ORDINANCE NO.
(Series of 19~)
AN ORDINANCE AMENDING THE UNIFORM BUILDING CODE, 1979 EDITION, AS
ADOPTED BY THE CITY OF ASPEN, TO INCLUDE, AS STRUCTURES REQUIRING
A BUILDING PERMIT, SATELLITE RADIO FREQUENCY SIGNAL RECEPTION AND
TRANSMISSION DEVICES; SETTING FORTH A DEFINITION OF SUCH DEVICES;
AND EXPRESSLY ADOPTING PENALTY PROVISIONS
WHEREAS, the City Council of the City of Aspen, Colorado, has
become aware of the placement of satellite radio frequency signal
reception devices within the City of Aspen; and
WHEREAS, such devices by their size, configuration and place-
ment may constitute a hazard to the health, safety and welfare of
the citizens of Aspen if they are not properly anchored to resist
high winds; and
WHEREAS, such devices require electrical wiring, the install-
ation and placement of which should be inspected by the Building
Department to insure the health, safety and welfare of the citi-
zens of Aspen; and
WHEREAS, the size and configuration of these devices may make
them subject to Building and Zoning Code requirements for set-
backs, encroachment on rights-of-way, required clearances for
traffic safety vision corridors, encroachment on required parking
spaces, conformance with sign regulations and other relevant mat-
ters; and
WHEREAS, the City finds it in the best interests of the
health, welfare and safety of its citizens to require that such
devices be subject to its building permit requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1

That Ordinance No. 33 (Series of 1981), Section 3, Section
7-141(f) and also Section 7-141(f), Aspen Municipal Code, be
amended to read as follows:
"Division 2 of Section 1101 is hereby amended to read as fol-
lows:
Division 2. Fences, tanks, towers and satellite radio fre-
quency signal reception and transmission devices.
Outside the City limits of Aspen, a building permit is not
required for a fence under six (6) feet high.
A "satellite radio frequency signal reception and/or trans-
mission device" means a dish-shaped or parabolic-shaped
reception or transmission antenna for the reception and/or
transmission of satellite signals, including television sig-
nals, am radio signals, fm radio signals, telemetry signals,
data communications signals or any other reception or trans-
mission signals using free air space as a medium, whether for
commercial or private use."
Section 2
Violations of the amendment herein contained expressly shall
be subject to the penalties as provided in Section 7-142 of the
Aspen Municipal Code, as amended.
Section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 4
