HomeMy WebLinkAboutordinance.council.045-84 RECORD OF ~ROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1984) AN ORDINANCE APPROVING A MODIFICATION TO THAT AGP~EEMENT BETWEEN THE CITY OF ASPEN AND ALBORZ CORP., PERTAINING TO THE WHEELER OPEPJ% HOUSE, SO AS TO REFLECT A PRI~ARY TERM COMMENCING AS OF THE DATE THE LEASE WAS FULLY EXECUTED AND ENDING ON FEBRUARY 1, 1999: WHEREAS, by letter dated October 15, 1984, from the law firm Of Garfield & Hecht, P.C., Alborz Corp. has requested a modification to that agreement between the City of Aspen and Alborz Corp., dated October 3, 1983, so as to ~odify paragraph 2, pertaining to the primary term to read "commencing as of the date this lease is fully executed and ending on February 1, 1999" ., rather than "commencing as of the date this lease is fully executed and ending on the last day of December, 1998," and WHEREAS, the City Council desires to approve the afore- said modification and to authorize the Mayor, on behalf of the City, to execute such documents, as may be approved to form by the City Attorney. NOW, THEREFORE, be it ordained by the City Council of the City of Aspen, Colorado: Section 1 The City Council hereby approves a modification to paragraph 2 of that agreement dated October 3, 1983, between the City of Aspen and Alborz Corp.~ pertaining to the Wheeler Opera House, such that the words "commencing as of the date this lease is fully executed and ending on the last day of December, 1998" shculd read "commencing as of the date this lease is fully executed and ending on February 1, 1999;" and the Mayor ~s hereby authorized to execute such modifica- tion, as is approved as to fo~m by the City Attorney. In ~11 RECORD OF PROCEEDINGS 100 Leaves other respects, the aforesaid lease agreement dated October 3, 1983 shall remain unohanged and in full force and effect. Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or ~nconstitutional by any cour~ of competent jurisdiction, such portion shall be deemed a separate, distinct and inde- pendent provision and such holding shall not affect the validity of the remaining portions thereof. Section 3 A public hearing on the ordinance shall be held on the day of , 1984, at 5:00 o'clock p.m. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
