No. 23, Series �I A997 of 1996) t CC: Sara Thomas, Vicki Monge OOMMUNITIDEVEt GT(OFASPEN SUMMARY OF REQUEST: Attached is a letter from Phil Overeynder, Water Director, requesting an insubstantial amendment to an approved Final Plat for the Waterplace Housing project and the water treatment plant. The applicant is requesting several changes to the development order that was approved under Ordinance No. 23 (Series of 1996), which 1 believe to be more accurately associated with the SPA rather than the final plat. From review of the original casefile (A23 -96) it appears that the intent of the final plat was simply to create a separate lot for the development of affordable housing. The actual layout and plan of the water treatment facilities was addressed in the SPA. The three changes being requested by the water department are as follows: 1. Relocation of the 4200 s.f storage building approximately 100 ft. north of the approved location to minimize impacts on existing native oaks. 2. The administrative office which was to be located as a second floor above the west plant is now being proposed above the east plant sedimentation basin. 3. New metal roofs are proposed to be added to both the east and west plant buildings to reduce maintenance costs associated with the existing flat roofs. The new roofs are designed similarly to the new roof for the proposed administration building. ANALYSIS: Under Section 26.80.040 E., "An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director." The code then goes on to describe those items that are NOT considered an insubstantial amendment. Staff has reviewed the three proposed changes against the following review criteria: a. A change in use or character of the development. The use remains the same as originally proposed. The structures will be somewhat shifted, but they will not change the character of the existing water treatment facilities. The request to shift the storage building approximately 100' north was actually approved by insubstantial amendment dated January 24, 1997 (attached). b. An increase by greater than 3% in the overall coverage of structures on the land. The storage building is being relocated, but there is no increase in the size of the structure. (The original land use application indicated that the storage building was intended to be 3960 s.f., but could be increased up to 20% more. The 4200 s.f. currently proposed is well within the 20% increase originally approved. See attached page 17 from the original submittal ). The administration building above the sedimentation basin is a smaller footprint than the existing sedimentation basin. There is no increase in the overall coverage of structures on the land. c. Any amendment that substantially increases trip generation rates of the proposed development, or the demand for public facilities. The minor amendments will not have any affect on trip generation rates nor the demand for public services as compared to the original proposal. d. A reduction by greater than 3% of the approved open space. There is no reduction in approved open space. e. A reduction by greater than 1 % of the off - street parking and loading space. There is no reduction of the off - street parking and loading space. f. A reduction in required pavement widths or rights -of -way for streets and easements. There are no streets or easements affected by this amendment. g. An increase of greater than 2% in the approved gross leasable floor area of commercial buildings. These are public facilities and not commercial buildings. There is not an increase in gross leasable floor area. h. An increase by greater than 1% in the approved residential density of the development. The residential portion of the Waterplace project is not affected by the water treatment plant improvements. i. Any change which is inconsistent with a condition or representation of the projects original approval or which requires granting of a further variation from the project's approved use or dimensional requirements. None of the proposed changes require the granting of a further variation from the project's approved use or dimensional requirements. This proposal does not fall into any of the above criteria, therefore it is eligible for an insubstantial amendment through the Director. RECOMMENDATION: Staff recommends that the Community Development Director approve this insubstantial amendment to the SPA, with the condition that an amended SPA drawing be submitted to the file, and to casefile A23 -96 reflecting these changes . The proposed changes represent minor revisions which are necessary to deal with structural conditions in the West Plant. Because of these conditions, it not economically feasible to place a second floor office.over the West Plant as originally'proposed:' 1. The location of the new 4,200 s.f storage building, storage bins and pipe yard,area has been moved and located approximately 100 ft. north of the originally proposed site to minimize disturbance of the native Gamble Oaks. This modification has been previously approved by your office. 2. The administrative offices, restrooms, lunch room and conference room which were approved to be located in a new second floor space above the West Plant are proposed to be moved to a new location. The new location is above the East Plant sedimentation basin. Detailed plans and elevations for this newlocation have been provided separately. 3. New metal roof structures are proposed to be added to the existing East and West Plant buildings to address the inadequate structural capacity'of the existing flat roofs to' hold the snow' load, and to address high maintenance costs associated with the existing flat roof structures utilizing a membrane waterproofing. Leakage and snow removal are continuing maintenance problems with both existing roof structures. When the project was reviewed, basements were not indicated on the plans. Because the units are fairly small, the city believes that a full basement for each unit is necessary to ensure adequate storage for employees. There is no change to the footprint of the buildings, and basements do not add to the FAR- Under Section 26.84.080, "An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The code then goes on to describe those items that are NOT considered an insubstantial amendment. The existing 250 square foot chlorine storage building will be expanded by approximately 250 square feet to house a 1 ton chlorine scubber. S. Expanded electric shed to include approximately 450 additional square feet added to the south end of the existing 1,100 square foot structure. This structure will be used to store Electric Department equipment and materials. The expansion will be constructed of metal to match the existing building. the only utility servicing the building will be electric. 6. Constriction of new transformer storage yard to consist of grading a level platform only located adjacent to the electric shed. 7. Construction of a new Water Department storage building consisting of approximately 3,960 square feet and will be constructed of concrete block or steel with a metal roof. This structure will be a design build contract from the City and therefore finish design may vary slightly from that provided at this submission. In the event that substantial revisions are required, such as an increase in square footage by more than 20% or building height by more than that allowed within the Public Zone district. The front elevation will have standard bays with overhead doors in front of each bay. The purpose of this building will be for Water Department vehicle and equipment storage. The only utility servicing the building will be electric. S.
