department made the fOllowing comments: 1. The applicant shall submit a plat. which complies with the requirements in Section 24, Article 7-l004 (D) (2) of the Aspen Municipal Code. 2. The applicant shall join a Special Improvement District. 3. In accord with section 24, Article 7-l004(D) (2) (a-8) of the Aspen Municipal Code, the applicant needs to submit a storm drainage plan for this development which needs to be in accordance with the design standards in section 24, Article 7-l004 (e) (4) (f) of the Code. city Attorney: In a memo dated January 9, 1989, from Staff Attorney Fred Gannett, he states he has no additional concerns other than the exemption issues raised in the application. 1""'. ~ STAFF COMMENTS: section 7-1008 of the Aspen Land Use Code refers to the requirements for condominiumization. 1. CRITERIA: The existing' tenants shall be given first right of refusal. RESPONSE: The proposed condominiumization involves new units which have no prior tenant history. 2. CRITERIA: Residences in the Commercial zone district shall be restricted to six (6) month minimum lease restrictions with no more than two shorter tenancies per year unless otherwise demonstrated by the application according the criteria stated in Section 7-1008 (A) (1) (b) (2) as follows: a. The immediate vicinity of the parcel proposed for condominiumization is characterized predominantly by lodges or other units which are permitted to be used as short term accommodations, and a substantial percentage of those units are currently being used for short-term rentals b. There were not previously long-term residents of the parcel who were displaced directly or indirectly by the proposed condominiumization c. The parcel is in close proximity to the downtown area or to major tourist recreational facilities d. The Aspen Area Comprehensive Plan designated the subject neighborhood as appropriate for short term accommodations RESPONSE: The applicant has attempted to demonstrate in the application that the two (2) units should not be subject to. the minimum lease requirements, responding as follows to the above referenced criteria: a. Within and adjacent to the immediate vicinity of the two (2) townhome units are primarily office and retail buildings. b. No previous long term residents were displaced by the construction or use of the townhomes c. The parcel is in close proximity to the downtown area and major tourist facilities d. The Aspen Area Comprehensive Plan specifically designated the subject neighborhood as appropriate for 2 . , r": ~, short term accommodations. This parcel of land is located on the fringe of the Central Area and was planned for tourist related activities and accommodations. staff does not support the' applicant I s request to waive the minimum lease requirements. We find that the immediate neighborhood, currently a blend of many employee units and older, smaller-scale homes, will be impacted by this project. Four deed restricted units are located in the KSNO Building immediately across Hopkins from the subject property; four are also located in the City Plaza building. There are also several small homes occupied on a long-term basis which remain within a 1-2 block radius of the property. The recently approved condominiumization of the Spring street Townhomes, a/k/a Brownstone Townhomes, located in the block immediately to the east on Hopkins, did not receive a waiver of the minimum lease requirements. Those two townhome units are slightly smaller in scale to the L.T.T. Townhomes. We feel short-term use of the sUbject units is not appropriate for the area. 3. CRITERIA: An affordable Housing Impact Fee shall be assessed to each free market condominium unit based on the number of bedrooms contained in the unit. RESPONSE: The applicant agrees to pay $8,050 per unit, a total of $16,lOO.00 (based on the fee schedule for three bedrooms or larger). This shall be paid at the time the condominium plat is filed. In summary, the applicants have complied with all the applicable Code requirements for condominiumization, with the exceptions as noted in the referral comments from the Engineering Department. RECOMMENDED MOTION: "Move to grant Subdivision Exemption. for condominiumization of the L.T.T. Townhomes, with the following conditions: l.
