AN ORDINANCE REPEALING ORDINANCE NO. 4 (SERIES OF 1983)
WHICH DELETES THE APPLEJACK INN FROM THE L-3
LODGE PRESERVATION ZONE
WHEREAS, on December 27, 1982, the City Council of
the City of Aspen, Colorado, did enact Ordinance No. 68
(Series of 1982) rezoning certain lodges existing in the
City to L-3, Lodge Preservation; and
WHEREAS, at the request of the owners of the
Applejack Inn the City Council amended Ordinance No. 68
(Series of 1982) to delete the Applejack Inn from the
provisions thereof, said property being described more
specifically as Lots East ~ of D and all of E, F, G, H, J,
Block 45.
WHEREAS, the owners of the Applejack Inn did not
fully understand the ramifications of deletion of the
Applejack Inn from the L-3 Lodge Preservation.
WHEREAS, in recognition of the above mentioned
misunderstanding the City Council desires to repeal
Ordinance No. 4 (Series of 1983) and reinstate L-3 zoning
for the East ~ of D and all of E, F, G, H, J, Block 45.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That Ordinance No. 4 (Series of 1983) is hereby
repealed.
Section 2
If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed~a separate,
distinct and independent provision and such holding shall
not affect the validity of the remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on
the ~ daY of~ , 1983, at 5:00 p.m. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado, ~
days prior to which hearing notice of the same shall be
published once in a newspaper of general circulation within
the City of Aspen.
