AN ORDINANCE APPROVING THE TERMS AND CONDITIONS OF A SUPPLEMENTAL
AGREEMENT BETWEEN THE CITY OF ASPEN, COLORADO, AND THE MUNICIPAL
ENERGY ~GENOY OF NEBRASKA ESTABLISHING A METHOD WITH REGARD TO THE
PAY-BACK OF CARRYING CHARGES ASSOCIATED WITH CONSTRUCTION COSTS
FOR A TRANSFORMER REQUIRED BY COLORADO UTE AND THE COST SHARING OF
MAINTENANCE OF A 25KV;UNDERGROUND LINE BELONGING TO HOBY CROSS
ELECTRIC AND DIRECTING THE MRYOR TO EXEGUTE SAID AGREEMENT ON
BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council a sup-
plemental agreement between the City of Aspen and the Municipal
Energy Agency of Nebraska which agreement establishes a method for
the pay-back of carrying charges associated.with construction
costs for a transformer required by Colorado ~Ute and the cost
sharing of maintenance of a 25ky underground line belonging to
Holy Cross Electric.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve a
supplemental agreement between the City of Aspen and the Municipal
Energy Agency of Nebraska establishing a method for the pay-back
of carrying charges associated with construction costs for a
transformer required by Colorado JUte and the cost sharing of main-
tenance of a 25ky underground line belonging to Holy Cross Elec-
tric, .which agreement is attached hereto and incorporated hereiM;
and does further authorize the Mayor to execute said supplemental
agreement on behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional in a court of competent jurisdiction, such portion shall

be deemed a separate, distinct and independent ~ovision and shall
not affect the validity of the remaini~ portions thereof.
Section 3
A public hearing on the ordinance shall be held on the ~
