AN ORDINANCE REPEALING ORDINANCE NO. 47 (SERIES OF 1985) REGULAT-
ING FIREPLACES AND WOODBURNING STOVES AND RATIFYING, CONFIRMING
AND RE-ENACTING (TO THE EXTENT NECESSARY) SECTIONS 11-2.3 AND
11-2.6(a) OF THE MUNICIPAL CODE AS IN EFFECT PRIOR TO THE ADOPTION
OF ORDINANCE NO. 47 (SERIES OF 1985)
WHEREAS, a petition has been submitted to the City Council
requesting that Ordinance No. 47 (Series of 1985) be repealed;
and
WHEREAS, the City Council has considered the request of the
petitioners and deems it to be in the best interest of the citi-
zens and visitors of the City of Aspen to repeal Ordinance No. 47
(Series of 1985) and to ratify, confirm and re-enact (to the
extent necessary) Sections 11-2.3 and 11-2.6(a) of the Municipal
Code as in effec prior to the adoption of Ordinance No. 47 (Series
of 1985).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Ordinance No. 47 (Series of 1985) be and the same is
hereby repealed and Sections 11-2.3 and 1~-2.6(a) of the Municipal
Code as in effect prior to the adoption of said Ordinance No. 47
be and the same are hereby ratified, confirmed and, to the extent
necessary, re-enacted.
Sect i. on 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.

A public hearing on the ordinance shall be held on the ____
