ORDINANCE NO.
(Series of 1
AN ORDINANCE APPROVING THE PURCHASE (AND THEREBY RATIFYING A CON-
TRACT TO PURCHASE) OF CERTAIN REAL ESTATE WITHIN THE CITY OF ASPEN
WITH OPEN SPACE FUNDS AND DESIGNATING FROM OPEN SPACE BOND
PROCEEDS THE SUM OF $105,000 TO PURCHASE THE SAME
WHEREAS, the City Manager, with the advice of the Open Space
Negotiating Team, has negotiated the conditional purchase of cer-
tain real estate with open space funds and the contract for pur-
chase is conditioned on approval thereof by the City Council.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the Residential Contract to Buy and Sell Real Estate
dated March 1, 1983 (a copy of which is attached hereto as Exhibit
"A" and incorporated herein by this reference) for the purchase of
Lots 2 and 3, Block 4, Lakeview Addition, City of Aspen, Pitkin
County, Colorado, and the improvements thereon, be and hereby is
ratified and approved.
Section 2
That the sum of $105,000 be and hereby is designated from
open space bond proceeds for the purchase of Lots 2 and 3, Block
4, Lakeview Addition, City of Aspen, Pitkin County, Colorado.
Section 3
That the City Manager is hereby authorized and directed to
execute all documents hereafter necessary to complete the convey-
ante of said Lots 2 and 3, Block 4, Lakeview Addition, City of
Aspen, Pitkin County, Colorado.
Section 4
If any section, subsection, sentence, clause, phras~ or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent

provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 4
A public hearing on the ordinance shall be held on the //
day of ~j , 1983, at 5:00 P.M. in
the City Council Chambers, Aspen City Hall, Aspen, Colorado.
