Mill St.--Popcorn Wagon DATE: June 22,1998 SUMMARY: We have received an application for an HPC Exemption for the Popcorn Wagon located at 305 S. Mill St. The applicant is proposing some interior improvements in the prep kitchen (dishwasher addition, relocating the sinks), and painting the exterior ofthe prep kitchen (same color) which do not require approvals, but do require building permits (except painting). Additionally, the applicant is requesting approval of an HPC Exemption for the following items: 1) Adding new undercounter refrigerator which will require the minor expansion of the lower portion of the rear Popcorn Wagon. The footprint of the cart will remain unchanged. 2) Existing brick planters will be repaired by adding steel reinforcement and replacing missing brick; 3) Removal of existing dead evergreen tree; 4) Replacement of the existing awning along the front edge of the Popcorn Wagon. The sign on the awning will not exceed 6" in height per the sign code. Details of each of these items are included in the application packet attached. HPC EXEMPTION PROCESS: These items require the approval of the Community Development Director for an exemption from HPC review. Please refer to Section 26.72.010 C.2. below: 2. Development which the community development director shall exempt from HPC review shall include repair of existing architectural features, replacement of architectural features when found necessary for the preservation of the structure, and similar remodeling activities which create no change to the exterior appearance of the structure and have no impact on its character. The community development director shall exempt awnings, canopies, fences, mechanical equipment or other similar attachments to, or accessory features of a structure, provided however, that in the process of erecting said attachments, none of the significant features of the structure are destroyed or permanently removed. Incidental destruction or limited removal necessary to erect any ,.r · <h rp; , 2. ' , .h. attachment shall not make the action significant development. The community development director shall exempt signs which are not reviewed under Section 26.72.010(F)(2)(A). Within the Commercial Core, the community development director shall exempt any insignificant changes in the site design of an individual property, such as paving and new street furniture. . . LOCATION: Popcorn Wagon--305 S. Mill St. ZONING: CC Commercial Core APPLICANT: Susan Parry, represented by Milton Stewart. STAFF FINDINGS: Staff finds that the proposed expansion to the rear of the popcorn wagon, the repair to the brick planters, the removal of the evergreen tree, and replacement of the existing awning are eligible for an exemption from Section 26.72.010(C)(2), and do meet the requirements set forth in that section. Staff recommends that the Community Development Director approve these exemptions for the Popcorn Wagon located at 305 S. Mill St., subject to the following conditions: 1. That building permits be applied for all work, including interior work such as electrical, plumbing, and mechanical work as necessary; 2. That the Environmental Health Dept. sign off on the proposed changes to the restaurant operation prior to the issuance of building permits; 3. That the necessary Tree Removal Permit be issued by the Parks Dept. prior to the removal of any trees; 4. That the replacement bricks match the existing brick planter, and that the mortar color and mix and strike pattern match the existing; 5. That the addition to the wagon be painted to match the existing paint color of the wagon as indicated in the application; 6. That the lettering on the sign located on the awning will not exceed 6" in height per the sign code; and 7. Mill St. Aspen, Colorado 81611 Representations: 1. "The Popcorn Wagon" is a restaurant with outdoor seating, located at: 305 S. Mill St., Aspen, Colorado. The restaurant consists of: a. a wagon, a non-permanent fixture & personal property of Susan Parry b. permanent improvements including a prep kitchen, parking area for the wagon, seating area, & planters, all currently owned by Stanford University and leased to Susan Para 2. This location is within the Historical District. 3. The Owner, Susan Parry, is represented by Milton Stewart. 4. The fixtures and appliances were installed in the wagon approximately 23 years ago, and have deteriorated to the extent that some are non-functional and most are in need of replacement. The equipment is functionally inefficient relative to contemporary standards, difficult to maintain, and potentially hazardous to the health of the employees and customers. 5. The brick planters have cracked and have loose bricks. 6. The Prep Room for the popcorn wagon, located adjacent to the wagon is part of the restaurant and contains • storage, food prep sinks, and sinks for washing dishes, pots, etc. Proposed Improvements: 1. The owner wishes to replace the existing fixtures as may be possible, with new equipment. All of these fit within the interior of "The Popcorn Wagon" or the associated prep room except for the new refrigerators and counter appliances for "The Wagon" 2. The new refrigerators are similar to the existing undercounter refrigerators, they do require a minor amount of additional room at the bottom rear, requiring a minor modification to the back ofthe wagon. See diagram. 3. Non of the upgrades listed above change the exterior appearance ofthe front or sides ofthe wagon. The footprint is unchanged. The back of the wagon is currently, and will remain a painted plywood box, slightly reconfigured to contain the new refrigerators. 4. The owner is contemplating adding a dishwashing machine in the prep room, which may require some reconfiguration ofthe existing sinks. Non ofthis work will effect the exterior ofthe existing building. 5. The owner will repaint the building and the wagon. No change in the wagon's existing colors is contemplated. 6. Minor repairs to the existing wiring, plumbing, and other mechanical systems are included in the scope of the work. 7. The brick planters will be reinforced with steel and the brick repaired. 8. The trees located in the planters may need to be replaced if it is determined that they are causing the planters to deteriorate. The large evergreen tree located next to the wagon has died, showing only an insignificant amount of live foliage this year. It should be removed as in it's decaying state it is not attractive, and allows the potential for falling material from the tree and from the birds roosting in the tree to impact people and food below. 9. The small awning across the front edge ofthe roof will be replaced. This awning is shown in the documents from the original approval. 10. The broken glass will be replaced. The applicant intends to keep all improvements within the scope of what is exempt from HPC review. The applicant understands that all improvements listed above fall within the "Definition Of Development Which Qualifies For A Community Development Director Exemption From HPC Review". Mill St. Aspen, Colorado 81611 Representations: 1. "The Popcorn Wagon" is a restaurant with outdoor seating, located at: 305 S. Mill St., Aspen, Colorado. The restaurant consists of: a. a wagon, a non-permanent fixture & personal property of Susan Parry b. permanent improvements including a prep kitchen, parking area for the wagon, seating area, & planters, all currently owned by Stanford University and leased to Susan Parry 2. This location is within the Historical District. 3. The Owner, Susan Parry, is represented by Milton Stewart. 4. The fixtures and appliances were installed in the wagon approximately 23 years ago, and have deteriorated to the extent that some are non-functional and most are in need of replacement. The equipment is functionally inefficient relative to contemporary standards, difficult to maintain, and potentially hazardous to the health of the employees and customers. 5. The brick planters have cracked and have loose bricks. 6. The Prep Room for the popcorn wagon, located adjacent to the wagon is part of the restaurant and contains storage, food prep sinks, and sinks for washing dishes, pots, etc. Proposed Improvements: 1. The owner wishes to replace the existing fixtures as may be possible, with new equipment. All of these lit within the interior of"The Popcorn Wagon" or the associated prep room except for the new refrigerators and counter appliances for "The Wagon" 2. The new refrigerators are similar to the existing undercounter refrigerators, they do require a minor amount of additional room at the bottom rear, requiring a minor modification to the back ofthe wagon. See diagram. 3. Non ofthe upgrades listed above change the exterior appearance ofthe front or sides ofthe wagon. The footprint is unchanged. The back of the wagon is currently, and will remain a painted plywood box, slightly reconfigured to contain the new refrigerators. 4. The owner is contemplating adding a dishwashing machine in the prep room, which may require some reconfiguration ofthe existing sinks. Non of this work will effect the exterior of the existing building. 5. The owner will repaint the building and the wagon. No change in the wagon's existing colors is contemplated. 6. Minor repairs to the existing wiring, plumbing, and other mechanical systems are included in the scope of the work. 7. The brick planters will be reinforced with steel and the brick repaired. 8. The trees located in the planters may need to be replaced if it is determined that they are causing the planters to deteriorate. The large evergreen tree located next to the wagon has died, showing only an insignificant amount of live foliage this year. It should be removed as in it' s decaying state it is not attractive, and allows the potential for falling material from the tree and from the birds roosting in the tree to impact people and food below. 9. The small awning across the front edge ofthe roofwill be replaced. This awning is shown in the documents from the original approval. 10. The broken glass will be replaced. The applicant intends to keep ali improvements within the scope of what is exempt from HPC review. The applicant understands that all improvements listed above fall within the "Definition Of Development Which Qualifies For A Community Development Director Exemption From HPC Review".
