l\GREEMENT
This agreement is enteted into this IS'" day of July, 2000 between the City of Aspen, Pitkin County, Colorado, hereinafter
referred to as "ASPEN", and Arja P. Adair, JI. at 5375 South Geneva Way, Englewood, Colorado S0111, hereinafter referred to as
"Owner",
WHEREAS, the Owner is the owner of the property described as 12S/130 Park Avenue. Aspen, Colorado, legally known as
the northern half of the Hobgood Parcel of the Hobgood-Burres Subdivision, Aspen, Colorado.
WHEREAS, the Owner seeks the approval of ASPEN for the design of his driveway as defined by the improvement survey
including drive profile attached herein as Exhibit A.
WHEREAS, said jrivewJ!Y design includes a grade of 16% :t which exceeds the 'Aspen City' code maximum grade of 12%.
WHEREAS, ASPEN has the authority to conditionally approve said drive design,
THEREFORE, in consideration of the mutual agreement hereinafter contained, ASPEN and Owner covenant and agree as
follows:
1. Approval of the driveway as defined in Exhibit A is hereby granted to Owner.
2. Owner hereby agrees to save, defend, and hold harmless ASPEN against any and all claims, for damages, costs and
expenses specifically caused by the driveway grade on owner's property in excess of 12% to persons or property that
may arise out of or be occasional by the use, occupancy and maintenance of said driveway.
3. This agreement shall be binding upon and inure to the benefit of the parties hereto their representatives, successors
and/or assigns.
IN WITNESS WHEREOF, the parties execute this Agreement the day and year first written.
