HomeMy WebLinkAboutordinance.council.036-84 RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 36 (Series of 1984) AN ORDINANCE ZONING THE SUNNY PARK ANNEXATION WHICH LAND WAS ANNEXED TO THE CITY OF ASPEN PURSUANT TO ORDINANCE NO. 24, SERIES OF 1984, AND THE COLORADO MUNICIPAL ANNEXA- TION ACT AND REZONING LOT 7, SUNNY PARK NORTH SUBDIVISION FROM R-15 TO R-15A/PUD WHEREAS, the Planning and Zoning Con,mission of the City of Aspen, Colorado, has considered a proposal to zone the Sunny Park North Annexation as R-15A/PUD; and WHEREAS, in Resolution No. approved on , 1984, the Planning Commission did recommend that the City Council zone the Sunny Park North Annexation R-15A/PUD; and WHEREAS, the Aspen City Council desire to accept the recom- mendations of the Planning Conunission and zone the Sunny Park North Annexation as R-iSA/PUD; and WHEREAS, pursuant to Section 24-12.3 of the Municipal Code of the City of Aspen, Colorado, the Aspen Planning and Zoning Commission agreed to sponsor the rezoning of lot 7, Sunny Park North Subdivision from R-15 to R-15A/PUD; and WHEREAS, at a public hearing on , 1984, the Planning and Zoning Commission did review the requested rezoning and then did recommend to the City Council the rezoning of Lot 7, Sunny Park North Subdivision, from R-15 to R-15A/PUD. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN COLORADO: Section 1 That from and after the effective date of this ordinance, the property identified as the Sunny Park North Annexation, more particu- larly descrJ~edas follows: A tract of !and being part of Lot 7, Sunny Park North Sub- division and a tract of land situated in the Southeast quarter of Section 7, Township 10 South, Range 84 West of the 6th P.M., Pitkin County, Colorado, being more fully described as follows: RECORD OF PROCEEDINGS 100 Leaves Beginning at the Northeast corner of said Lot 7, Sunny Park North Subdivision, thence S45°21'W 8.59 feet, thence N74°05W 154.58 feet, then N23°00'E 98.46 feet, thence S67°27'17"E 188.25 feet thence S45°21'W 79.53 feet thence N42°29'W 1.46 feet to the point of beginning containing 15.191 square feet more or less. shall be zoned R-15A/PUD and be subject to those zoning regulations applicable to said zone district and described in Chapter 24 of the Aspen Municipal Code (as now exists or may hereafter be amended). Section 2 That Zoning District Map of the City of Aspen referenced in Section 24-2.2 of the Municipal Code is hereby amended by rezoning Lot 7, Sunny Park North Subdivision, from R-15 to R-15A/PUD which real property shall be subject to those zoning regulations applicable to the R-15A/PUD zone district as described in Chapter 24 of the Municipal Code of the City of Aspen, as now exists or may hereafter be amended. Section 3 The City Engineer is hereby directed to amend the Zoning Dis- trict Map consistent with the requirements of the Municipal Code and as described in Section 2 above. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinanc~ is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 5 A public hearing on the ordinance shall be held on the day of ~~/ ., 1984, at 5~00 p.mo in the RECORD OF PROCEEDINGS 100 Leaves City Council Chambers, Aspen City Hall, Aspen, COlorado, fifteen (15) days prior to which hearing notice of the same shall be published in a newspaper of general circulation within the City of Aspen.
