HomeMy WebLinkAboutordinance.council.021-84 RECORD OF PROCEEDINGS 100.Leaves ORDINANCE NO. ~/ (Series of 1984) AN ORDINANCE AMENDING SUBSECTION (b) OF SECTION 5-30 OF THE MUNI- CIPAL CODE TO PROVIDE THAT A DOG SHALL BE DEEMED TO BE RUNNING AT LARGE IF, WHEN ON THE PREMISES OF AN OWNER, POSSESSOR OR KEEPER SAID DOG IS NOT LEASHED, CONFINED OR ACCOMPANIED BY A RESPONSIBLE PERSON WITHIN THE SIGHT AND HEARING OF SAID DOG WHEREAS, dogs which are not adequately leashed, confined, or controlled by their owners, possessors or keepers, present a potential for damage and nuisance, and WHEREAS, the City Council deems it to be in the best inter- est of the City, its residents and visitors to amend subsection (b) of Section 5-30 of the Municipal Code to provide that dogs shall be deemed to be running at large when on the premises of the owner, possessor or keeper if said dogs are not leashed, confined or accompanied by a responsible person within the sight and hear- ing of the dog. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE OF ASPEN, COLORADO: Section 1 That subsection (b) of Section 5-30 of the Municipal Code of the City of Aspen, Colorado, be and the same is hereby amended to read as follows: "(b) A dog shall be deemed to be running at large when off or away from the premises of the owner, possessor, or keeper thereof and not under the direct control of the owner, possessor, keeper or his agent or servant or a member of his immediate family either by leash, cord, or chain no longer than ten (10) feet in length and of suf- ficient strength to completely restrain the dog or with- in a vehicle or other confinement. Additionally, a dog shall be deemed to be running at large when on the pre- mises of the owner, possessor or keeper if the dog is not leashed or confined or accompanied by a responsible person within sight and hearing of the dog." Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or RECORD OF PROCEEDINGS 100 Leaves unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 3 A public hearing on the ordinance shall be held on the day of , 1984, at 5:00 p.m. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
