HomeMy WebLinkAboutordinance.council.001-84 RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 198~ AN ORDINANCE AMENDING CHAPTER 8 1/2, ASPEN MUNICIPAL CODE, WHICH IS ENTITLED "EMERGENCY ALARM SYSTEMS AND PROTECTION SERVICES", BY AMENDING SECTIONS 8 1/2-6(a) AND (b) TO PROVIDE FOR A NEW FLAT- RATE FALSE ALARM FEE AND BY ADDING A NEW SECTION 8 1/2-9 THAT EXEMPTS CITY-OPERATED MUNICIPAL FACILITIES FROM THE PROVISIONS OF THE CHAPTER WHEREAS, the City of Aspen did enact Ordinance No. 5-1980 (Chapter 8 1/2, Aspen Municipal Code), for the purpose of regulat- ing emergency alarm systems and protection services provided to the general public within the City of Aspen; and WHEREAS, the City C6uncil finds that it is in the best inter- est of the City to amend that Ordinance and the Code chapter to enact a new flat-rate false alarm fee and to add a new subs~tion to exempt City-operated municipal facilities from the provisions of that Ordinance and Code chapter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Sections 8 1/2-6(a) and (b) of the Municipal Code be repealed and reenacted to read as follows: "(a) Any protection service business licensee that relays an alarm to the police department shall reimburse the City at a flat rate of Ten Dollars ($10.00) per alarm for the time deemed spent by police departmDnt personnel on answering, clearing and re-setting such alarms. (b) The police department shall maintain an accurate written accounting of all such alarms relayed." Section 2 That Chapter 8 1/2 of the Municipal Code be amended by the addition of a new section to read as follows: "Sec. 8 1/2-9. Exemption for City-operated Municipal Facili- ties. The provisions of this Chapter shall not apply to security systems connected directly from City-operated municipal facilities (whether in City-owned or -leased premises) to the RECORD OF PROCEEDINGS ~00 Leaves police department if such facilities are the subject of a written exemption permit issued by the City Manager." Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
