HomeMy WebLinkAboutordinance.council.003-83 RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 198--~7--- AN ORDINANCE AMENDING DIVISION 3 OF ARTICLE III OF CHAPTER 23 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, ENTITLED "WATER RATES AND CHARGES" (AND THEREBY AMENDING ORDINANCE NO. 2]-1982 AND ORDINANCE NO. 34-1977) BY INCREASING CERTAIN WATER RATES AND CHARGES; CORRECTING A TYPOGRAPHICAL ERROR IN AN EARLIER CODIFICA- TION OF ORDINANCES BY RE-AFFIRMING AND RE-CODIFYING SECTION 23~ 102(d) THAT PROVIDES A SURCHARGE FOR THOSE METERED CUSTOMERS SERVED BY PUMPING STATIONS; AND SETTING FORTH A PROVISION FOR DEALING WITH HARDSHIP CASES BY ADMINISTRATIVE MEANS WHEREAS, the City Council finds it necessary to improve the existing water transmission system; and WHEREAS, the City has approved issuance of 2.7 million dol- lars of General Obligation Utility Bonds; and WHEREAS, the City Council desires that the cost of the debt service for these utility improvements be paid for by the water customers rather than out of the General Fund; and NOW, THEREFORE, BE IT ORDAINED By THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Division 3 of'Article III of Chapter 23 of the Municipal Code of the City of Aspen, Colorado, (and by implication, Ordin- ance No. 21-1982 and Ordinance No. 34-1977) be and hereby is amended to read as follows: A. That Section 23-101(a) is hereby amended to read as fol- lows: "(a) The residential, multiple family and commercial flat in-city rate shall be computed on a point basis according to the following schedule; and for each point determined by fixture count there shall be charged eighty-seven cents ($0.87) per month, provided, however, that in no event shall there be billed less than thirteen dollars and thirty-one cents ($13.31) per month for any flat rate service given." B. That the first paragraph of Section 23-101(b) is hereby amended to read as follows: RECORD OF PROCEEDINGS 100 Leaves "(b) The schedule set forth in this section applies only to those users who are not required pursuant to Section 23-104 to have converted to metered ser- vice. In the event a user who is required to have converted to metered service has not so converted by the date specified in Section 23-104, the charges set forth below shall be increased by one hundred percent (100%) .... " C. That Section 23-102(a) is hereby amended to read as fol- lows: "(a) Residential (single-family and duplex only). For in-city residential water users where a metering device has been installed, is operative and readily accessible, the rate of charge and/or monthly charge, or any fraction thereof, shall be computed in accordance with the following table: Gallons Monthly Charge Meter Size (Minimum) (Minimum) 3/4 inch 5,000 $ 7.99 1 inch 10,000 14.38 1 1/2 inch 20,000 25.29 2 inch 40,000 48.98 Each additional 1,000 gallons over the minimum = $0.87 D. That Section 23-102(b) is hereby amended to read as fol- lows: "(b) Commercial and multiple family (all other metered water users except residential single and two family units). That a Section 23-102(d), which had been deleted from codification of the Aspen Municipal Code by a typographical error, is hereby re-affirmed and re-codified to read as follows: RECORD OF PROCEEDINGS 100 Leaves "(d) For those users of water where a metering device has been installed, is operative and readily accessible and such use relies on pumping stations owned and maintained by the City of Aspen, there shall be a surcharge equal to fifty (50) percent of the in-city monthly bill, if one pumping station is required to furnish water to the user, and eighty (80) percent of the in-city monthly billing if two (2) pumping stations are required to furnish water to the user." Section 2 With respect to the water rates and charges contained in Sec- tion 1 of this ordinance, in cases of verifiable hardship and upon the approval of both the Finance Director and the Water Superin- tendent, special billing arranagements may be made for such hard- ship cases. Section 3 The water rates and charges contained in Section 1 of this ordinance shall become effective as of March 1, 1983. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
