AN ORDINANCE AMENDING APPI%OPILIATIONS ORDINANCE NO. ?4, SERIES OF
1982, BY ADDING THREE BUDGET ITE~4S THERETO AS FOLLOW~: AN
APPROPRIATION FOR LAND FUND EXI~ENDI~ OF $174,485; A
RECOGNITION OF LAND FUND REVENUES OF $174,485: AND A TRANSFER OF
$50,000 FROM THE TRANSPORTATION/MALL FUND TO THE TRANSIT FUND,

ORDINANCE.
WHEREAS, it has come to the attention of the City Council that
an appropriation for Iand Fund Expenditures of $174,485, a recognition
of Land Fund Revenues of $174,485 and a transfer of $50,000 from the
Transportation/Mall Fund to the Transit Fund were inadvertently deleted
from the provisions of Ordinance No. 74, Series of 1982, and
WHEREAS, it was the intention of the City Council to authorize the
aforesaid appropriation, recognition and transfer at the time
Ordinance No. 74, Series of 1982, was adopted, and
~fn~IIEAS, the City Council desires to amend Ordinance No. 74,
Series of 1982, so as to accurately reflect the intention of the
City Council with regard to the aforesaid appropriation, recognition
and transfer, and
WHEREAS, the City Manager has certified that as of the date of
the passage of Ordinance No. 74, Series of 1982, revenues and funds in
excess of those estimated in the budget were available for appropriation.
NOW, THEREFORE BE IT ORDAINED BY %%qE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
Section 1
That the title of Ordinance No. 74, Series of 1982, be amended by
adding the following at the end of the title: "; APPROPPJATING
LAND FUND EXPENDITLrRES OF $174,485; P~COGNIZING LAND FUhD REVENUES
(k~ $174,485; AND TRANSFERRING $50,000 FRO61 THE TRANSPORTATION/MALL
FUND TO THE TRkNSIT FUND."
Section 2
That Section 1 of Ordinance No. 74, Series of 1982, be amended
by inserting the following language at the end of Section 1:

"~appropriating Land Fund Expenditures of $174,485; ,cecognizing
Land Fund Revenues of $174,485; and tranferring $50,000 from the
Transportation/Mall Fund to the Transit Fund."
Section 3
That Exhibit "A" annexed to Ordinance No. 74, Series of 1982,
be amended by the addition of the aforesaid appropriation, recognition
and transfer for the purposes specified as described in the amended
Exhibit "A" which is annexed hereto and made a part hereof.
Section 4
If any section, subsection, sentence, clause, phrase or portion
of this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be deemed
a separate, distinct and independent provision and such holding shall
not affect the validity of the remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the ~
