HomeMy WebLinkAboutordinance.council.063-83 RECORD OF PROCEEDINGS 100 leaves (Series of 1983) AN EMERGENCY ORDINANCE CANCELLING THE SPECIAL ELECTION SCHEDULED TO BE HELD ON TUESDAY, NOVEMBER 15, 1983, AND RESCINDING AND REPEALING RESOLUTION NO. 28 (SERIES OF 1983) AND ORDINANCE NO. 50 (SERIES OF 1983). WHEREAS, pursuant to Resolution No. 28 (Series of 1983) and Ordinance No. 50 (Series of 1983) the City Council did schedule and set forth the questions and details in regard to a special election on Tuesday, November 15, 1983, and WHEREAS, the City Council has been advised by the City Manaqer and bond council that there is no longer a necessity to hold a special election on November 15, 1983, and WHEREAS, the City Council desires to save the time and exoense of conducting said special election, reserving, however, the perrogative to submit the questions established in Ordinance No. 50 (Series of 1983) to the electors at a f~ture date, and WHEREAS, pursuant to Section 4.11 of the City Charter of the City of Aspen, the City Council may enact an emergency ordinance for the preservation of public property, health, peace, or safety,and WHEREAS, given the urgency of cancelling the November 15, 1983 electior as quickly as possible to save the time and expense of conducting said election, the City Council deems it to be in the best interest of the City and its inhabitants to repeal and rescind Resolution No. 28 (Series of 1983) and Ordinance No. 50 (~eries of 1983) by emergency ordinance, all as set forth herein below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the special election scheduled for Tuesday, November 15, 1983, be and the same is hereby cancelled, and that Resolution No. 28 (Series of 1983) calling said special election and Ordinance No. 50 (Series of 1983) RECORD OF PROCEEDINGS 100 Leaves setting forth questions and providing for other details in regard to said election be and the same are hereby rescinded and repealed. ~ Section 2 The City Council hereby declares this ordinance to be an emergency ordinance to be enacted pursuant to Section 4.11 of the City Charter of the City of Aspen in order to save the City and its inhabitants the unnecessary time and expense for conducting said election. Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed as separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 4 This ordinance shall take effect immediately pursuant to Section 4.11 of the City Charter of the City of Aspen.
