ORDINANCE NO. ~O
(Series of 1984)
AN ORDINANCE REPEALING SUBSECTION (j) OF SECTION 7-141, PERTAINING
TO AMENDMENTS TO THE UNIFORM BUILDING CODE, 1979 EDITION, AND
AMENDING SUBSECTIONS (k) AND (1) OF SECTION 7-141 BY RELETTERING
SAID SUBSECTIONS (j) AND (k), RESPECTIVELY
WHEREAS, the City Council deems it to be in the best interest
of the City of Aspen and its residents and visitors to repeal sub-
section "(j)" of Section 7-141 of the Municipal Code of the City
of Aspen, Colorado, which subsection amends and modifies the Uni-
form Building Code, 1979 Edition, Table No. 33-A, adopted by the
City of Aspen, so as to not require handicap access in one- or
two-story buildings for the floor above or the floor below the
floor closest to grade; and
WHEREAS, in light of the repeal of subsection (j) as herein-
below provided, the City Council desires to amend presently-exist-
ing subsection (k) and (1) of Section 7-141 by relettering said
subsections "(j)" and "(k)", respectively.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That subsection "(j)" of Section 7-141 of the Municipal Code
of the City of Aspen, Colorado, be and the same is hereby
repealed.
Section 2
That in view of the repeal of subsection "(j)" of Section
7-141, that subsections "(k)" and "(1)" of Section 7-141 of the
Municipal Code of the City of Aspen, Colorado, be and the same are
hereby amended by relettering subsection "(k)" as subsection "(j).'
and relettering subsection "(1)" as subsection "(k)"
Section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such

portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 4
A public hearing on the ordinance shall be held on the /~
day of ~, 1984, at 5:00 p.m. in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
