AN ORDINANCE AMENDING ARTICLE VII, CHAPTER 24 OF THE MUNICIPAL
CODE PERTAINING TO SPECIALLY PLANNED AREAS BY ADDING A NEW SECTION
24-7.3 EMPOWERING THE PLANNING DIRECTOR TO AUTHORIZE MINOR CHANGES
TO AN ADOPTED PRECISE PLAN
WHEREAS, the City Council, having considered Planning Commis'
sion Resolution 84-9 recommending various amendments with respect
to the specially planned area provisions of the Municipal Code,
desires to implement that recommendation empowering the Planning
Director to authorize minor changes by amending Article VII, Chap-
ter 24, by adding a new Section 24-7.3 as hereinbelow provided.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Article VII, Chapter 24, of the Municipal Code of the
City of Aspen, Colorado, be and the same is hereby amended by add-
ing a new Section 24-7.3, to read as follows:
"Sec. 24-7.3. Amendment of adopted precise plan.
Substantial amendments to an adopted precise plan shall con-
stitute a new application subject to the review procedures
outlined in this article. Minor changes in the adopted pre-
cise plan may be authorized by the Planning Director without
additional public review, if required by engineering stan-
dards or other technical design needs not anticipated during
the review of the project. The planning director shall fol-
low the standards of Section 24-8.26 in determining whether
or not a change is deemed minor."
Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-

tutional in a court of competent jurisdiction, such portion shall
be deemed a separate, distinct and independent provision and shall
not affect the validity of the remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on the ~
day of ~ , 198~, in the City Council Cham-
bers, Aspen City Hall, Aspen, Colorado, 15 days prior to which
hearing notice of the same shall be published once in a newspaper
of general circulation within the City of Aspen.
