ORDINANCE NO.
(Series of 1984)
AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITY OF ASPEN,
COLORADO, AND OWL CREEK AT ASPEN, A COLORADO CORPORATION, PROVID-
ING FOR THE EXTENSTION OF CITY WATER SERVICE ~ THE OWL CREEK PRO-
PERTIES LOCATED IN PITKIN COUNTY, COLORADO, AND AUTHORIZING THE
MAYOR TO EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY OF ASPEN
WHEREAS, the City Council finds it to be in the best inter-
ests of the City of Aspen, its inhabitants and visitors to enter
into an agreement between the City of Aspen, Colorado, and Owl
Creek at Aspen to provide for the extension of City water service
to the Owl Creek properties located in Pitkin County, which
agreement is appended hereto and incorporated herein by this
reference.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve an
agreement between the City of Aspen, Colorado, and Owl Creek at
Aspen, attached hereto and incorporated by this reference, which
agreement provides for the extension of City water service to the
Owl Creek properties located in Pitkin County and does further
authorize the Mayor, on the effective date of this ordinance, to
execute said agreement on behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.

Section 3
A public hearing on the ordinance shall be held on the
day of , 1984, at 5:00 p.m. in the
City Council Chambers, Aspen City Hall· Aspen, Colorado.
