ORDINANCE NO. ~
(Series of 1985)
AN ORDINANCE APPROVING THAT AGREEMENT BETWEEN THE CITY AND THE
COUNTY WHEREBY THE COUNTY HAS AGREED TO CONVEY AND THE CITY HAS
AGREED TO ACCEPT WAGNER PARK AND THE COUNTY TRAIL SYSTEM AS REFER-
ENCED, INCLUDING TRAILS EQUIPMENT; TERMINATING THE JOINT MAINTEN-
ANCE AND POLICING AGREEMENT BETWEEN THE PARTIES DATED SEPTEMBER
13, 1976; AND DIRECTING THE MAYOR TO EXECUTE SAID AGREEMENT ON
BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council an
Agreement between the City and Pitkin County terminating the joint
maintenance and policing agreement between them and wherein the
County agrees to convey and the City agrees to accept Wagner Park
and the County trail system referenced in the agreement, including
trails equipment, a copy of which is attached hereto and incor-
porated herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve the
Agreement between the City and Pitkin County providing for convey-
ance by the County and acceptance by the City of Wagner Park and
those portions of the County trail system referenced in the agree-
ment, including trails equipment, and terminating the joint main-
tenance agreement between the parties dated September 13, 1976,
and does further authorize the Mayor to execute said Agreement on
behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional in a court of competent jurisdiction, such portion shall
be deemed a separate, distinct and independent provision and shall
not affect the validity of the remaining portions thereof.

A public hearing on the ordinance shall be held on the
