HomeMy WebLinkAboutordinance.council.005-84 RECORD OF PROCEEDINGS 100 Leaves ORDINANC~ NO. {Series of 1954) AN ORDINANCE REZONiNG CERTAIN REAL PROPERTY LOCATED IN BLOCK 71~ CITY ~D TOWNStTE OF ASPEN, COMMONLY KNOWN AS 232 E. HALLAM TO WHEREAS~ the Vigoda Family Limited Partnership, owner of real property described in Exhibit "A", attached hereto and incorporated herein, did approach the Aspen Planning and Zoning Commission to request sponsorship of a rezoning application~ as per Section 2~- 12.2 of the ~unicipal Code of the' City of Aspen~ Colorado; and WHEREAS~ in its review of the history of the zoning of the property~ the Planning Office did find that a portion of the property was incor- rectly zoned in the preparation of the City zoning maps; and W~EREAS~ the zoning shown on the map for that portion of the property is SPA and the Planning Office believes that due to its residential character, the correct zoning of the parcel should be R-6~ and WHEREAS~ at a public hearing held on February 7~ 1~8~ the Aspen Planning and Zoning Commission did review the requested rezoning and finding it to be in compliance with the criteria of Section 2~- 12.5 of the Code~ and therefore did recommend to the Aspen City Council the rezoning of the subject property described in Exhibit "A" to R-6. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 24-2°2 of the Municipal Code entitled "Zoning District Map" be and hereby is amended by rezonin9 that certain tract of land in Block 71 of the City and Townsite of Aspen, more particularly described in Exhibit "A"~ attached hereto and incorporated herein, as R-6 subject to those zoning regulations applicable to the R-6 RECORD OF PROCEEDINGS 100 Leaves Page 2 zone district as described in Chapter 24 of the Aspen Municipal Code (as now exists or may hereafter be amended). That the City Engineer be and hereby is directed to ~end the Zoning District Map consistent with the requirement of the Aspen Municipal Code and as described in Section 1 above. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. A public hearing on the Ordinance shall be held on the~ day of ~, 1984, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, 130 S. Galena Street, Aspen, Colorado, fifteen (15) days prior to which hearing notice of the same shall be published once in a newspaper of general circulation within the Ci~ of Aspen.
