U TO: Aspen planning and Zoning Commission 130 South Galena Aspen, Colorado 81611 RE: Sat-Time Special Review Hearing for Erection of Satellite Dish ======================================================================= Out-of-town business prevents me from appearing in person, nevertheless, I desire that my thoughts on the above captioned proposal be of record. While I do encourage individual entrepreneurs, as I believe there is already too much governmental interference in our lives, I feel very strongly that this proposal to allow such a large (10 foot) obtrusive piece of electronic gear is just not in keeping with the nature of our community, especially if it is to be in full public view either at ground level or on top of a building. I am confident that tourists who visit, and residents who have chosen Aspen as their home, do not wish to be sUbjected to ugly, visually obtrusive objects, such as satellite dishes, even if it is mounted on a trailer. Surely, in your wisdom, you will reject this applicant's request in its present form, but perhaps will assist by Offering guidance in the development of a hidden, remote location more suitable for this type of electronic gear. SAT Time Inc. - Satellite Dish Special Review December 22, 1984 ------------------------------------------------------------------ ------------------------------------------------------------------ There is a general problem in the core area and that problem is not enough parking. SAT Time's wanting to use a parking space of the Professional Building at 600 E. Hopkins for a mobile satellite dish not only uses up a parking space but a parking space of the office building. Thus making another car park on the street, something we do not encourage. SAT TIME Inc. is in the business of brokering satellite time on a national basis. we require the use of a satellite dish to monitor transmissions and to maintain accurate infonnation in our data bases. Additionally, SAT TIME Inc. may use the dish locally to receive sporting events and business teleconfernces throughout the valley. For that reason, the dish is mounted on a trailer. As part of the lease agreement with the owners of the building, we have been assigned the first of their parking spaces, located in the private parking lot between the Hunter Professional Building and the building housing KSNO. As the dish has to face South and has to have line of sight west and East the first parking space has been assigned. Enclosed is a letter from Mr. Bill Jordan, aknowledging the allocation of the parking space and confirming ownership of the Hunter Professional Building. Also enclosed are pictures of the site. The size of the satellite dish is ten feet in diameter. The trailer will fit comfortably in a parking space. we have reviewed the city ordinance pertaining to satellite dishes and find that we satisfy all criteria. we would appreciate the ability to meet and have our application reviewed at the January B, 1985 meeting, thus our submittal of this application today, December 7, 1984. Enclosed is our cheCk in the amount of $680.00. It is our understanding that the planning board is charging $135 per hour of review on this application. Please advise us if there are any circumstances that would cause this review to require an inordinate amount of time to process. we work in the satellite communications industry and are aware of an average filing fee of $25 - $50 to register a satellite receive dish in communities across the country. Hopkins C-I APPLICANT'S REQUEST: The applicant wants to place a ten foot (10') in diameter satellite dish on a trailer in the front parking space between the Hunter Professional Building and the KSNO Building on Hopkins Street. PLANNING OFFICE REVIEW: Satellite dishes were made a conditional use in all zone districts in the city of Aspen in May of 1983. Section 24-3.1(gg) added the following definition to the Code: "A 'satellite dish antenna' or a 'satellite radio frequency signal reception and/or transmission device' regulated under this Section means a dish-shaped or parabolic-shaped reception or transmission antenna, which antenna is more than two (2) feet in diameter, placed within the City of Aspen (including antennae stored or tanporariliy placed for seven (7) days or more) for the reception and/or transmission of satellite signals, including television signals, am radio signals, fro radio signals, telemetry signals, data communications signals or any other reception or transmission signals using free air space as a medium whether for commercial or private use, if said antenna or device is visible (or will be visible after installation) from any public way within th e Ci ty . " Criteria for the review of the satellite dishes, in addition to the requirements of the building code and the Historic Preservation Committee, in Section 24-3.7(p) are the following: 1. The installation of a satellite dish antenna shall not cause a violation of area and bulk requirements within the zone (unless a variance therefore is granted by the Board of Adjustment) . 2. A satellite dish antenna shall not be placed on an easement or in the City right-of-way (unless an encroachment permit can be secured). 3. The installation of a satellite dish antenna shall not cause any increased danger to neighboring property in the event of collapse or other failure of the antenna structure. 4. The visibility of the dish from the public way shall be reduced to the highest degree practical including, but not limited to, sensitive choice in placement of the dish, screening with fencing, landscaping, subgrade placanent, or any other effective means that both screen the dish and does not appear to be unnatural on the site. The proposal to use the front parking space will not violate area and bulk requirements or be in the City right-of-way or on an easement. The Building Department would have to check the secure placement of ~ ~ the dish on the trailer to assure that no danger of its coming loose or collapsing is posed on the neighboring properties. We do not believe that criterion 4, dealing with visual vulnerability is satisfied by this submission. Placing this trailer in the most forward parking space exposes it to the maximum degree possible. The applicant indicated that a smaller dish is not an option because of the nature of their use. The dish needs to be placed in this space for their use in order to face South and have a clear line of sight. No screening or landscaping is proposed, and in this location is not especially practical. Fencing or planting would not appear to be natural this far forward on the parking lot. The applicant's intention is to move the dish to alternative locations throughout the City and County for special events. Their representatives will describe its use in greater detail at the meeting. The limit of the Commercial Core Historic District is Hunter Street. The dish will be visible from the CC zone but is 1/2 block outside the district. A side issue is that the other parking spaces are not specifically reserved for tenants in the Professional Building. The C-l zone does not have a parking requirement and the building was built prior to GMP or Ordinance 19, so no specific number of spaces was likely required. This does, however, eliminate a parking space from its intended use and al though the appli cant has agreed not to par k a vehicle in another of the Professional Building's parking spaces, it will probably mean additional on-street parking. It is the Planning Office's opinion that the community has demonstrated a high level of sensitivity to the placement of satellite dishes. The dish used by KSPN on Main Street raised quite a controversy. The review by the County board of Canyon Cable's dishes has been quite laborious, with an effort at careful screening made. The ordinance was written to encourage the use of small dishes in that a dish of two feet (2') in diameter or less need not be reviewed. It would be very difficult to retain a Vi ctorian character of the town if there was a proliferation of large satellite dishes. Pony dish approved without careful placement and screening would only open the door and encourage applications for more dishes. We would suggest that the Airport Business Center would be a much better location for such an operation. As an alternative, the applicant has indicated to us that their business can operate, although not as successfully, without the dish. Therefore, should the applicant insist upon remaining in this location we recommend that the business be required to operation without the satelli te di sh.
