ORDINANCE NO. ~ (Series of 1
AN ORDINANCE APPROVING THE FOLLOWING AGREEMENTS BETWEEN MUNICIPAL
ENERGY AGENCY OF NEBRASKA ("MEAN") AND THE CITY OF ASPEN:
1. ELECTRICAL RESOURCES POOLING AGREEMENT;
2. AGREEMENT FOR THE PURCHASE AND SALE OF ELECTRIC CAPACITY AND
ENERGY;
3. TOTAL POWER REQUIREMENTS POWER PURCHASE AGREEMENT;
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS ON BEHALF OF
THE CITY OF ASPEN
WREREAS, the City Council finds it to be in the best inter-
ests of the City of Aspen, its inhabitants and visitors to enter
into the following agreements with the Municipal Energy Agency of
Nebraska for the purchase of electric power from the Nebraska
Municipal Power Pool, which agreements are appended hereto and
incorporated herein by this reference:
1. Electrical Resources Pooling Agreement;
2. Agreement for the Purchase and Sale of Electric Capacity
and Energy;
3. Total Power Requirements Power Purchase Agreement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve the
following agreements between the City of Aspen and the Municipal
Energy Agency of Nebraska, attached hereto and incorporated by
this reference:
1. Electrical Resources Pooling Agreement;
2. Agreement for the Purchase and Sale of Electric Capacity
and Energy;
3. Total Power Requirements Power Purchase Agreement;

and does further authorize the Mayor, on the effective date of
this ordinance, to execute said agreements on behalf of the City
of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on the~
