HomeMy WebLinkAboutordinance.council.027-84 RECORD OF PROCEEDINGS v~ 100 Leaves ORDINANCE NO. 27 (Series of 1984) AN ORDINANCE REPEALING AND REENACTING SECTION 19-77(a) OF THE MUNICIPAL CODE OF THE CITY OF ASPEN TO ALLOW FOR THE USE OF CER- TAIN NATIVE MATERIALS AS BACKFILL, IF APPROVED BY THE CITY ENGI- NEER WHEREAS, the City Council of the City of Aspen desires to repeal and reenact Section 19-77(a) of the Municipal Code in order to allow for the use of certain native materials as backfill, if such materials are approved by the City Engineer. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 Subsection "(a)" of Section 19-77 of the Municipal Code of the City of Aspen is hereby repealed and reenacted to read as follows: "(a) Excavations in paved areas. Backfill shall be entirely select material and shall be placed in layers not to exceed eighteen (18) inches in depth. Compaction shall be ninety-five (95) percent of the A.S.T.M. Designation D 698-64T. Backfill may be native material if approved in writing by the City Engineer except that the top eight (8) inches, compacted depth, shall be three-quar- ter (3/4) inch crushed road base. Native backfill shall be placed in layers, shall not contain boulders 9reater than six (6) inches in diameter, and compaction shall be ninety-five (95) percent of the A.S.T.M. Designation D698-64T." Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent RECORD OF PROCEEDINGS 100 Leaves provision and such holding shall not affect the validity of the remaining portions thereof. Section 3 A public hearing on the ordinance shall be held on the day of , 1984, at 5:00 p.m. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
