A ORDINANCE APPROVING AN EQUIPMENT LEASE/PURCHASE AGREEMENT
BETWEEN THE CITY OF ASPEN, COLORADO, AND HONNEN EQUIPMENT CO.,
SETTING FORTH THE TERMS AND CONDITIONS FOR THE LEASE OF A JOHN
DEERE BACKHOE LOADER BY THE CITY OF ASPEN FROM HONNEN EQUIPMENT
CO. AND DIRECTING THE MAYOR TO EXECUTE SAID AGREEMENT ON BEHALF
OF THE CITY OF ASPEN;
WHEREAS, there has been submitted to the City Council an
Equipment Lease/Purchase Agreement between the City of Aspen
and Honnen Equipment Co. setting forth the terms and condi-
tions for the lease of a John Deere backhoe loader by the City of
Aspen from Honnen Equipment Co.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve the
Equipment Lease/Purchase Agreement between the City of Aspen and
Honnen Equipment Co. providing for the lease of a John Deere
backhoe loader by the City of Aspen from Honnen Equipment Co.,
which agreement is attached hereto and incorporated herein; and
~oes further authorize the Mayor to execute said Agreement on
behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
