The applicant is requesting an amendment to an approved
condominium plat necessitated by a surveyor'serror~iUnder
Secti on 20-2l(b) of the Code, the Pl anningandZohing Conlmissjon
grants final approval on an amended fi nal plat where Jhe '

The Engineering Department feels this amendment to ,die ,condo-
minium plat is not an engineering or surveyor's erro'r.and. "
thus, should be required to comply with subdivision reglJla~ .
tions. Engineering feels the change results from a devefoper's
error since the platting was. done twice (1978 and 1980) by
two different surveyors, both obtaining the same number of
offices as found in the unamended plat. Other comments by
Engineering include:
1. The change does not increase the floor area.
2. The change will form an additional ownership by adding
a new condominium unit.
3. The unitsi.n question, 201 and 202, are not numbered the
same way on the plat as they are on the building and should
be reversed on the plat so the numbering agrees.
The City Attorney emphasized that the proposed change should
definitely reflect an engineering or survey error or the
appl1cation should be sumbitted to subdivision procedures.

verbally and in writing, feels thi.s change in the condominium
plat has resulted from a surveyor's error. The amendment is
to a 11 ow one offi ce, Unit 201, to be split into two offi ces,
Units 201 and 202. The total floor area will not change. The
wall separating the proposed units is currently in existence
as it was part of the original plat. The change will result
in one additional office condominium unit.
If the Planning and Zoning Commission disagrees and feels the
application should go through subdivision procedures, the
application should be considered as a subdivision exception.
Thus, instead of granting approval under this special review
(Section 20-21(b))'the Commission should make a recommendation
to Council regarding the revised plat (Section 20-19).
The Planning Office recommends the Planning and Zoning
Commission grant approval of the amendment to the condominium
plat for Park Central West under the special review described
in Section 20-21(b) of the Qode subject to the condition that
the numbers on Units 201 and 202 on the building coincide with
the .unit numbers of the revised condominium plat.

Amendment to Condominium Plat
After reviewing the above, the Engineering Department has the
following comments:
1. The changes are to form an additional ownership.
2. The change does not increase the floor area.
3. The changes shown are developer errors, not Survey
or Engineering. The original platting of this condominium,
drawn by Gerard Pesman, recorded in November, 1978 with the
most recent platting drawn by Ken Glenn, recorded in November,
1980, both show the same office space.
4. This recent platting of the condominium was held up
for a time so'all spaces could be identified.
5. The Units 201 and 202 are numbered wrong per the plat.
Mr. Nicholson might like to change the plat so it will agree
with the numbering on the building.
The Engineering Department suggests that this request is to
re-subdivide a portion of an existing condominium and should be
required to comply with the subdivision regulation.

Plat
The Nicholson application avpears to request the future
subdivision of office No. 201 (as indicated on the plat)
into two offices, Nos. 201 and 202. Section 20-2I{a) of
the code provides that any change to a recorded plat
shall require full compliance with the subdivision regu-
lations. Thus, unless the proposed changes reflect
merely an engineering or survey error in the presently
recorded final plat, the plat accompanying the applica-
tion must be submitted to full subdivision procedures.

Dear Mr. Richman:
Pursuant to Aspen Municipal Code, S20-21(b), Resubdivision and
Engineering Errors, we are submitting for Planning & zoning
Commission approval four copies of the following items:
Sheets 1 and 2, Park Central West Condominium
Map as recorded November 11, 1980 in Plat Book
10, Page 71, of the Pitkin County Recorder.
These sheets have the two proposed corrections
on each page marked in red.
These corrections do not change the use, occupancy, floor area,
our present ownership, parking, etc., and have no effect on any
of the other condominiums.
We respectfully request that the matter be on the Planning &
Zoning agenda for November 17, 1981.
