HomeMy WebLinkAboutordinance.council.011-83 RECORD OF PROCEEDINGS 100 Leaves ORDINANCE .(Series of 1983) AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF FIVE (5) PRECINCTS FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD ON MAY 3, 1983, AND SETTING FORTH THE DESCRIPTION OF THOSE PRECINCTS WHEREAS, the City Council ("Council") of the City of Aspen, Colorado (the "City"), in the COunty of Pitkin and State of Colo- rado, a municipal corporation duly organized and existing as a home rule city pursuant to Article XX of the Colorado Constitu- tion, will conduct a general municipal election, pursuant to Section 2.2 of the Aspen Home Rule Charter, on Tuesday, May 3, 1983; and WHEREAS, Council has determined, and hereby does determine, that the use of the five (5) general election precincts for said general municipal election will maximize the convenience of the voters; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 Pursuant to Section 2.3 of the Aspen Home Rule Charter, the Council has heretofore adopted Ordinance No. 5-71, establishing multiple voting precincts. The Council has determined, and hereby does determine, that, solely for purposes of the general municipal election to be held May 3, 1983, the City shall constitute five (5) voting precincts, the boundaries of which shall be the same as the boundaries of the general election precincts (General Election Precinct Nos. 1, 2, 3, 4 and 5) previously established for use in connection with general election, which five (5) precincts are described in Exhibit "A" attached hereto and incorporated herein by this reference. This ordinance shall supersede said Ordinance RECORD OF PROCEEDINGS 100 Leaves 5-71, but only as to the May 3, 1983, general munzcipal election herein described. Section 2 The officers of the City shall be, and they hereby are, authorized and directed to take all action necessary or appropri- ate to effectuate the provisions of this ordinance. Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
