Dear Mr. Adeh:
This letter shall service to confirm the pre-payment arrangements for the curb and gutter
improvements for 215 West Francis Street in Aspen's West End.
Penninsula LLC, the owner of the above referenced property, acknowledges that it is
responsible for the construction of a curb and gutter in front of this property pursuant to Section
.1""'" 21.16.030 of the Aspen Municipal Code; and, the City of Aspen acknowledges that the
"-- construction of curb and gutter at this time is not prudent or feasible,
The amount of$5,250 will be contributed by Penninsula, LLC to the City of Aspen in lieu
of installing curb, gutter and pavement. This amount is based on an estimated construction cost
to install 60 feet of curb and gutter and 390 square feet of asphalt.
Penninsula, LLC understands that the City is under no obligation to use Penninsula,
LLC's contribution for curb and gutter on West Francis Street, nor is the City under any
obligation to ever install curb and gutter on Francis Street.
In the event that curb and gutter is ever installed on Francis Street, Penninsula, LLC
and/or any successor in interest may be asked by the City to join their neighbors in contributing
to the project. At this future date, the City, and not the owners of215 West Francis Street, will
pay for the construction of 60 feet of curb and gutter and 390 square feet of asphalt paving in
front of215 W. Francis Street.
