HomeMy WebLinkAboutordinance.council.053-00 RECORD OF PROCEEDINGS 10i Leaves (Series of 1~83) AN ORDINANCE BY THE CITY COUNCIL OF ASPEN, COLORADO, CERTIFY] ~G TO THE TREASURER OF PITKIN COUNTY, COLORADO, CERTAIN DELINQUENT 3NI- CIPAL CHARGES OWING TO THE CITY OF ASPEN FOR COLLECTION WITH COUNTY PROPERTY TAXES, PURSUANT TO SECTION 31-20-105, COLORAD REVISED STATUTES (C.R.S.) 1973, AS AMENDED WHEREAS, the City of Aspen, Colorado, through its electr: , water and building departments has certain delinquent customer accounts; and WHEREAS, the City has made all reasonable efforts to coll ct these delinquent accounts short of legal action; and WHEREAS, the Municipal Code of the City of Aspen by Secti. ns 23-22, 23-106, 7-143 and 20-18 permits collection of delinquent electric and water charges and park dedication fees by lawsuit or lien, or both; and WHEREAS, state law, by Sections 31-20-101 et seq., C.R.S. 1973, as amended, provides that delinquent municipal charges be certified by the municipality to the county treasurer, whose duty is thereupon to collect such delinquent charges in the sam6 manner as county property taxes are collected; and WHEREAS, the City Council has determined that it is in the best interests of the City to reduce its delinquent utility and park dedication fee accounts by collection in this manner as prom vided by law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That all of the delinquent electric and water utility and park dedication fee accounts receivable by the City of Aspen, as listed on Exhibits "A", "B" and "C", copies of which are attached hereto and incorporated herein by reference, be and hereby are RECORD OF PROCEEDINGS 1~ Leaves certified to the Treasurer of Pitkin County, Colorado, for c< Llec- tion with county property taxes, in such cases made and provided by law including, without limitation, Section 31-20-101 et se ., C.R.S. 1973, as amended, and Sections 23-22, 23-106, 7-143 an~ 20-18, Aspen Municipal Code, as amended. Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of remaining portions thereof. Section 3 A public hearing on the ordinance shall be held on the /~ day of 7~~-~ , 1983, at 5:00 P.M. n the City Council Chambers, Aspen City Hall, Aspen, Colorado.
