Employee housing units constructed as part of a commercial GMP project require approval of Council upon recommendation of p & Z. The Whale of a Wash has to have a special review for an FAR bonus as well as HPC approval. The Rubey Park visitors center needs to be rezoned to SPA, ,,' have an SPA plan adopted and get HPC approval. Ms .Penne told Council if they agreed ~l with ilb.e P Sc Z recommendation, they should approve Resolution #32, Series of 19B2. !; Bil Dunaway asked if the Rubey Park Visitors Center had to receive voter approval. Manager Chapman said Rubey Park was paid for out of the general fund, not with six seventh penny funds. The Charter requirement that there be voter approval because space funds does not apply. II I' i. 11 Councilwoman Michael moved to approve Resolution #32, Series of 1982; seconded by Council- man Knecht. City .and :! of open H II II , " l; !: I' ;\ Ii Monroe Summers told Council that the current zoning of Rubey Park, T, Transportation, allows food service operations in support of a public facility. Summers said he feels that the ' public facility uses of the building, the transportation elements, hallways, restrooms, food service operations, lockers, all are exempt from competition under growth management. Mayor Edel said a restaurant is a commercial venture and should be cQunted. Vann said the zone allows certain uses as assessory to the transportation function; the applicant will have to come in in a subsequent review process and convince Council the nature of any operation is in fact accessory. Whether or not Council concurs, is a separate issue. Councilman Collins questioned the s,quare footage on Rubey Park. Ms. penne said commercial square footage requested is 5810 square feet. There are other areas considered accessory to the type of use. There are subsequent reviews for this Councilman Collins asked what the rest of the area is as the total build out is S8l0.square feet. Ms. Penne said there is employee housing, public space. the total that are project. more than ~ LI U Councilwoman Michael asked how this allocation for GMP commercial project-can come to .Council with a proviso the rest of the project will be dealt with later. Vann told Council i: the applicant competed for 5810 square feet of commercial space. The applicant believes that certain uses are accessory to the public function of the building. Council, upon P & Z recommendation, must make the determination about the rest of the project. Vann said:' if Council does not agree about the rest of the project, the applicant will have to amend his application. If the applicant has to compete,in the growth management competition for the rest of the square footage, he will have to wait until the next competition. Vann said in public facilities of a transportation nature, he felt it would be appropriate for a commerciaL support to have something like coffee and doughnuts. Vann said if Council does: decide to exempt the accessory uses, it will be s,object to mitigating the impacts of that space. Council may exact, as a condition of exemption, if there is employee' housing generated, that they meet that need. Summers said there is a provision in the Code exempted food service operations in support of public facilities. If Council does. not concur that the proposed food service square footage is an accessory use, the project will have to go back through GMP or not be. Summers said the question is how much, or what, will be exempted. All in favor, Councilman Parry abstained. Motion carried. ORDINANCE #63, SERIES OF 1982 - Land Use Code Referral Fees Environmental Health Officer Tom Dunlop told Council the county has chosen not to address this ordinance so Council should not address it. ORDINANCE #64, SERIES OF 1982 - Food Service Establishment Fees Tom Dunlop, environmental health department, told Council as a result of escalating costs, he is trying to generate more revenues. Dunlop said the environmental health department could charge for checking food service paIns for new and remodeled restaurants. Dunlop said this would generate $2,000 a year. The department is not self-supporting but they are trying to lessen the impact on the general fund. Councilman Collins said every time the city prOVides a service to the citizens, they put the burden on, them. There is already a fee paid to the building department for plan checks. Councilman Collins pointed out this would only raise a few thousand and would prefer not to charge businesses again. Council agreed with this. Council told Tom Dunlop his department was doing a good job. MAIN STREET TRAFFIC LIGHTS . Jay Hammond, engineering department, reminded Council there has been concern over the sequencing and the lengths of the traffic lights. Hammond met with the police chief and Councilman Parry. The feeling was the sequences at Monarch and Aspen were too long a wait Mill and Main' it is important to maintain a separation between the traffic and pedestrians This means keeping the pedestrian sequence and the no righ~ turn on red. Hammond. said the green sequence on the Mill street side will be lengthened. The stop signs on MOnarch and Bleeker will be reversed to create a direct alternative between Mill and Aspen. Hammond told Council the department of highways has had personnel in Aspen for awhile attempting to repair some of the electrical problems with the system. Hammond said that the syncronization of the three lights is not working. Hammond said he feels the city should go to the department of highways and tell them the system is not working, and that the lights should be repaired and functioning before winter, or replace the system. Council agreed to have.a meeting with the highway department as soon as possible. IJ ENCROACHMENT REQUEST - prospector Lodge Herb Paddock, representing the applicant, told Council they are requesting an encroachmen1 license on the Hyman Avenue side of 4 inches in a couple of areas. SUBDIVISION EXCEPTION - Little Victorians D Co1ettePenne, planning office, told Council this is a request for subdivision exception to condominiumize eight units know as the Little Victorians located at 634 West Main. Ms.!, Penne said these units have all rented outside the income guidelines for the past eighteenl months. Councilman Parry moved to approve subdivision exception for the purpose of condominiumiza-" tion of the Little Victorians apartments at 634. West Main with the following conditions; ~ (1) improvements necessary to the building from the results of the building department it inspections as summarized in the Octoberl8, 1982, and October 19, 1982, building depart- 11 ment memos must be made prior to the sale of any unit: (2) compliance with Section 20-22; ~ (3) statement of exception from the full subdivision process for the purpose of condo- I' minimization and a declaration of restriction covenants be executed on forms approved by . the city attorney; seconded by Councilman Collins. Randy Cote, COlorado Division of Wildlife, said that if leghold traps are used properly the way they were intended, most injuries can be ! done away with. Cote said education of using traps would be more appropriate than banning!: them. Cote said once animals are trapped, it makes it much more difficult to trap them il again. Lisa Russell, animal control department, said dogs have been caught in these [! traps a~d one dog had to have his leg amputated. Assistant City Attorney Gary Esary i suggested amending the ordinance to allow the city manager to issue a permi~ to trap in I time of danger, animal disease, etc. Council agreement Mayor Edel closed the public hearing. . The letter asks for a 4-inch encroachment for rock veneer on the front of the building. However, since the letter was written, the applicant has amended his request to include an additional 52- square foot encroachment and a 28-square foot encroachment for required stairwells. Herb Paddock will be present to represent the applicant. A photo- copy map of the requested encroachments and a draft encroachment agreement are also attached. A marked improvements map will be available at the meeting. I spoke to Jay Hammond about this application and he grudgingly approves it. According to Jay, it was poor design to build to the property line without providing for required access, but given the present location of the building, the encroaching stairwells appear to be the only solution. Further, according to Jay, the encroachments at least still provide for the minimum eight-foot sidewalk width. Finally, although the City has apparently granted minor encroach- ments in the past without cost and as a matter of course (the Woodstone and the Patio Building come to mind), the size of this encroachment may lead the City to consider a payment for this encroachment, either as a periodic rental or a one-time fee. The attached survey verifies this situation. Per section 19-5 of the City of Aspen Municipal Code, I am requesting an encroachment license from the City of Aspen on behalf of the owner. A prompt scheduling for City Council review would be greatly appreciated. Additionally, I am working to obtain the necessary approvals from the Historic Preservation Committee due to unauthorized changes by the previous general contractors. Those changes are scheduled to be heard by the H.P.C. on October 12th. Finally, I am preparing a request for an ammendment to the Conditional Use approval to the Planning and Zoning Connnission. Due to the addition of the Mechanical ~oom in the Parking Garage, there has been a reduction in the number of parking spaces from 17 to 16. I hope to have this scheduled for the November 16th Planning and Zoning Commission meeting for their review. Thank you again for your assistance in addressing the encroachment problem. Motion carried. Sunny Vann told Council this is a request for growth management exemption for an employee .: hOUSing unit to be constructed in the remodeled and expanded Prospector Lodge. This lodge:! is a conditional use in the CC zone district. The proposal has gone through P & Z and :! ape. The applicant is seeking approval for a proposed employee unit to replace an older unit; the proposed unit is 630 square feet. Dave Gibson told Council the old building will be torn down and redone. The new unit will have kitchen, bathroom, bedroom, etc. COuncil brought up who would occupy the unit; Gibson answered it is intended for an employee of the lodge. Councilman, Behrendt noted this is proposed to be 'a moderate unit. Jim Reents, housing director, said one factor is that this is new construction. Another POssible factor is that when an employer is building units for his own employee, perhaps the city ought not get involved in that guideline. The' employer will have to pay the employee. Council had a long discussion about who could live in the unit. Ms. Butterbaugh pointed out if this unit is restricted to an employee of the lodge, the question of what price guidelines should be used is moot because the unit is probably part of his salary. Councilwoman Michael moved to exempt. the proposed Prospector 'Lodge employee housing unit from compliance with growth management procedures subject to the following conditions; (1) the deed restriction of the one-bedroom employee unit for a period of 50 years under the city's low income rental guidelines, said restriction to be executed prior to the. " issuance of a building permit; (2) the construction of the employee housing unit otherwisei; COmplying with all requirements imposed by the zoning code, a final determination of com- " pliance to be made at such time that working drawings are submitted for a building permit , and (3) occupants of said unit be employees of the prospector Lodge; seconded by Councilman Behrendt. Such units are exempt from Growth Management subject tothe'(approva1 of the City Council upon the recommendation of the Planning & Zoning Commission. On August 19th, 1980 the applicant received approval from the Planning & Zoning Commission to renovate and expand the lodge, a conditional use in the CC zone district, and for exemption from Mandatory P.U.D. As the attached 1 etter indi cates, the app 1 i cant proposes to construc~ an approxi- mate1y 630 sq.ftnne-bedroom employee housing unit to replace an existing efficiency unlt of approximat1ey 250 sq. feet. The new one-bedroom unit is intended to house the lodge's resident manager and will contain its own kitchen, fireplace, balcony and semi-private entry. The applicant proposes to deed restrict the unit for a period of 50 years under the City's moderate income guidelines. The Engineering Department has reviewed the applicant's request and recommends approval without conditions. The Housing Director has also reviewed the application and concurs with the moderate income rental restriction. Recommendation In view of the City's desire to encourage incorporation of employee housing in conmercia1 operations, and the fact that the provision of an employee unit was a condition of the applicant's prior P&Z approval, the Planning Office recommends approval of the applicant's request subject to the following stipulations: 1. The deed restriction of the one-bedroom employee unit for a period of 50 years under the city's moderate income rental guidelines, said restriction to be executed prior to the issuance of a building permit. 2. The construction of the employee unit otherwise complying with all requirements imposed by the zoning code, a final determination of compliance 'to' be made at such time that working drawings are submitted for a building permit. The Planning & Zoning Commission concurred with the Planning Office recommen- dation and approved the applicant's request subject to the above conditions on November 4th, 1980. Should Council also concur with the above recommendations, the appropriate motion is as follows: "I move to exempt the proposed Prospector Lodge employee housing unit from compliance with Growth Management procedures subject to the following conditions~ 1.
