SUMMARY AND RECOMMENDATION
The Roaring Fork Transit Agency (RFTA) and the City of Aspen are
seeking Conceptual SPA (Specially Planned Area) approval and a
Growth Management Quota System (GMQS) exemption for improvements
to the bus depot and transit/pedestrian circulation system at
Rubey Park. This memorandum addresses each of the applicant's
requests.
The Planning Office and the Planning and ~Qning (P&z) recommend
approval of the applicant's request subject to conditions listed
at the end of the memorandum.
THE PROPOSAL
The intent of the new Rubey Park site plan is to provide for the
safe, conven.ient and comfortable waiting, loading and discharge
of bus passengers, both resident and tourist to all points in the
city and Valley. The application proposes improving the bus
circulation, waiting facility, transit information, landscaping
and pedestrian areas. Attachment 1, a summary chart prepared by
the applicant, compares and contrasts the existing conditions on
the site with the proposed new design. Attachment 2 depicts the
proposed conceptual site plan for Rubey Park which was originally
presented to the P&Z. Attachment 2A depicts the revised plan.
Attachment 3 depicts the existing conditions on the site.
BACKGROUND
Comprehensive Plan Recommendation - Recent plans for the
Aspen Area have recommended the Rubey Park site for transit
facilities. The draft Aspen Area Comprehensive Plan:
Transportation Element also recommends the Rubey Park as the
City's primary transit hub.

Zoning - (Park) with a Drainage, Historic, and SPA overlay
zone districts.
Size - 27,000 square feet.
Existing Use - Transit depot and parking lot.
REFERRAL AGENCY COMMENTS
1. Parks Department - The Parks Department offers the following
comments (see Attachment 4):
o Landscaping - Although the landscaping proposal looks
good there is a question regarding the feasibility of
using trees in planters as bus dividers (refer to
Attachment 4, site plan). As the trees grow they may
interfere with bus parking.
o Snow Removal - The applicant needs to identify snow
storage areas and discuss who will be responsible for
snow removal.
o Parking - A parking space for RFTA employees should be
considered.
o Drainage - The applicant should address the problem of
drainage on Galena street. Presently water drains to
the Galena street Mall which creates a hazard when it
freezes at night. It is suggested that now would be a
good time to install a drain similar to the type of
drainage in front of the MacDonalds on Mill street.
2. city Attorney - The city Attorney had no comments concerning
this application but may have some later (see Attachment 5).
3. Water Department - Adequate water service is available to the
site (see Attachment 6).
4. Environmental Health Department - There do not appear to be
any air quality impacts resulting from the proposal, although
buses will be required to observe the City ordinance which
precludes idling motors for more than fifteen minutes. Care
should be taken by RFTA to avoid non-point source runoff into the
storm sewer from fuel, anti-freeze and other fluids (see Attach-
ment 7).
5. Electric Department - The Electric Department suggested the
following improvements (see Attachment 8).
o Metering will be required on the side of the building.

o Secondary w~r~ng will be required to run to the vault
depicted in Attachment 8.
o The applicant will be required to dig trenches.
6. Engineering Department - Overall the Engineering Department
supports the application because the proposal will greatly
enhance traffic circulation and conflicts in the alley between
buses and service vehicles, however the following improvements
are suggested (see Attachment 9):
o All of the angles and extended curbs and drop-off curbs
facing on Durant street should be changed to smooth
curves to facilitate snow removal.
o All curbs must have handicap ramps.
o Lighting should be consistent with the rest of the
commercial core and be shown on the Precise SPA plan.
o All utilities should be shown on the site survey at the
Precise Plan stage.
o Concerns have been expressed regarding the loss of
parking spaces during the Off-season.
o A detailed parking plan should be presented at the
Precise Plan stage.
o Curbs constructed on Durant must be rebuilt according
to the grades proposed for the reconstruction of the
street. The project should be coordinated with the
Lodge Improvement District (this recommendation was
made prior to the decision by City Council not to
pursue the Lodge Improvement District).
Planning Office Comments
Conceptual SPA Plan Section 24-7.3 of the Municipal Code
requires an applicant during the Conceptual SPA submission to
establish the overall intent of the SPA plan and present a
conceptual proposal for the use of the site. Technical details
are not required or recommended at this stage of the planning
process.
The amenities for pedestrians waiting to use the transit system
will be significantly improved. The plan calls for a four fold
increase of heated waiting areas over and above the existing area
within the shack presently located on the site. The bus staging
areas will be dispersed around the site with seating located
adjacent to them.

Bathrooms and minor ski storage facilities will be provided on
site within the building but are not shown outside. Adequate ski
and boot storage at Rubey Park is essential in order to provide
convenient facilities for Snowmass based skiers to store their
gear while they shop and eat in the City of Aspen. The Precise
Plan should show in more detail indoor and outdoor ski and boot
storage facilities and document the capacity of these facilities.
The plan proposes extending the mall from Galena street and Mill
Street to the Rubey Park site to enhance pedestrian flows. It is
the Staff opinion that the mall extensions are essential to the
plan and should be completed in association with Rubey Park
improvements. It is recommended that mall bricks be used for
paving the pedestrian areas in Rubey Park. We view Rubey Park as
the beginning of the pedestrian experience for many AspenjSnow-
mass visitors. For some, their first impression of the downtown
will be when they get off the bus at Rubey Park. Rubey Park
should serve as an extension of the Aspen pedestrian mall. The
P&Z and the Staff recommend that the City work cooperatively with
RFTA to complete mall extensions this fall in association with
the Rubey Park upgrading.
The most significant site planning issue which the P&Z and staff
has identified is the over abundance of space allocated for ski
bus storage (see attachments 2 and 2A). RFTA is seeking an area
for ski bus storage in order to store buses on-site during the
off-peak hours. The provision of bus storage on-site precludes
the need for running empty buses back to the bus barn in the
middle of the day and then returning during peak hours. When the
proposed ski bus storage area is not used for bus storage,
automobiles park on-site. The Planning Office believes that bus
storage should take place off-site because due to the location of
the ski bus storage, the buses detract from the pedestrian link
between the mall and Rubey Park.
The applicant has been responsive to concerns regarding ski bus
storage expressed at the P&Z meeting and has submitted a revised
site plan which is depicted in attachment 2A. A comparison
between attachment 2, the original site plan, and attachment 2A
shows that the applicant has reduced ski bus storage on the site
from eleven bus parking spaces to just five and slightly increas-
ed the quantity of landscaping. We consider the reduction in ski
bus storage areas to be a significant improvement, but do not
believe that there has been enough of a corresponding improvement
in landscaped pedestrian areas.
While the Planning Office would prefer to see the complete
elimination of on-site ski bus storage, we understand the
operational cost savings which result from providing for bus
storage on-site. It is our opinion that the ski bus storage area
tends to isolate the major pedestrian portion of Rubey Park from

the Aspen pedestrian mall. A critical pedestrian link between
the pedestrian mall and Rubey Park is compromised by the ski bus
storage.
An option available to the Council is the complete elimination of
all bus storage on-site and its replacement with landscaping and
mall bricks. The trade-off from such an action would be in-
creased operational costs for RFTA and a loss of vehicular
parking at Rubey Park during periods in which ski bus storage
areas are used for parking. Given the original site plan
depicted in attachment 2, the parking on site would be reduced
form 41 spots to 22 spots. By comparison, given the site plan
proposed in attachment 2A parking on site would be reduced to 10
parking places. In our opinion the ski bus storage issue is the
most significant issue before the city CoUncil.
Improved vehicular circulation appears to be a major asset of the
proposed plan. Buses will never have to back up and will be
provided with spaces for waiting which do not interfere with
traffic flow.
Attachment 10, an elevation drawing of the site, depicts a
clocktower and message board which is approximately 17 feet high.
Reactions to the proposed clocktower vary considerably. Some
people like the clocktower and others do not. The Staff does not
believe that a clocktower is appropriate on-site, but the
majority of the P&Z does. We believe that it is important to have
a clock on the site and recommend that a clock be placed on the
wall of the bus depot. The P&Z and the staff both recommend that
the ski storage lockers proposed for inside the base of the
clocktower be relocated on-site.
It is unclear at this time how the queuing for the Ski buses will
be accommodated. Given the conceptual nature of the plan, it can
not be determined whether or not the queuing can be accommodated.
The treatment of visitors waiting for ski buses at Ruby Park is
one the biggest deficiencies of the existing facility and should
be addressed in detail at the Precise plan stage.
In summary, the Planning Office believes that the Rubey Park plan
submitted by the applicant satisfies the code's requirements for
Conceptual SPA submission and the proposed site plan represents a
major improvement over the existing facility. However, we
believe that the proposed plan overemphasizes bus storage as
compared to pedestrian areas and needs to be further redesigned
to create a stronger link between the mall and the bus depot.
Rather than pursuing the standard bus depot with some pedestrian
areas and landscaping, we believe the applicant should pursue a
unique, but functional bus depot with an abundance of pedestrian
areas and landscaping.

Growth Management Quota system Exemption - section 24-11. 2 (e)
establishes review criteria for a GMQS exemption for essential
government projects other than housing. The Planning and Zoning
commission is required to make a recommendation to the city Coun-
cil for such GMQS requests. The Rubey Park Plan which has been
proposed meets the minimum criteria of the code for an exemption
because, it serves an essential public purpose, provides facilit-
ies in response to the demands of growth and is not in itself a
growth generator, is available for public use, serves the needs
of the local community and is not a for-profit venture.
The applicant has demonstrated within the application that there
will be negligible adverse impacts on the community from the
granting of a GMQS exemption. There will be no additional
employees required to run the facility, pUblic safety will be
enhanced and the facility will be much more attractive. The only
adverse impact of the proposed plan is the loss of 22 to 34 non-
ski season parking spaces. This loss of parking was anticipated
when the draft Aspen Area comprehensive Plan: Transportation
Element was developed. We consider the anticipated loss of non-
ski season parking to be an acceptable trade-off to insure the
upgrading of a facility like Rubey Park which affects the
vacation experience of thousands of Aspen visitors.
Advisory cOllllllittee and Staff Recommendation
The Planning Office and P&Z strongly support the proposed
upgrading of Rubey Park. We believe the improvements are long
overdue and essential to a quality resort experience. However,
we suggest minor changes to the site plan to enhance the pedes-
trian character of the site. Our comments should not be miscon-
strued as opposition to Rubey Park upgrading. We believe that
Rubey Park should be very carefully planned because so many
visitors and residents pass through the site.
The Planning Office and P&Z recommend that the City Council
approve of the Growth Management Quota System exemption and
approve the Rubey Park Conceptual SPA subject to the followi-
ng conditions.
1. All representations made in the application will be
adhered to.
2 The applicant will be required to comply with proce-
dures of Sections 24-7.5, 24-7.6, 24-7.7 and 24-7.8 of
the Municipal Code which address SPA plans.
3. The Precise Plan shall document the quantity of indoor
and outdoor ski and boot storage which will be avail-
able on the site.

4. The Precise plan shall describe the paving materials
which will be used for all pedestrian areas.
5. As part of the Precise Plan Submission the applicant
shall provide a detailed analysis of the functional bus
requirements at Rubey Park including an analysis of
pedestrian queuing and bus staging. It is recommended
that bus storage areas be reduced if functionally
possible and eliminated at a future time when parking
is available at an alternate location ( it should be
noted that the applicant has already responded to this
recommendation as shown in attachment 2A).
6. There shall be no ski storage lockers located within
the base of the clocktower.
7. RFTA shall work cooperatively with the city of Aspen to
complete the mall extensions this summer and fall.
8. In preparing the Precise Plan, the applicant shall meet
with the Parks Department and reach a mutual agreement
regarding the compatibility of trees and buses in the
bus stacking area. The Precise Plan Submission shall
reflect the mutual understanding of the Parks Depart-
ment and the applicant.
9. The applicant will address snow removal in detail in
the Precise Plan.
10. The applicant will meet with the Parks and Engineering
Departments prior to the Precise Plan Submission to
discuss the potential resolution to the drainage
problem on Galena Street which has been identified by
the Parks Department within Attachment 4.
11. The applicant will meet with the Electric Department to
address metering, secondary wiring and trenching as
noted within Attachment. 8. The Precise Plan Submission
shall address these issues to the satisfaction of the
Electric Department.
12. The applicant will meet with the Engineering Department
to discuss their requirements for curb improvements and
reflect those requirements in the Precise Plan Submis-
sion.
13. The applicant will be required to construct curbs with
handicap ramps.
14. Lighting shall be consistent with the rest of the
commercial core and approved by the city Engineer.

Drainage: A problem to address is the Galena Street drainage VYhich
presently flovvs into the mall vvithout adequate drains. This
becomes a real problem in early spring runoff on warm sunny
afternoons, turning water flow into ice hazards after the sun goes
down, creating liability problems for pedestrians in the mall. It
might be a good time and solutiOn to add a large drain, similar to
the OM in front of McDonalds on Mill Street.
Please keep us informed of any changes, and t11anks for your consideration.

This offiee has reviewed the above-mentioned submittal for the
following environmental concerns.
Air Pollution:
There does not appear to be any direct impacts on air quality as
the result of this application.
A reminder will be issued at this time that the buses shall not
idle longer than 15 minutes while in the depot area, as directed
by City ordinance. This has not been a serious problem lately as
the drivers have 'been recently reminded to turn their buses off

4. We are concerned about the loss of off-hours parking spaces.

Also, we would like to see a parking lot plan showing the off-
hours arrangement.
5. The submittal included the sidewalk areas on the west side of
Mill Street and the east side of Galena Street. Are these
included in the scope of this project, or for the City to
construct at a later date?

the grades proposed for the reconstruction of this street.
Coordination with the ASALID is essential.

8. Overall, we are in favor of this proposal. The circulation

INTRODUCTION
The Roaring Fork Transit Agency (RFTA) and the City of Aspen are
seeking Conceptual SPA (specially Planned Area) approval and a
Growth Management Quota System (GMQS) exemption for improvements
to the bus depot and transit/pedestrian circulation system at
Rubey Park. The attached application summarizes the proposal.
This memorandum addresses each of the applicant's requests.
THE PROPOSAL
The intent of the new Rubey Park site plan is to provide for the
safe, convenient and comfortable waiting, loading and discharge
of bus passengers, both resident and tourist to all points in the
City and valley. The application proposes improving the bus
circulation, waiting facility, transit information, landscaping
and pedestrian areas. Attachment 1, a summary chart prepared by
the applicant, compares and contrasts the existing conditions on
the site with the proposed new design. Attachment 2 depicts the
proposed conceptual site plan for Rubey Park. Attachment 3
depicts the existing conditions on the site.
BACKGROUND
Comprehensive Plan Recommendation - Recent plans for the
Aspen Area have recommended the Rubey Park site for transit
facilities. The draft Aspen Area Comprehensive Plan:
Transportation Element also recommends the Rubey Park as the
city's primary transit hub.

and pPA overlay zone districts.

REFERRAL AGENCY COMMENTS
1. Parks Department - The Parks Department offers the following
comments (see Attachment 4):
o Landscaping - Although the landscaping proposal looks
good there is a question regarding the feasibility of
using trees in planters as bus dividers (refer to
Attachment 4, site plan). As the trees grow they may
interfere with bus parking.
o Snow Removal - The applicant needs to identify snow
storage areas and discuss who will be responsible for
snow removal.
o Parking - A parking space for RFTA employees should be .
considered.
o Drainage - The applicant should address the problem of
drainage on Galena street. presently water drains to
the Galena Street Mall which creates a hazard when it
freezes at night. It is suggested that now would be a
good time to install a drain similar to the type of
drainage in front of the MacDonalds on Mill street.
2. City Attorney - The City Attorney had no comments concerning
this application but may have some later (see Attachment 5).
3. Water Department - Adequate water service is available to the
site (see Attachment 6).
4. Environmental Health Department - There do not appear to be
any air quality impacts resulting from the proposal, although
buses will be required to observe the city ordinance which
precludes idling motors for more than fifteen minutes. Care
should be taken by RFTA to avoid non-point source runoff into the
storm sewer from fuel, anti-freeze and other fluids (see Attach-
ment 7).
5. Electric Department - The Electric Department suggested the
following improvements (see Attachment 8).
o Metering will be required on the side of the building.
o ,Secondary wiring will be required to run to the vault
depicted in Attachment 8.
o The applicant will be required to dig trenches.
6. Engineering Department - Overall the Engineering Department
supports the application because the proposal will greatly

enhance traffic circulation and conflicts in the alley between
buses and service vehicles, however the following improvements
are suggested (see Attachment 9):

o Concerns have been expressed regarding the loss of
parking spaces during the off-season.
o A detailed parking plan should be presented at the
Precise Plan stage.
o Curbs constructed on Durant must be rebuilt according
to the grades proposed for the reconstruction of the
street. The project should be coordinated with the
Lodge Improvement District.
Planning Office Comments
Conceptual SPA Plan section 24-7.3 of the Municipal Code
requires an applicant during the Conceptual SPA submission to
establish the overall intent of the SPA plan and present a
conceptual proposal for the use of the site. Technical details
are not required or recommended at this stage of the planning
process.
The amenities for pedestrians waiting to use the transit system
will be significantly improved. The plan calls for a four fold
increase of heated waiting areas over and above the existing area
within the shack presently located on the site. The bus staging
areas will be dispersed around the site with seating located
adjacent to them.
Bathrooms and minor ski storage facilities will be provided on
site within the building but are not shown outside. Adequate ski
and boot storage at Rubey Park is essential in order to provide
convenient facilities for Snowmass based skiers to store their
gear while they shop and eat in the City of Aspen. The Precise
Plan should show in more detail indoor and outdoor ski and boot
storage facilities and document the capacity of these facilities.

The plan proposes extending the mall from Galena street and Mill
street to the Ruby Park site to enhance pedestrian flows. It is
the staff opinion that the mall extensions are essential to the
plan and should be completed in association with Rubey Park
improvements. It is recommended that mall bricks be used for
paving the pedestrian areas in Rubey Park. We view Rubey Park as
the beginning of the pedestrian experience for many AspenjSnow-
mass visitors. For some their first impression of the downtown
will be when they get off the bus at Rubey Park. Rubey Park
should serve as an extension of the Aspen pedestrian mall.
The most significant problem which we have found with the Rubey
Park site Plan is the over abundance of space allocated for
buses, particularly bus storage (see Attachment 2). The Rubey
Park site is adjacent to major pedestrian areas such as the Mall
and Wagner Park as well as several residences to the north of the
bus depot. While the number of buses proposed for the site may
be acceptable in a more urban setting, we believe it is inapprop-
riate for Aspen. As designed, the transit plaza, the major
pedestrian part of the site, is an island separated from the
Aspen pedestrian mall by a sea of asphalt and buses. The storage
of buses should occur at the bus barn, not in the City. It is
simply not necessary or in keeping with the pedestrian character
of the area to store eleven buses on this site. Likewise, we
consider it unnecessary to have separate locations at the bus
depot for every bus route since all of the buses are never at the
site at the same time.
It is recommended that the bus storage area be eliminated from
the site plan and replaced with landscaping and pedestrian areas.
We recognize that there will be a greater loss of parking, but we
believe that the loss of parking has been accommodated for in the
Aspen Area Comprehensive P1an: Transportation Element. By
removing the designated bus stops for each bus route, a few spots
can be created for short-term bus storage. We do recognize the
advantages of designated bus stops to visitors unfamiliar with
the bus system, but feel the space requirements for such a system
are too great. With the elimination of the bus storage and the
replacement with landscaping, the applicant will be able to
extend the pedestrian malls to the site and make the buses fit
the landscape of the community rather than make the landscape of
the community fit in around the buses.
We do recognize that the site plan for Rubey Park needs to serve
two purposes, functional purpose of a bus depot and an extension
of the pedestrian mall. These purposes need to be balanced in
the site planning process. Our bias is toward the pedestrian
mall. The applicant needs to prepare for Precise Plan a func-
tional analysis of the operations of Rubey Park in order to
justify bus storage. Perhaps bus storage cannot be totally
eliminated, but can be significantly reduced. It is our inclina-

tion that bus storage should occur at the bus storage facility,
not in town.
Improved vehicular circulation appears to be a major asset of the
proposed plan. Buses will never have to back up and will be
provided with spaces for waiting which do not interfere with
traffic flow. During the non-ski season, it is proposed that the
ski bus storage area can revert to parking for cars. However,
given the proposed plan the capacity for parking will be reduced
from 41 cars to 22 cars. If the bus storage area is eliminated
as we propose, there will be a further reduction in the non-ski
season parking. Although we believe all of the parking should be
removed, it may be possible to retain some parking in conjunction
with space for storage of one or two buses.
Attachment 10, an elevation drawing of the site, depicts a
clocktower and message board which is approximately 26 feet high.
We consider a clocktower to be inappropriate on the site. We
recommend the removal of the clocktower. The money saved on the
clocktower could be used for additional landscaping on the site
and further enhancement of pedestrian areas. We believe that it
is important to have a clock on the site and recommend that a
clock be placed on the wall of the bus depot.
It is unclear at this time how the queuing for the Ski buses will
be accommodated. Given the conceptual nature of the plan, it can
not be determined whether or not the queuing can be accommodated.
The treatment of visitors waiting for ski buses at Ruby Park is
one the biggest deficiencies of the existing facility and should
be addressed in detail at the Precise plan stage.
In summary, the Planning Office believes that the Rubey Park plan
submitted by the applicant satisfies the code's requirements for
Conceptual SPA submission and the proposed site plan represents a
major improvement over the existing facility. However, we
believe that the proposed plan overemphasizes bus storage as
compared to pedestrian areas and needs to be redesigned to create
a strong link between the mall and the bus depot. Rather than
pursuing the standard bus depot with some pedestrian areas and
landscaping, we believe the applicant should pursue a unique, but
functional bus depot with an abundance of pedestrian areas and
landscaping.
Growth Management Quota System Exemption - section 24-11. 2 (e)
establishes review criteria for a GMQS exemption for essential
government projects other than housing. The Planning and Zoning
commission is required to make a recommendation to the city Coun-
cil for such GMQS requests. The Rubey Park Plan which has been
proposed meets the minimum criteria of the code for an exemption
because, it serves an essential public purpose, provides facilit-
ies in response to the demands of growth and is not in itself a

growth generator, is available for public use, serves the needs
of the local community and is not a for-profit venture.
The applicant has demonstrated within the application that there
will be negligible adverse impacts on the community from the
granting of a GMQS exemption. There will be no additional
employees required to run the facility, public safety will be
enhanced and the facility will be much more attractive. The only
adverse impact of the proposed plan is the loss of 22 non-ski
season parking spaces. As noted above, this loss of parking was
anticipated when the draft Aspen Area Comprehensive Plan:
Transportation E1ement was developed. We consider the antici-
pated loss of non-ski season parking to be an acceptable trade-
off to insure the upgrading of a facility like Rubey Park which
affects the vacation experience of thousands of Aspen visitors.
Recommendation
The Planning Office strongly supports the proposed upgrading of
Rubey Park. We believe the improvements are long overdue and
essential to a quality resort experience. However, we do suggest
major changes to the site plan to enhance the pedestrian charac-
ter of the site. Our comments should not be misconstrued as
opposition to Rubey Park upgrading. We believe that Rubey Park
should be very carefully planned because so many visitors and
residents pass through the site.
The Planning Office recommends that the Planning and Zoning
Commission recommend to the City Council approval of the Growth
Management Quota System exemption and approval of the Rubey Park
Conceptual SPA subject to the following conditions.
1. All representations made in the application will be
adhered to.
2 The applicant will be required to comply with proce-
dures of Sections 24-7.5, 24-7.6, 24-7.7 and 24-7.8 of
the Municipal Code which address SPA plans.
3. The Precise Plan shall document the quantity of indoor
and outdoor ski and boot storage which will be avail-
able on the site.
4. The Precise plan shall describe the paving materials
which will be used for all pedestrian areas.
5. As part of the Precise Plan Submission the applicant
shall provide a detailed analysis of the functional bus
requirements at Rubey Park including an analysis of
pedestrian queuing and bus staging. It is recommended
that bus storage areas be greatly reduced or completely

eliminated and replaced with landscaped pedestrian
areas.
6. The clocktower shall be removed from the plan.
7. The applicant will be required to extend the Mill and
Galena pedestrian mall to the site. We recommend that
RFTA work cooperatively with the city of Aspen to
complete the mall extensions this summer and fall.
8. In preparing the Precise Plan, the applicant shall meet
with Parks Department and reach a mutual agreement
regarding the compatibility of trees and buses in the
bus stacking area. The Precise Plan Submission shall
reflect the mutual understanding of the Parks Depart-
ment and the applicant.
9. The applicant will address snow removal in detail in
the Precise Plan.
10. The applicant will meet with the Parks and Engineering
Departments prior to the Precise Plan Submission to
discuss the potential resolutions to the drainage
problem on Galena Street which has been identified by
the Parks Department within Attachment 4. The Precise
Plan shall include a proposal by the applicant to
resolve the problem.
11. The applicant will meet with the Electric Department to
address metering, secondary wiring and trenching as
noted within Attachment 8. The Precise Plan Submission
shall address these issues to the satisfaction of the
Electric Department.
12. The applicant will meet with the Engineering Department
to discuss their requirements for curb improvements and
reflect those requirements in the Precise Plan Submis-
sion.
13. The applicant will be required to construct curbs with
handicap ramps.
14. Lighting shall be consistent with the rest of the
commercial core and approved by the city Engineer.
15. All utilities will be shown on the site survey as part
of the Precise Plan Submission.
16. A detailed parking plan shall be submitted as part of
the Precise Plan.

BACKGROUND: The applicant, Dave Gibson and Bruce Abel on behalf
of the Roaring Fork Transit Agency are requesting conceptual
submission to build a depot building of 1,000 sq. ft., public
restrooms, ski/storage lockers, lounge, etc. The site is 27,000
sq. ft. total with 11,632 sq. ft. being proposed for bus, storage
and travel, 1,100 sq. ft. proposed as building coverage and
14,268 proposed as open space and/or pedestrian area.
The applicants are requesting exemption from GMP based on Section
24-1l2-te) "all construction of essential government projects
other than housing, subject to the special approval of he city
Council-upon recommendation of the Planning and Zoning commis-
sion". They suggest that the transit center is an ~ssential
project.
They further suggest that the new facility will be staffed by one
person at the ticket/information window from 7:00 AM to 1:00 AM
as is presently done. No additional driver,s routes, or service
employees will be added as a result of this development, and the
net effect on employee generation will be zero.
I spoke with David Gibson and suggested that cleaning and locker
rental could generate additional employees. His response was
that the grounds that are currently being maintained by park
personnel will be reduced and the cleaning could be incorporated
in the present employees daily chores.
The ticketing area is only two feet larger than at present and
upon review the Housing staff agrees with the applicants repre-
sentations.
HOUSING OFFICE RECOMMENDATIONS: Approval of application as staff
does not see an employee generation from this project but rather.
an expansion for the comfort of passengers.

Attached is a copy of the list of Property Owners adjacent to
Rubey Park within 300 feet, which was prepared by the County
Assessor's Office. We have searched our records on all of the
properties listed from May, 1985 forward in order to find any
recent changes in ownership not yet shown at the Assessor's Office.
AS of April 27, 1987 (the effective date of our records) there have
been no recent changes in ownership except for those listed below:

When we met yesterday afternoon to discuss the Ruby Park bus
depot SPA application I mistakenly told you the wrong fee for the
application. The application fee will be $1900 for the Planning
Office review , $200 for the Engineering Department, $50 for
Environmental Health and $50 for the Housing Office. The total
fee will be $2200.

SPECIALLY PLANNED AREA (SPA) PRECISE REVIEW
Statement of Intent. The intent of the new Rubey Park design is
to provide for the safe, conven ien t, and comfortab 1 e wai t i ng,
loading and discharge of bus passengers, both resident and
tourist, to all points in the City and Valley currently served by
RFTA. At the same time, the intent is to enhance the civic
character of the site, to make it readily perceived as a transit
center, to extend the character a.nd detail of the pedestrian
malls to the site, and to enhanc& a park-like ambience on the
Rubey Park site.
Type of Development. A transit center with the following
features is proposed: A depot building of 1000 SF with generous
glazing on all four sides to permit good visibility of buses, and
a ticket/information window at the center. Public restrooms,
ski/storage lockers, and a private drivers' lounge are proposed.
Wide overhangs around the one story brick structure allow
sheltered outdoor waiting and entering, and recall the image of
an old railroad depot. The fl'ee-standing' marquis/clock tower
which was shown on concep~ual plans has been deleted due to
budgetary considerations. Ski storage lockers have been located
outdoors along the north wall of the depot, and indoors, in both
waiting areas; a total of 27 lineal feet of locker, or 36 9"
wide, keyed, ski storage lockers.
Landscape features are proposed to feature 4 foot and 2 1/2 foot
tall pat terned concrete plant ers on Mi 11, Durant, and Gal ena.
Street frontages. Openings for pedestrian movement and queuing
would penetrate the otherwise continuous visual screen of
planting. Existing mature evergreens are proposed to be
relocated into the raised planters, as well as theon-grade
planting areas.
Discussion of the success of placing trees in the island along
the alley was raised during Conceptual Review. The precise plan
has enlarged and concentrated these alley-adjacent planting areas
in wider dimensions, which should insure their success. One
small island remains on the plan, and the two trees which it
contains will be tall and mature initial plantings with a canopy
above bus-height. We feel it is important to maintain the
planting continuity along the alley.
The Parks Department has been enlisted in the effort to meet the
budget and the November '~ompleti6n goals of Rubey P~rk by
assisting with 'the storing and transplanting of the existing
mature tres and other plant matefials on the site for the general
contractor.

Pedestrian waiting in a park--type setting a.-e encouraged with
benches anchored to the 4' tall plant~rs, and secondary seating
along the edges of the 2 1/2' tall planters; a total of 300 LF of
exterior seating in benches plus additional seating on low
planters. It should be noted that seating directly under the
eaves of the depot has been eliminated, due to concerns about
snow sliding/safety concerns, and planted areas have been placed
along all drip locations, with access only at gable end locations
of the depot.
The Site is 27,000 SF total. Of this area, 11,200 SF (41%) is
proposed as asphaltic area for bus storage and travel, 1000 SF
(4%) is proposed as building coverage, and 14,800 SF (55%) is
left as planted open space and/or pedestrian area. This
represents a modest increase in open space/pedestrian area over
the conceptual plan, due to elimination of some bus
storage/parking on-site. (See chart following).
Winter high season sees an intensive use of the site. The
present passenger load will be handled with four ski buses
loading (Buttermilk, Highlands, and Snowmass (2)), four city
routes loading (Snowbunny, Highlands, Hunter Creek, and Aspen
Grove), and three county routes (Downvalley Express, Downvalley
local, Snowmass). In addition, storage for five ski buses on the
site during mid-day hours is provided. To ease passenger
confusion, the same routes will always load in the same "slots".
In skier queuing areas, the largest spaces of the transit plaza
occur, allowing room for the overflow of Snowmass skiers (up tQ
250). Flush pipe sleeves in the paving will allow for removable
lightgage pipe fences for qu~uing for Snowmass skiers, in place
of the present bulky wooden fencing. (See Queuing Plan).
The Queuing Plan shows an area 40' x 40' which will be
queuing the Snowmass Ski bus passengers, using the
sleeved pipe fence sections to direct the queue
boarding.

In Summer high season, with the present service level, five city
routes will run from Durant (Snowbunny, Highlands, Hunter Creek,
Aspen Grove, and Music Festival) and three county routes
(Downvalley Express, Downvalley local, and Snowmass) wi 11 load
from within the site. A potential of ten auto parking spaces
exist within theDn~site bus.tora,e area, pot. needed during the
summer. Although public parking on the site during "off-season"
has been reduc.dfrom 41 t6 12, the add~dsafety, tonvenience,
am~nity and attractiveness of the site to the general public and
the 3000 to 7000 persons who use this Transit Facility every day
of the year seems to justify the improvements as wise and
prudent. (See Parking Plan).
No designated employee parking on-site is now proposed,
person most often now arrives at th~ site by bus.

Vehicular Circulation is significantly improved over the existing
conditions. Circulation is proposed to become one-way,
clockwise, through and around the site. This allows passengers
to load and unload directly onto pedestrian plaza areas without
crossing traffic. No backing motions will be required. If
summer auto parking for the public is allowed, the backing into
some alley-adjacent angle parking spaces will be required.
However, the one-way pattern of circulation will be maintained at
all bus loading locations, as well as around the entire periphery
of site.

Moreover, the Aspen Area General Plan has identified Rubey Park
as the most appropriate downtown location for a Transit Center,
and this Proposal fulfills that goal of the General Plan.

Draina~e from the site will follow the present sheet flow
drainage to adjacent storm drains. The pedestrian transit plaza
will flow towards Durant Avenue. Seventy-five percent of the
flow will be captured in underground planter drains. The bus
parking area will drain to Valley pan along the alley and take
water to the Mill Street drain. Nosit~ drainage will enter the
alley itself or Galena Street. Twenty-five percent of all

SPA AGREEMENT FOR RUBEY PARK
THIS SPA AGREEMENT made and entered into this
day of
, 1987, by and between the City of Aspen,
colorado, a municipal home rule city (hereinafter referred to as
"City") and the Roaring Fork Transit Agency (hereinafter referred
to as "RFTA").
R E C I TAL S
1. RFTA has submitted to the City for approval, execution
and recordation, an SPA Precise Plan for development (hereinafter
referred to as "Precise Plan") pertaining to the development of
the Rubey Park Transportation Center (hereinafter known as
"project") on a tract of land within the city of Aspen, Colorado,
legally described on Exhibit "A", attached hereto and incor-
porated herein by this reference.
2. RFTA has received all requisite development approvals
from the city for the project.
3. City has fully considered the Precise Plan and the
proposed development and improvement of the lands therein, and
the anticipated benefits and burdens tc other adjoining neighbor-
hood properties in the downtown area in general by reason of the
proposed development and improvement o~ the lands included in the
Precise Plan, all in accordance with Article VIr and other
related provisions of the Municipal Code of the City of Aspen,
Colorado (hereinafter referred to as "Municipal Code").

4. The City has fUlly considered the Precise Plan and
finds that the Precise Plan submitted by RFTA has met the
standards set forth in Section 24-7.7(a) of the Municipal Code;
that RFTA has met its burden and demonstrated the reasonableness
and suitability of the Precise Plan; and conformity to the
requirements of Article VII of the Municipal Code; that the
adverse effects of the proposed development ~ave been minimized
to the extent practicable, and that the project complies with
city Council's intent in originally designating the site with an
SPA overlay.
5. The city is willing to approve, execute and accept for
recordation the Precise Plan on the agreement of RFTA to the
matters hereinafter desoribed, sUbject to all the requirements,
terms and conditions of Article VII of the Municipal Code as
presently constituted and other such laws, rules and regulations
as are or may be applicable.
6. The city has imposed conditions and requirements in
connection with its approval, execution and acceptance for
recordation for the Precise Plan, and such matters are necessary
to protect, promote and enhance the public health, safety and
welfare.
7. Under the authority of Article VII of the Municipal
Code, the City is entitled to assurances that the matters

hereinafter agreed to will be faithfully performed by RFTA and
RFTA's successors and assigns.
8. RFTA is willing to enter into such agreement with and
to provide such assurances to the city.
WIT N E SSE T H:
NOW, THEREFORE, in consideration of the mutual covenants
herein contained, and the approval, execution and acceptance of
the Precise Plan for recordation by the City, it is agreed as
follows:
I. SOIL TESTING
Prior to the issuance of a building permit for any construc-
tion in connection with the project, RFTA shall obtain a soils
analysis of Rubey Park and the alley north of the park, prepared
and certified by a professional engineer. The analysis shall
propose a program and cost for reconstructing to pave surfaces to
accommodate the weight loads of bus traffic.
II. MYLARS
Prior to the issuance of a building permit for any construc-
tion relating to the project, RFTA shall prepare a set of Precise
Plan mylars for recordation, satisfactcry to the City Engineer
and Planning Director. The mylars shall depict the following
elements of the Rubey p~rk plan:
A. Phasing schedule for all proposed improvements, inclu-
ding a note indicating that all improvements to the site and all

improvements to be completed by RFTA shall be completed by June
of 1988.
B. Index sheets for all mylars and separate mylars for:
existing site plan, improvement plan, drainage plan, parking
plan, queuing plan, landscaping plan, Durant elevation drawings,
depot plan, ski/boot/bicycle storage plan, interim operations
plan, south elevation, east elevation, and north elevation.
C. The depiction of the areas of the parking lot in which
the buses shall turn off Mill street and on to Galena street.
There shall be a note indicating that these areas shall be paved
with concrete.
III. MAINTENANCE RESPONSIBILITY
City agrees that the it shall be responsible for maintenance
and snow removal of all pedestrian, landscap~d and vehicular
areas.
IV. POTENTIAL FIRE HYDRANT CONFLICT
In the event conflicts arise between proposed improvements,
RFTA shall be responsible for the cost of relocating the fire
hydrant to a location acceptable to the city Water Department.
V. HANDICAPPED ACCESS
RFTA shall construct handicapped access curbs.
VI. REPRESENTATIONS
RFTA hereby agrees to adhere to all representations made in
the SPA review process.

VII. GENERAL PROVISIONS
A. Notice. Notices to be given to the parties to this
agreement shall be deemed given if personally delivered or if
deposited in the United states Mail to the parties by registered
or certified mail at the addresses indicated below, or at such
other address as may be substituted upon written notice of the
parties or their successors and assigns:

B. Bindinq Clause. The provisions hereof shall run with
and constitute burden upon the title to the subject property, and
shall be binding upon and inure to the benefit of RFTA, city and
their respective heirs, personal representatives, successors and
assigns.
C. APPlicable Law. This agreement shall be SUbject to and
construed in accordance" with the laws of the State of Colorado
and the Municipal Code of the city of Aspen.
D. Severability. If any of the provisions of this
agreement or any paragraph, sentence, clause, phrase, word or
section or the application thereof in any circumstances is

invalidated, such invalidity shall not affect the validity of
any such provision, paragraph, sentence, clause, phrase, word or
section or any other circumstances shall not be affected thereby.
E. Incorporation of Recitals and written Submittals. city
and RFTA stipulate and agree that the "recitals" preceding this
agreement and all the written submittals (as amended and pres-
ently effective) made by RFTA to City throughout the course of
the RUbey Park SPA approval process shall be deemed to be a part
of this agreement and incorporated herein by this reference.
F. Entire Aqreement; Amendment. This agreement contains
the entire understanding and agreement between the parties herein
with respect to the transactions contemplated hereunder and may
be altered or amended from time to time only by written instru-
ment executed by each of the parties hereto.
G. Acceptance of SPA Precise Plan; Ratification bv RFTA.
Upon execution of this agreement, the city agrees to provide, to
approve and execute the SPA Precise Plan for Rubey Park, and to
accept the same for recordation in the recording office of Pitkin
County, Colorado, upon payment of the recordation fee and cost to
City by RFTA. For its part, RFTA hereby ratifies and confirms
each and every representation set forth in the plan, and made in
the course of submittals and hearings (as amended and presently
effective), upon which approval is granted and may have been
based.

INTRODUCTION: The Roaring Fork Transit Agency (RFTA) and the city
of Aspen are seeking Precise SPA (Specially Planned Area)
approval for an improvement plan for the Rubey Park bus terminal.
The city Council has previously granted RFTA conditional Concep-
tual SPA approval. This memorandum addresses the Precise Plan
submission and the conditions imposed by the city Council during
the previous review stage.
BACKGROUND: Attachments 1-9 which are listed below depict the
basic elements of the Rubey Park plan which will be referred to
through out this memorandum.

During the city Council review of the Conceptual SPA the follow-
ing conditions were imposed upon the applicant.
1. All representations made in the application will be
adhered to.
2 The applicant will be required to comply with proce-
dures of Sections 24-7.5, 24-7.6, 24-7.7 and 24-7.8 of
the Municipal Code which address SPA plans.
3. The Precise Plan shall document the quantity of indoor
and outdoor ski and boot storage which will be avail-
able on the site.
4. The Precise plan shall describe the paving materials
which will be used for all pedestrian areas.

5. As part of the Precise Plan Submission the applicant
shall provide a detailed analysis of the functional bus
requirements at Rubey Park including an analysis of
pedestrian queuing and bus staging. It is recommended
that bus storage areas be reduced if functionally
possible and eliminated at a future time when parking
is available at an alternate location ( it should be
noted that the applicant has already responded to this
recommendation as shown in attachment 2A).
6. RFTA shall prepare a proposal in the Precise Plan for
mall extensions to assist the city in budget process.
7. RFTA shall work cooperatively with the City of Aspen to
complete the mall extensions this summer and fall.
8. In preparing the Precise Plan, the applicant shall meet
with the Parks Department and reach a mutual agreement
regarding the compatibility of trees and buses in the
bus staCking area. The Precise Plan Submission shall
reflect the mutual understanding of the Parks Depart-
ment and the applicant.
9. The applicant will address snow removal in detail in
the Precise Plan.
10. The applicant shall prepare a Precise Plan for drainage
to satisfaction of city Engineer.
11. The applicant will meet with the Electric Department to
address metering, secondary wiring and trenching as
noted within Attachment 8. The Precise Plan Submission
shall address these issues to the satisfaction of the
Electric Department.
12. The applicant will meet with the Engineering Department
to discuss their requirements for curb improvements and
reflect those requirements in the Precise Plan Submis-
sion.
13. The applicant will be required to construct curbs with
handicap ramps.
14. Lighting shall be consistent wi th the rest of the
commercial core and approved by the city Engineer.
15. All utilities will be shown on the site survey as part
of the Precise Plan Submission.
16. A detailed parking plan shall be submitted as part of
the Precise Plan.

17. The applicant will prepare a proposal for a sidewalk on
north side of the alley consisting of rolled mall
bricks and curb. The proposal will include cost
estimates.
REFERRAL AGENCY COMMENTS
1) Engineering Department - The city Engineering Depart-
ment has commented regarding the following four issues
(see attachment 10 for Engineering referral memoran-
dum) :
o The sub-surface soils under Rubey Park and the
alley north of Rubey Park have a high clay content
which become sponge-like when wet. Due to the
poor subsurface RFTA and the city have had to
overlay and rebuild portions of the parking lot
and alley almost every other year. To remedy this
situation, the asphalt and subsurface soils should
be removed and refilled with road base and then
re-paved. Although the excavation and site
preparation is expensive, the road base recon-
struction should take place simultaneously with
the reconstruction of Rubey Park.
o The Engineering Department approves of the Rubey
Park drainage plan which is depicted in attachment
6 with one recommended change. The applicant,
Parks Department and Engineering Department have
met to determine a way to alleviate the drainage
problem by the Galena and Mill street Malls. The
two agencies and the applicant have agreed that
the applicant will install an underground storm
sewer line on the north side of Rubey Park to
collect storm water before it crosses the alley
and ices up during the winter.
o The lighting standards must be single, not double,
to match the standards in the downtown area.
o It is recommended that the applicant try to
increase parking on the site during the off-season
and when the ski buses are not stored on the site.
It is suggested that the planters depicted in
attachment 5 be either reduced in size or removed.

city Attorney - The City Attorney has commented that
the use of streets and public right-of-ways should be
authorized by the city council (see attachment 11).
city Electric Department - The Rubey Park plan does not
pose any special problems for the Electric Department

which can not be resolved during the construction
process (see attachment 12).
4) City Water Department - Planting and landscaping must
not interfere with the existing fire hydrant. In the
event that there is a conflict, the developer must pay
for the expense associated with relocating the fire
hydrant (see attachment 13).
5) Parks Department - The parks Department has offered the
following four comments:
o The sidewalk on the north side of the alley should
be at least 6 feet wide to accommodate the snow
sweeping machine.
o Bill Ness is very concerned about the proposed
drainage plan because it does not alleviate icing
conditions on the Galena street Mall and an icing
problem in front of McDonalds on the Mill street
Mall. The Staff has met with the applicant and we
have agreed on a solution to the problem which is
addressed above under the Engineering Department
referral comments.
o The application does not specify who will maintain
the landscaping and pedestrian areas in Rubey Park
during the non-snow seasons. Prior to considera-
tion of the Precise plan by the City council, the
issue of site maintenance needs to be addressed.
o The application does not address who will be
responsible for snow removal in the pedestrian
areas during the ski season. The Parks Department
is not prepared to remove snow from the pedestrian
areas given the current site configuration. Bill
Ness has commented that if the Parks Department is
going to remove the snow the site should be
designed to accommodate a snow sweeping machine.
ISSUES AND CONCERNS: The following staff review is based on the
review criteria for SPA review plans pursuant to Section 24-7.7
of the Municipal Code.
1. NEIGHBORHOOD COMPATIBILITY
Criteria - "Whether the proposal is compatible with neigh-
boring developments in terms of use, density, height, bulk,
open space landscaping and other site and architectural
design features" (24-7.7 (a)(1)) .

design of the proposal has been altered. The proposed
clocktower has been removed due to budget constraints and
the clock is now proposed for the top of the bus depot
building (see attachment 9). The Planning Office considers
the new location of the clock to be superior to the original
design. It is the intention of the applicant to transplant
all of the existing landscaping on the site. Hopefully,
very few of the existing trees will be lost. The Parks
Departments concern about the suitability of the planters on
the site for landscaping has been alleviated.
Bus storage on the site has been significantly reduced from
eleven buses to just five buses and on-site parking has been
reduced from 21 spaces at Conceptual Plan stage to 12
parking spaces in this submission.
In summary the Planing Office believes that the proposed SPA
plan is compatible with the neighborhood and an improvement
from the Conceptual Plan.
SUPPORT SERVICES
Criteria - "Whether sufficient utilities and roads exist to
service the intended development" (24-7.7(a) (2)).
Review - Comments from the referral agencies indicate that
adequate water, sewer and road capacity exist to serve the
development. Specific comments have been made regarding the
subsurface soil conditions on the site and a sidewalk in the
alley north of Rubey Park. These issues are addressed in
the following sections.
NATURAL SITE FEATURES
criteria - "Whether the parcel is suitable for the intended
development, considering the slope, ground instability and
the possibility of mud flow, rock flow, rock falls, avalanc-
he dangers and flood hazards (24-7.7(a)(3))."
Review - with the exception of the problem of subsurface
soils referenced in the City Engineer's referral comments,
environmental hazards are not of great concern on this site.
However the condition of the subsurface soils is a major
concern to the Precise Plan review. The City Engineer has
indicated that unless the existing soil on the site is
completely excavated and replaced with road base, the
asphalt on the site and the alley will not withstand the
loads from the buses on the site without resurfacing every
other year. The Planning Office con~;ders bi-annual
resurfacing to be an una impact on adjacent
proper J.es as we as a waste of RUblic monies. It is
recommended that the applicant submit an Engineers report
regarding the sUb-surface at RUbey Park and a proposal to

stabilize soil conditions prior to consideration of this
application by the city council.
4 . SITE PLANNING/SITE DESIGN
criteria - "Whether the applicant has creatively employed
land planning techniques such as setbacks, clustering,
screening, buffering and architectural design to preserve
significant view planes, avoid adverse environmental impacts
and provide open space, trails and similar amenities for the
users of the project and the public at large (24-7.7(a)(4)).
Review The application is generally satisfactory with
respect to the site design. The site is to be heavily
landscaped and will function well in serving mass transit
needs. As part of the Precise Plan submission the City
council requested that the applicant address in detail each
of the following specific areas.

Ski and Boot storage - Presently, there is not any
space at Rubey Park devoted to locker storage. The
Precise Plan calls for an increase in locker storage
from the 24 lineal feet proposed at the Conceptual Plan
stage to 27 lineal feet. It is the opinion of the
Planning Office that the locker storage on the site is
insufficient and should be expanded. We continue to
feel that Rubey Park should provide a convem,em: and
~dle place for Snowmass Village based skiers to store
their skiing equipment while they shop, drink or eat
dinner in Aspen after skiing.
It is not clear from the application how many storage
lockers will be provided and how many skis may be
stored on the site. The provision of adequate ski and
boot storage at a bus terminal is a basic resort
amenity that should be provided to Aspen guests. It is
recommended that locker storage be further addressed
prior to consideration of this application by the City
Council. It is essential that provisions be made for
ski storage as well as providing small lockers.
Paving Materials It is proposed that the entire
transit plaza be paved in four foot bands of mall
bricks. The remaining paved area will consist of
concrete which will be colored to compliment the mall
bricks. It is the Planning Office opinion that the
entire paved area should be done in mall bricks and the
concrete paving should be eliminated. As mentioned
earlier, we view the Rubey Park facility as both the
entrance to and extension of the downtown mall.

other should become one consistent public area with
similar lighting, landscaping and paving materials. It
is recommended that all of the paved pedestrian areas
be comprised of mall bricks.
:eedestflan Queuing - The City Council requested that
the applicant address pedestrian queuing in detail as
part of the Precise Plan. Bus queuing is a considera-
tion during the skiing season for the Snowmass ski
buses. Attachment 3 depicts a 40'x40' queuing plan for
the Snowmass ski buses. The queuing area will be
capable of accommodating 250 people. It is proposed
that the queuing areas be delineated by removable
sleeved pipe fence sections. It is the intent of RFTA
to remOve the queuing pipes when they are not needed.
Based upon our review of the queuing plan it appears to
be more than adequate.
Mall Extensions It has been suggested that RFTA
extend the Galena and Mill street Mall approximately
100 feet to Durant street. RFTA contends that the Mall
extensions are beyond their budget and can not be
accomplished. City council requested that RFTA
estimate the cost of the Mall extension as part of the
Precise Plan submission to assist the City of Aspen in
the Capital budget process. RFTA estimates that

As previously mentioned in staff reviews the pedestrian
link between Rubey Park and the Aspen commercial core
via the malls to be vital to the community. It is our
belief that the $50 0 . e to nn The all

revenues which are likely to result from mall exten-
sions that draw Rubey Park pedestrians to the com-
mercial core. Likewise mall extensions from the
commercial core to the transit depot will help to
increase bus ridership.
In our review of Aspen Mountain Lodge PUD Agreement for
Council, we found that the lodge developers had agreed
to contribute $25,000 toward a "study" of Rubey Park
improvements. We suggest that the City call for this
money immediately, and that it be used to fund 1/2 of
mall extensions, with other 1/2 matched by RFTA or
City. (see Attachment 14)
It is the Staff recommendation that the Galena and Mill
street Mall extensions occur simultaneously with the

Rubey Park construction. By concentrating construction
activity within one building season the impacts on the
surrounding residential and commercial areas will be
minimized.
sidewalk At the City council meeting it became
evident that a sidewalk with a rolled curb is needed
on the north side of the alley contiguous with the
transi t center. Presently, pedestrians traverse the
alley to get to either mall and mix with automobile and
bus traffic in the alley. This particular alley has
more pedestrian and vehicular traffic than any alley in
the City and functions more as a street than an alley.
As with other off-site improvements, RFTA has indicated
that they do not have the budget to make the improve-
ments in the alley. It is anticipated that the side
walk will cost approximately $4,500 exclud~ng the cost
of the mall pavers.
The Staff considers the sidewalk to be an essential
off-site improvement which is necessary for the safety
of pedestrians using the RUbey Park terminal. Like the
malls it is recommended that the sidewalk be construc-
ted simultaneously with the Rubey Park construction to
avoid incrementalizing impacts on the neighborhood.
Bill Ness of the Parks Department has indicated in his
referal comments that the sidewalk should be at least
six feet wide to enable the Parks Department to sweep
the side wall in the winter with the snow sweeping
machine.
Restroom Facilities - The city Council required the
applicant to add additional restroom facilities. The
Precise Plan shows three toilets within each of the
restroom facilities (see attachment 8). This repre-
sents an increase of one toilet in each restroom from
the conceptual plan submission. It should be noted
that the restrooms will serve the needs of transit
users and the public at large. This improvement is
consistent with the code language referenced above.
5. MASTER PLAN
Criteria - " Whether the proposal is in compliance with the
Aspen Area General Plan (24-7.7(a)(5)).
Review - The Aspen Area General Plan is in the process of
being revised. The Aspen Area Comprehensive Plan: Transpor-
tation Element addresses Rubey Park. The Element calls for
Rubey Park to serve as the City of Aspen's primary transit

center. The Plan also anticipates the loss of parking
spaces at Rubey Park which is associated with the proposed
improvements.
6. EXPENDITURE OF PUBLIC FUNDS
Criteria - Whether the development will require the expendi-
ture of excessive public funds to provide services and
facilities for the site or surrounding neighborhood (Section
24-3.7(a) (6}).
Review - Since the Rubey Park improvement plan is a public
project this criteria is not as relevant as it would be to a
private sector land use application. Nevertheless, it is
worthwhile to analyze whether or not additional public
expendi tures will need to be spent as a resul t of the
proposed project. Based upon our review, the Planning
Office had identified capital improvements such as mall
extensions and sidewalk construction which should be made in
association with the Rubey Park improvements. These
improvements will result in significant public benefits and
should be coordinated by the City and RFTA to occur simul-
taneously to minimize disruption of the neighborhood.
Additionally, the comments from the City Engineer regarding
sUb-surface conditions on-site and in the alley indicate
that if RFTA does not prepare the site properly and the City
does not reconstruct the alley, the public sector will incur
significant costs bi-annually patching and re-surfacing
asphalt.
7. MISCELLANEOUS ISSUES
Two miscellaneous issues are addressed in this section.

Snow Removal - The City of Aspen will provide snow
removal for the vehicular traffic areas, but it is
unclear who will remove the snow from the pedestrian
areas. Prior to City Council review of the plan, the
applicant should present a proposal for snow removal in
the pedestrian areas to the planning Office.
Interim operations Plan - The applicant proposes using
Durant Street in front of Wagner Park for the interim
bus station. The plan would require posting "no
parking" signs on the north side of Durant Street.
RFTA proposes installing a temporary trailer or wooden
structure on Durant or Mill Streets as a temporary
information booth.

SUMMARY AND RECOMMENDATION
Based upon our review of the Rubey Park Precise Plan it is the
Planning Office opinion that the proposal includes significant
inadequacies and opportunities. RFTA and city of Aspen have
demonstrated a lack of coordination in planning on and off-site
improvements. Likewise, RFTA has failed to address a very
significant issue with respect to soil conditions on the site.
The project should not be initiated until the sub-soils and
paving issue is resolved and on and off-site public sector
capital improvements are coordinated by the City and RFTA.
The re-development of Rubey Park presents a major opportunity for
RFTA and the City of Aspen to coordinate capital improvements so
that the mall is extended, a sidewalk is constructed on the north
side of the alley and the alley is reconstructed simultaneously
with the Rubey Park re-development. It is our opinion that it is
unfair to residential and commercial neighbors to stagger these
improvements so that construction impacts occur twice. The
$25,000 fee which the Aspen Mountain Lodge has committed should
be called in and matched by the city so that all construction at
Rubey Park and in the vicinity occurs at once.

of Aspen that on-site and off-site improvements are made simul-
