AN ORDINANCE AMENDING ORDINANCE NO. 68 (SERIES OF 1982) SO AS TO
DELETE THE APPLEJACK INN FROM THE L-3, LODGE PRESERVATION ZONE
WHEREAS, on December 27, 1982, the City Council of the City
of Aspen, Colorado, did enact Ordinance No. 68 (Series of 1982)
rezoning certain lodges existing in the City to L-3, Lodge Preser-
vation; and
WHEREAS, it has come to the attention of the City Council
that the owners of the Applejack Inn, a lodge included within the
zoning action, have indicated that they desire that the Applejack
Inn not be zoned to L-3, Lodge Preservation, pursuant to Ordinance
No. 68 (Series of 1982); and
WHEREAS, at the request of the owners of the Applejack Inn
the City Council desires to amend Ordinance No. 68 (Series of
1982) to delete the Applejack Inn from the provisions thereof,
said property being described more specifically as Lots East 1/2
of D and all of E, F, G, H, J, Block 45.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Ordinance No. 68 (Series of 1982) be and the same is
hereby amended by deleting from Exhibit "A", attached thereto and
incorporated therein by reference, the Applejack Inn more specifi-
cally described as follows:
Lots East 1/2 of D and all of E, F, G, H, J, Block 45
Section 2
The aforesaid property, commonly known as the Applejack Inn,
shall revert to the zoning in effect for said parcel prior to the
adoption of Ordinance No. 68 (Series of 1982).

Section 3
That the City Engineer be and hereby is directed to amend the
Zoning District Map consistent with this ordinance.
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the ./~ .
day of ~ , 1983, at 5:00 P.M. in
the City Council Chambers, Aspen City Hall, Aspen, Colorado, 15
days prior to which hearing notice of the same shall be published
once in a newspaper of general circulation within the City of
Aspen.
