ORDINANCE NO.
(Series of 1985)
AN ORDINANCE REPEALING AND REENACTING SECTION 19-49 OF THE ASPEN
MUNICIPAL CODE PROVIDING NEW FEES FOR EXCAVATION PERMITS AND
PAVEMENT REPLACEMENT
WHEREAS, the City Council desires to repeal and reenact
Section 19-49 of the Aspen Municipal Code to provide new fees for
excavation permits and pavement replacement for the benefit of the
City of Aspen,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 19-49 of the Aspen Municipal Code is hereby
repealed and reenacted to read as follows:
"Sec. 19-49. Fees.
No permit shall be issued unless the applicant therefor shall
have first paid the required fee determined as follows:
(a) An inspection fee of twenty-five dollars ($25.00) shall
be assessed for each permit except when the work is
being performed directly by or for the city.
(b) In addition to the inspection fee the following fees
will be assessed when the city must replace paved
improvements:
Asphalt paving . $5.50/sq.ft.
Concrete paving or sidewalk . $6.00/sq.ft.
Concrete curb and gutter .$18'00/sq.ft.
Pedestrian mall brick structure .$10.50/sq.ft.
Replacement bricks . $6.50/sq.ft."
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.

A public hearing on the ordinance shall be held on the
