HomeMy WebLinkAboutordinance.council.004-84 RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1984) AN ORDINANCE AMENDING SUBSECTION (b) OF SECTION 5-30 OF THE MUNI- CIPAL CODE PERTAINING TO LEASH CONTROL, SO AS TO REQUIRE THAT DOGS BE LEASHED OR PROPERLY CONFINED WHETHER ON OR OFF THE PREMISES OF THE OWNER, POSSESSOR OR KEEPER WHEREAS, recent events in the City have demonstrated a high potential for damage and nuisance by dogs that are not adequately leashed or confined while on the premises of the owner, possessor or keeper of the dog, and WHEREAS, the City Council deems it to be in the best inter- ests of the City, its residents and visitors to amend subsection (b) of Section 5-30 of the Municipal code to require that dogs be properly leashed or confined at all times, even if on the premises of the owner, possessor or keeper, in order to reduce the poten- tial that dogs will run at large and cause damage to wildlife and citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That subsection (b) of Section 5-30 of the Municipal Code of the City of Aspen, Colorado, be and the same is hereby amended to read as follows: "(b) A dog shall be deemed to be running at large when not under the direct control of the owner, possessor, keeper or his agent or servant or a member of his immediate family, either by leash, cord, or chain no longer than ten ~eet in length and of sufficient strength to com- pletely restrain the dog, or within a vehicle or other confinement." Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent RECORD OF PROCEEDINGS 100 Leaves provision and such holding shall not affect the validity of the remaining portions thereof. Section 3 A public hearing on the ordinance shall be held on the ~ day of y~~ , 1984, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado. Section 2 The tract of land hereby disconnected shall not be exempted from the pa~nent of any taxes lawfully assessed against it for tile purpose of paying any indebtedness lawfully contracted by the City Council of the City of Aspen while such tract was within the limits of the City of Aspen which remains unpaid and for the pay- ment of which such tract could be lawfully taxed and the provi- sions of Section 31-12-503, C.R.S. 1973, concerning the authority of the City Council of the City of Aspen in respect of future levies of taxes are hereby incorporated by reference herein. Section 3 The City Clerk of the City of Aspen is hereby directed imme- diately to certify and file two copies of this ordinance with the Clerk and Recorder of the County of Pitkin, State of Colorado. Section 4 If any section, subsection, sentence, clause, phrase or por- tion of this ordinance is for any reason held invalid or unconsti- tutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
