ORDINANCE NO.
(Series of 1983)
AN ORDINANCE APPROVING THE PURCHASE PRICE (AND THEREBY RATIFYING A
CONTRACT TO PURCHASE) OF CERTAIN REAL ESTATE WITHIN THE CITY OF
ASPEN WITH OPEN SPACE FUNDS AND DESIGNATING THE SUM OF $80,000 TO
PURCHASE THE SAME FROM OPEN SPACE PROCEEDS
WHEREAS, the City Manager, with the advice of the Open Space
N~gotiating Team, has negotiated the conditional purchase of cer-
tain real estate with open space funds and the contract for pur-
chase is conditioned on approval thereof by the City Council.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the Vacant Land Contract to Buy and Sell Real Estate
dated ~J~e, 1~ 1983 (a copy of which is attached hereto as Exhi-
bit "A" and incorporated herein by this reference) for the pur-
chase of Lot 1, Block 4, Lakeview Addition, City of Aspen, Pitkin
County, Colorado, be and hereby is ratified and approved.
Section 2
That the sum of $80,000 be and hereby is designated from open
space land proceeds for the purchase of Lot 1, Block 4, Lakeview
Addition, City of Aspen, Pitkin County, Colorado.
Section 3
That the City Manager is hereby authorized and directed to
execute all documents hereafter necessary to complete the convey-
ance of said Lot 1, Block 4, Lakeview Addition, City of Aspen,
Pitkin County, Colorado.
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent

provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the
