AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
AMENDING SECTION 23.04.010 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN
TO AMEND THE DEFINITION OF "CHARITABLE ORGANIZATION" FOR TITLE 23
(TAXATION) OF THE ASPEN MUNICIPAL CODE.
WHEREAS, ordinance No. 26, Series of 1992, was adopted by the City Council to
codify various ordinances relating to taxation; and
WHEREAS, a typographical error was made in that codification which alters the intended
definition of the term "charitable organization"; and
WHEREAS, the City Council desires to correct that error.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
ASPEN, COLORADO:
Section 1.
That Section 23.04.010 of the Aspen Municipal Code is hereby amended to change the definition
of "charitable organization" as follows:
Charitable organization. Any entity that:
(1) Has obtained tax exempt status as a charitable not-for-profit organization pursuant to
Section 501(c)(3) of the Internal revenue Code; or
(2) Is a religious organization or an organization which exclusively, and in a manner
consistent with existing laws and for the benefit of an indefinite number of persons, freely and
voluntarily ministers to the physical, mental, or spiritual needs of persons, and which thereby
lessens the burdens of government.
Section 2.
This ordinance shall not have any effect on existing litigation and shall not operate as an abatement of
any action or proceeding now pending under or by virtue of the ordinances amended as herein provided,
and the same shall be construed and concluded under such prior ordinances.
Section 3.
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held
invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and shall not affect the validity of the remaining portions hereof.
A public hearing on the ordinance shall be held on the~ day of ~, 2000, in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
