AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
AMENDING CHAPTER 13.08 OF THE ASPEN MUNICIPAL CODE TO ELIMINATE
ANY REFERENCE TO THE CLEAN AIR ADVISORY BOARD
WHEREAS, the City Council previously disbanded the City's Clean Air Advisory
Board and withdrew all of their powers and authority pursuant to the Aspen Municipal Code;
and
WHEREAS, the City Council now desires to eliminate any reference to said board from
the Aspen Municipal Code keeping in place all other provisions relating to air quality.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ASPEN,
COLORADO, AS FOLLOWS:
Section 1.
That Chapter 13.08 of the Aspen Municipal Code, which chapter relates to the
regulation of air quality in the City of Aspen, shall be amended as follows:
Section 13.08.020 that relates to definitions used in Chapter 13.08 shall be amended to
repeal sub-section (a) "Board"; and
Sections 13.08.030, 13.08.040, 13,08.050 and 13.08.060 are hereby repealed.
Section 2.
This ordinance shall not have any effect on existing litigation and shall not operate as an abatement of
any action or proceeding now pending under or by virtue of the ordinances mended as herein provided,
and the same shall be construed and concluded under such prior ordinances.
Section 3.
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held
invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and shall not affect the validity of the remaining portions hereof.
A public hearing on the Ordinance shall be held on the llth day of September 2000, at
5:00 O'clock pm in the City Council chambers, Aspen City Hall, 130 S. Galena St. Prior to
such hearing a public notice of the san~e shall be published in a newspaper of general
circulation within the City of Aspen.
