CHAPTER 23 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, AS AMENDED. ENTITLED "UTILITY CONNECTION CHARGE", (AND THEREBY AMENDING ORDINANCE NO. 19, SERIES OF 1984, AND ORDINANCE NO 58, SERIES OF 1984) BY ENECTIh~ THE THIRD YEAR OF A PHASED INCREASE IN CERTAIN WATER UTILITY CONNECTION CH~%RGES. WHEREAS, the City Council ("Council") of the City of Aspen, Colorado ("City"), desires that water utility connection charges provide adequate capital contribution; and WHEREAS, the Council desires that such connection charges be fairly and equatable assessed according to demand on the City's municipal water utility; and WHEREAS, the Council desires to charge the cost of borrowing money for water improvements allocated to future users through tap fees phased in over a period of time and, therefore, the following increases in Sections 23-58 (b) and 23-58(d) represent the third of four annual twenty percent (20%) increases to meet said borrowing costs; NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN COLORADO= That Sections 23-58 (b) and (d) of the Municipal Code of the City of Aspen Colorado, be and hereby are amended to read as follows~ Sec. 23-58 (b) In the event that a connection or proposed connection does not fit within the categories provided in subsection (c) hereof, the Director may make a separate B~R determination, or may require that such determination be made by the City's engineer at the applicant's expense. Se ct i on~ If any section, subsection, sentence, clause, phrase or portion, of this ordinance is for any reason held invalid or unconstitutional by any court of comgetent jurisdiction, such provision shall be de~ed a se~arate~ distinct and independent provision and such holding shal~ not affect the validity of the r~aining 9rovisions thereof.
