AN ORDINANCE OF THE CITY OF ASPEN, COLORADO, AMENDING TITLE 23 OF THE
MUNICIPAL CODE TO REMOVE CIGARETTES AS EXEMPT FROM SALES TAX.
'�.W.HEREAS, City Council adopted Resolution#122, Series of 2017 submitting to the
electorate a question seeking authority to increase taxes on the sale of cigarettes and other
tobacco and nicotine products; and
WHEREAS, at the November 2017 Coordinated Election, the electorate approved the tax
by a vote of 1,294 for and 438 against;
WHEREAS, the tax became effective on January 1, 2018.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO, THAT:
Section 1. Section 23.32.100 Exemptions from sales tax be amended as follows:
Section (a) (6) Cigarettes be removed and the numbering for subsequent sections be
amended to reflect the change.
Section 2. Severability
If any section, subsection sentence, clause, phrase, or portion of this ordinance is for any
reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be
deemed a separate, distinct, and independent provision and.shall not affect the validity of the
remaining portions thereof.
Section 3. Public Hearing
A public hearing on the ordinance shall be held on the 301h day of April, 2018, in the City
Council Chambers,Aspen City Hall, Aspen, Colorado.
