(Series of 1985)
AN ORDINANCE APPROVING THE TERMS OF A PURCHASE AND SALE AGREEMENT
BETWEEN THE CITY OF ASPEN AND STEPHEN SCHUBERT FOR THE SALE OF THE
ANIMAL SHELTER BY STEPHEN SCHUBERT TO THE CITY OF ASPEN AND
AUTHORIZING THE M~YOR TO EXEGUTE SAID AGREEMENT ON BEHALF OF THE
CItY
WHEREAS, there has been submitted to the City Council a pro-
posed purchase and sale agreement between the City of Aspen and
Stephen Schubert, and
WHEREAS, the home rule charter of the City of Aspen, Colo-
rado, requires that all such agreements must be approved by ordin-
ance,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That it does hereby ratify the purchase and sale agreement
between the City of Aspen and Stephen Schubert, attached hereto
and incorported herein by this reference, and does further
authorize the Mayor to execute said purchase and sale agreement
and all other documents necessary to complete said sale on behalf
of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on the /~
day of ~/~/ ..... , 1985, at 5:00 p.m. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
