John Worcester, city attorney, told Council the Bradens own lots Q, R and G andH.
The Bradens tiled an action for quit claim for the portions of the alley, north of lot
Q. A deed was executed in the 1800's fora portion of the platted so the city no
longer has an interest in that portion. The city still owns the portion of the alley
north of lot R, which the Bradens are requesting the city vacate. W orcesteI: told
Council the city currently has an easement for a trail. The parks department does
not think it will be an easy place to put in a trail through this easement. In exchange
for this vacation, the Bradens will give the city an easement from the top of the b
to the bottom where the north boundary of the old trail easement is. The parks
department can construct a 10 foot trail with shoulders on each side. After it is
constructed, the city will do an as-builtsUlVey and record it.
Mayor Bennett opened the public hearing. There were no conunents. Mayor

Councilwoman Richards asked if the city can require the pJ;operty owners not to
fight any construction of a trail actually being built. Worcester said this can be
required of the current owner but not runwith the land. Dave Mylar, representing
the applicant, said his clients would be willing to add some language or write alett
stating they will not oppose the city's efforts to develop a trail. Mylar agreed to ad '
to !1license agreement, "Petitioners agre~ not to oppose or object to' construction 0
trail which is undertak~n and completed in compliance with the existing easement
and the neW easement and license agreement described above" .
Councilwoman Richards moved to adopt Ordinance #32, Series.of 1996, including
the language to be in a license agreement; seconded by Councilwoman Wagg
Roll call vote; Councilmembers Marolt, yes; Waggaman, yes; Richards, yes; May r
Bennett, yes. Motion carried.
RESOLUTION #50. SERI~S OF 1996 . Temporary Use Permit Blazing Paddles

Suzanne Wolff, community development department, told COWlcil Blazing Paddles
is requesting a temporary use pennit to continue to use the skating building at the
Silver Circle ice rink, lot 6 Aspen Mountain PUD until September 30th. Ms. Wolff
told Council lot 6 was restricted during the approvals for the Aspen Mountain Pill.
Ms. Wolff told Council the applicants were told this use would be acceptable and
have been operating aU summer based on that. Staff has discovered that $e in

was not to have any commercial operations at the ice rink. Ms. Wolff'said this is
only to allow them to, operate until the end of the summer season. , Ms. Wolff s,aid
staff has ,had no complaints about :alazing Paddles and this actually takes traffic off
downtown streets. Councilwoman Waggaman asked if the applicants can be asked
to load on the side streets rather than on Durant avenue as Durant is a major
transportation street. '

Doug Niehaus, manager of the Tipple Inn condominiums, said Blazing Paddles has
been parking and loading on Dean street between the North ofNeU and Tipple Inn.
The concern is this area is getting congested with skateboarders, roller bladders,
people that use the alley for "just amiriute". Niehaus said they would like the
applicants told not to use this area.
Mayor Bennett closed the public hearing.
Stan Clauson, community development director, said this approval is to get the
applicants through the season. Staff has not intended to take an exhaustive look on
how BlazingPaddles operation maybe changed. Clauson said Blazing Paddles wi!
not be able to retumunless there is an amendment to the PUD. This amendment
would take a look at the entire area, including traffic and parking. Councilwoman
Richards said she would like to make sure the Dean street is not being used as a
parking area. This should be enforced by the police. Councilwoman Richards sai
she would be willing to look at an amendment for the ice rink area to have it be,
more available for eonununity uses and more lively.
Councilwoman Richards moved to adopt Resolution #50, Series of 1996, the
temporary use Pennit with the condition that the trucks and loading not happen on
Dean street Tipple Inn area; seconded by Councilman Marolt.
Mayor Bennett said he would be glad to consider a request for an amendment to e
Aspen MOWltain PUD and using empty space there, makes sense.

SUMMARY: The Applicants (Blazing Adventures and Laurie and Bob Harris) are requesting a temporary
use permit to use the skating building at the Silver Circle Ice Rink as a pick up and drop off location for
guests, The Silver Circle is located on Lot 6 of the Aspen Mountain PUD. Please refer to the application
information (Exhibit A) for a description of the proposal.
The Community Development Department recommends approval of the temporary use permit for Blazing
Adventures to continue to operate until September 30, 1996.
BACKGROUND: Lot 6 of the Aspen Mountain PUD was restricted as a "community activity center and
public ice skating rink" pursuant to a Declaration of Restrictive Covenant recorded on June 2~, 1990, in
Book 624 at Page 51 of the records of the Pitkin County Clerk. Lot 6 was subsequently rezoned to the
"Park" zone district. The "Aspen Winter Garden" amendments to the Aspen Mountain PUD were approved
by Ordinance No. 12, Series of 1992. These approvals are attached as Exhibit B.
Since 1975 Blazing Adventures has booked trips and picked up and dropped off guests at the comer of
Hyman and Mill. That location is still used as the main booking location, however, congestion in that area
led the applicants to search for an alternate pick up and drop off location with convenient access for
vehicles. In 1995 the applicants discussed the possibility of using the Silver Circle with John Sarpa of
Savanah, the owner of Lot 6, Ernie Fyrwald of Aspen Sports, manager of the skating concession, and Bill
Drueding, City Zoning Officer. At that time Mr, Drueding determined that this use was consistent with the
approvals granted for Lot 6 since the use was recreational in nature.
Staffhas since discovered an interpretation from Diane Moore dated November 22, 1992, regarding
commercial uses at the ice rink, which states that the intent of the ice rink/park was to allow local public
use, and not to allow commercial operations (Exhibit C). Staff considers Blazing Adventures' use of the
facility to be commercial in nature.
CURRENT ISSUES: Staff informed the applicants that their use of the skating building does not comply
with the approvals for Lot 6, but agreed to process a temporary use permit to allow them to continue their

operation until the end of the summer season. In order to continue with any commercial operation in this
location in the future, an amendment to the Aspen Mountain PUD must be processed.
STAFF COMMENTS: Pursuant to Section 26.96 of the Aspen Municipal Code, the following review
criteria shall be considered for all temporary uses:
A, The location, size, design, operating characteristics, and visual impacts of the proposed use.
Response: Blazing Adventures is using the skating building as a pick up and drop off location for guests.
A computer and phone have been installed to accommodate a reservationist who dispatches activities.
Reservations can be made at this location, but the building is mainly used as a central meeting location for
guests.
B, The compatibility of the proposed temporary use with the character, density and use of structures
and uses in the immediate vicinity.
Response: The property is zoned Park; surrounding zone districts incll\de Commercial Lodge to the east
(North of Nell building), Lodge/Tourist Residential to the south (Grand Aspen Hotel) and west (Mountain
Chalet) and Public to the north (Rubey Park bus station). Staff has not received any complaints from the
neighbors regarding Blazing Adventures' use of this location.
C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and trqffic patterns,
mlO1icipal services, noise levels, and neighborhood character.
Response: This location was chosen because it is easily accessed by Blazing Adventures' vehicles, and has
less impact on in-town pedestrian and vehicular traffic than the previous pick up and drop off location at
Mill and Hyman. Guests can access this location easily on foot and by bus.
D. The duration of the proposed temporary use, and whether a temporary use has previously been
approvedfor the structure, parcel, property or location as proposed in the Application.
Response: The permit is requested to allow the applicant to continue to operate until September 30, 1996.
An amendment to the Aspen Mountain PUD will be required to allow future commercial use of the
structure.
E. The purposes and intent of the zone district in which the temporary use is proposed.
Response: The purpose of the Park zone district is "to ensure that land intended for recreation use is
developed so as to serve its intended use, while not exerting a disruptive influence on surrounding land,
uses," Staffhas determined that this commercial use is not consistent with the intent of the zone district or
the prior approvals for this property, but that continuation of the use until the end of the summer season is
acceptable since the use has been in operation all summer and has not disrupted adjacent uses.
F. The relation of the temporary use to conditions and character changes which may have occurred in
the area and zone district in which the use is proposed.

Response: The use is compatible with the neighboring uses and zone districts and serves the resident anc
visitor population of Aspen.
G. How the proposed temporary use will enhance or diminish the general public health, safety or
welfare.
Response: The use does not affect public health, safety or welfare.
FINANCIAL IMPLICATIONS: There are no discernible public costs associated with this temporary u,e
request.
RECOMMENDATION: The Community Development Department recommends approval of the Blazing
Adventures temporary use pennit to stage their trips from the skating building at the Silver Circle Ice RiIi.<,
subject to the following conditions:
1. This temporary use pennit shall allow the applicant to continue to operate until September 30,
1996.
2. An amendment to the Aspen Mountain PUD shall be required to allow future commercial use oflhe
structure.
3. The applicant shall manage and conduct its activities as allowed under this temporary use pennit in
such a manner so as not to create or allow a public nuisance as defined at Section 15.04.520 of the
Municipal Code and or Section 16-13-304(1)(a) of the Colorado Revised Statutes.
4. The applicant shall not create or allow noise levels in excess of those pennitted levels as set forth at
Section 18.04.040 of the Municipal Code.
5. The applicant shall comply with Section 13,08.110 of the Municipal Code, which prohibits the
idling of the motor of a stationary vehicle for more than 5 minutes within anyone hour time period.
6. The applicant shall adhere to all representations made in the application and in public hearings.
7. Failure to comply with the conditions of approval or representations made shall be cause for the
suspension of the temporary use pennit.
PROPOSED MOTION: "I move to approve Resolution No. 50 for a temporary use pennit for Blazing
Adventures to stage their activities from the Silver Circle Ice Rink on Lot 6 of the Aspen Mountain PUD,
until September 30, 1996."

In short, the Silver Circle was p.rimarily envisioned as a nl1\1ote pick up and drop off
location for our raft, bike and jeep guests. To accommodltte this fimction we have supplied the
tninima1 support &,ciIities - computer, phone, reser-vationist and appropriate signage. The vast
majority of our "bookings" still takes place at other 1000000ons, and guests are then directed to
meet us at the Silver Circle. The only activity taking pw.:e i.n the building is the booking and
dispatching of recreational activities. Despite the fiIct that we have been approached by other
vendors who would also like to sell their products at the Silver Circle, we have declined these
suggestions in order to keep our presence at the rink foeuSlld exclusively on our outdoor
activities.
Without the availability of the Silver Circle to coordinate our pick ups and drop offs, this
function would become cumbersome fur our stall: inconvenient for our guests and problematic for'
Aspen's already overburdened traffic concerns,
We would like to request a Temporary Use Pennit to enable us to remain until the end of
the season. We will be unavailable for the August 26th meeting; if our presence is required for
discussion. we will be happy to come to the next council meeting. Thank you.

Dear Ernie:
I am in. receipt of your letter outlining your ideas for t~l.e
operations of the Silver Circle ice skating rink/park. Your letter
essentially requests authorization from the city as to the summer
uses proposed for this~, si te.
I would iike to provide you with some background regarding the uses
that were contemplated for this site.: A restrictive convenant was
recorded on 6/29/90 stating that Lot 6 (ice rink/park) ~s
restricted as a community activity center and public ice skating
rtnk. Subsequently, Lot 6 was rezoned to the park zone,district.
The park zone district includes, permitted uses such as parks,
playfields, golf courses, riding stables, botanical gardens and
nurseries., ,The conditional uS,es include, recreation J:lUi ldings,
sport shops, restaurants ,and maintenanqe buildings.
During the land use approval process .cor the ice rink,' there was
considerable discussion that focused on maintaining "local public
uS'e" of the property. Summer uses were discussed and the inter_t
was to provide an open area that could be utilized for community
activites such as concerts, craft shows, and other special events.
,If special events were utilized on the site that excluded the
public, then approval would be, subjected to the city special event
approval procedure. Additionally, this park represented an area
that anyone could quietly enjoy.
I do not believe that your request is consistent with the goal of
providing public use of the park area. The summer uses that you
propose represent commercial operations and this was not the intent
when the project was approved by Council. The commercial
activities would preclude the public from utilizing the park in the
manner intended. I have to take exception with your comment that
the uses proposed do not change the use of the facility as I
believe they do.

In short, the Silver Circle was primarily envisioned as a remote pick up and drop off
location for our raft, bike and jeep guests. To accommodate this function we have supplied the
minimal support facilities - computer, phone, reservationist and appropriate signage. The vast
majority of our "bookings" still takes place at other locations, and guests are then directed to
meet us at the Silver Circle. The only activity taking place in the building is the booking and
dispatching of recreational activities. Despite the fact that we have been approached by other
vendors who would also like to sell their products at the Silver Circle, we have declined these
suggestions in order to keep our presence at the rink focused exclusively on our outdoor
activities.
Without the availability of the Silver Circle to coordinate our pick ups and drop offs, this
function would become cumbersome for our staff, inconvenient for our guests and problematic for
Aspen's already overburdened traffic concerns.
We would like to request a Temporary Use Permit to enable us to remain until the end of
the season. We will be unavailable for the August 26th meeting; if our presence is required for
discussion, we will be happy to come to the next council meeting, Thank you.
