Galena Street- Minor Review, Public Hearing 1, lil DATE: October 11,2000 SUMMARY: This proposal involves expanding an existing roof deck on the Brand Building. The Brand Building is listed on the National Register of Historic Places, is a local landmark, and is within the Commercial Core Historic District. APPLICANT: Richard Wall, owner of Unit #13, represented by Stryker/Brown Architects. LOCATION: 203 S. Galena Street, Brand Building Condominiums, Block 88, City and Townsite of Aspen. ZONING: The property is zoned "CC, Commercial Core." MINOR DEVELOPMENT No approval for any development in the "H," Historic Overlay District, or involving historic landmarks shall be granted unless the Historic Preservation Commission finds that all of the following standards (Section 26.415.010.B.4) are met: a. The proposed development is compatible in general design, scale, site plan, massing and volume with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an "H," Historic Overlay District, or is adjacent to an historic landmark. For historic landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot, exceed the allowed floor area by up to five hundred (500) square feet, or exceed the allowed site coverage by up to five (5) percent, the Historic Preservation Commission may grant necessary variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood than would be development in accord with dimensional requirements. In no event shall variations pursuant to this Section exceed those variations allowed under Section 26.520.040(B)(2), for detached accessory dwelling units. 1 .. Response: The Brand Building is the only two story sandstone building in downtown Aspen. It is well preserved and retains the integrity of the original design. Currently, there is walkout access to the southern part of the roof from several of the upper floor apartments. These alterations to the building are mostly hidden from view due to the shape of the parapet wall. This application affects the northern part of the building, which already has a 600 square foot wood deck with chairs and a grill. It is accessed via a glass enclosed staircase which is the tallest feature on the roof. The proposal is to expand the width of the enclosed staircase, to construct additional deck area partly covered by a roof, to add railings and planter boxes around the perimeter of the deck, and to install a hot tub and permanent grill. This building, and all of the proposed additions, are under the maximum height limit of 40', so no variances are needed. Staff has several concerns with the visibility of the proposed improvements. On the Paragon Building, which recently came in for a similar review, there was a requirement to hold all improvements back at least 3 feet from the street facing building walls. No such setback is not being maintained along the north wall (Hopkins Street side) of the Brand Building. The railing proposed on the north is solid, so that snow will be trapped between it and the parapet, a situation that is likely to negatively affect the condition of the structure. Also, the parapet drops in height on the northwest corner of the building meaning that alterations in this area may not be concealed. The stair enclosure is already a very visible and therefore inappropriate addition on the roof of this significant historic structure. The applicant proposes to expand its width slightly. There is no code requirement to justify this change, but it is not likely that the alteration will be perceivable from the street. If the enclosure is really being essentially reconstructed, staff would encourage discussion of ways to redesign the element to lessen its impacts. The new roof that is proposed to cover a portion of the deck will be taller than the staircase and will be very noticeable from the street. It is incompatible with the character and design of the historic building and would detract from it in the fact that it will affect the profile of the building and does not use roof forms or materials that are related to the historic structure. Staff recommends that this element be deleted from the project. It appears that some of the items proposed in this plan will not be visible from the street. Additional deck area, seating, the hot tub, grill, and planter boxes are generally not objectionable, however, their visibility at the northwest corner of the building, as mentioned above, must be explored further. Staff does have concerns with allowing trees, rather than flowers or low shrubs, in the box planters. 2 .. b. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: The issue of rooftop development in the downtown has come up several times at HPC recently. While there are many positive effects of increasing activity in the downtown, the HPC is concerned with visibility from the street, and to a lesser extent, visibility from surrounding buildings and from the mountain. The character of the neighborhood would be affected by any rooftop development that detracted from some of the important features of the 19th century structures, such as strong, decorative cornices and flat roofs. c. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels. Response: The Brand Building, historically known as the Hyman Block, was built for David H. Hyman, an early promoter of Aspen. It is a two story Peachblow sandstone structure, completed in 1891 at a cost of $30,000, and became the home of the First National Bank. The second floor was a large hall, which housed the Patriotic Order Sons of America (P.O.S.A.), a lodge dedicated to "society purposes and social gatherings." From the 1920's into the 1960's, the first floor of the building was occupied by gas stations, auto dealers, and auto repair shops. By 1971, the building had fallen into disrepair and was close to being condemned. The current owner purchased the building and began making repairs, and artists such as Roy Lichtenstein, Andy Warhol, and James Rosenquist used the upper floor for studios. The proposal does not involve alterations that would detract from the history of the structure. d. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. Response: Staff feels that some of the alterations will diminish the architectural integrity of the building, as discussed under the first review standard. The applicant should do "mock-ups" of the proposed development at the northwest corner of the building and for the staircase expansion. ALTERNATIVES: The HPC may consider any ofthe following alternatives: • Approve the application as submitted. • Approve the application with conditions to be met prior to issuance of a building permit. 3 .. ..... • Table action to allow the applicant further time for restudy. (Specific recommendations should be offered.) • Deny approval finding that the application does not meet the Development Review Standards. RECOMMENDATION AND RECOMMENDED MOTION: Staff recommends that the HPC continue the application with the following direction: 1. All improvements will be held back a full three feet from the north building wall. 2. The applicant must mock-up the proposed railing at the northwest corner of the building and the expansion of the existing stair enclosure for HPC to review. 3. If the stair enclosure is to be expanded, the applicant and HPC should discuss ways to improve its relationship to the historic structure. 4. The railing along the north wall must be open so that snow is not trapped against the parapet. 5. Nothing but flowers and low shrubs may be planted in the box planters. Trees are not permitted. 6. No furnishings on the roof may be taller than 6 feet. 7. The roof over the deck is not appropriate. 8. That the applicant agree that all improvements will be held back a full three feet from the north building wall; 2. That if the applicant wishes to expand the staircase enclosure, the applicant shall provide the HPC monitor with final drawings for review as to its relationship to the historic structure, prior to the application of building permits; 3. That the applicant agree to construct the railing along the north wall to be open so that snow is not trapped against the parapet; 4. That the applicant agrees to plant nothing but flowers and low shrubs in box planters. Trees shall not be permitted; 5. That the applicant agree that no furnishings on the roof shall be taller than six feet in height from the roof surface; 6. That the applicant agrees that no roofing shall be constructed over any part of the decking on the roof; 7. ARCHITECTS Meeting Notes: TO: HPC FROM: Steven Buettow DATE: August.24.2000 RE: Project Description, attachment 4 This existing unit is #13 in the Brand Condominiums, 205 S. Galena. We are proposing to remodel the existing Roof Deck. The current Deck is 619.75 SF. It is a raised wooden platform with metal sitting chairs and has an existing gas grill. We are proposing to expand the Deck to 1,112.26 SF with additional wooden platforms. They will be 2x6 redwood decking over 2x 6 redwood joist. Since the roof slopes from East to West and the top of roof elevation varies, we are proposing two platform elevations stepping down 7" in similar relation to the roof. From the existing stair tower we are proposing to build a covered porch of approximately 175 SF. This new porch element will comply with the porch definition in the Land Use Code. It will also be under the 40' height limitation. There will be no FAR increase. Two new planter boxes will be built to surround the deck with green vegetation. Hanging plant boxes will be installed on the North side from the new 42" solid rail. A Hot tub will be placed on the West side of the lower platform. We are proposing to keep the existing gas grill and install a sink cabinet adjacent to it. Overall, we have kept a 3'-0" space between the new deck and the existing 3'-0" building North parapet wall. And we placed the covered porch toward the middle of the deck away from the buildings North side and a possible street vision. The proposed development is compatible in general design, massing and volume, scale, and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District, or is adjacent to a Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area by up to 500 sq.ft. or the allowed site coverage by up to 5%, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. In no event shall variations pursuant to this section exceed those variations allowed under the Cottage Infill Program for detached accessory dwelling units, pursuant to Section 26.040.090 (B)(2). 2. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development; and 3. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels; and 4. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. Units 12,14 & 15 have them in addition to the existing one that we are remodeling. 2. The proposed development reflects and is consistent with the charactor of the neighborhood of the proposed parcel. The new Isis remodel, Aspen Drugstore and Independence Square buildings have roof terrace development and one story elements surrounding them. Covered Roof elements are seen in town. 3. The proposed development enhances the historical significance of the designated historic structures located on this parcel because it will not relate to the basic historic building form. The majority of the changes will be hidden by the existing parapet wall. The remainder are set well back from the building face and if seen at all will be a similar cedar shingles look appropriate to its time. 4. The proposed development enhances or does not diminish or detract from the architectural charactor and integrity of a designated historic structure or part thereof. This proposal is 85% hidden by the existing parapet wall and will never be seen. The covered porch element improves the existing stair tower silhouette and adds a wood and shingle element to the existing glass and metal stair structure. New green vegetation will humanize and greatly improve the present bare roof top appearance of rubber membrane,wood packing crates, metal roof top ventilator units, skylights and exposed silver ducts. The purpose of this one-on-one meeting with the historic preservation planner is to determine the review process into which your development proposal fits and to identify the 1 k }6' materials staff will need to review your application. ff • Submit development application. Based on your pre-application conference, respond to the appropriate portions of the application package and submit the requested number of copies, and fee if applicable, to the Community *480 01 Development Department. • Determination of completeness. Within five working days of the date of your submission, the application package will be reviewed by Staff to determine if all required information has been included. You will be notified in writing when additional materials are necessary. • Complete notice requirements. • Review of development application. Once the application is determined to be complete, the item will be scheduled on the soonest HPC agenda available. The submission due date is a minimum of nine days prior to the HPC meeting date to allow for staff review and memo preparation. It is the planner's task to review the application with respect to it's compliance with land use regulations and to write a memo to the Historic Preservation Commission. In the memo, the planner will recommend approval, approval with conditions, tabling, or denial of the application. The memo is normally available at the end of the week prior to the HPC meeting. At the meeting, staff will make a brief presentation of the case and then the Chair will ask the applicant or representative to make a presentation or to clarify any aspects of the project. HPC members will comment on the proposal and then vote on an action. 4. Receipt of building permit. Once the approval of HPC has been received, a building permit application may be submitted. At this time the proposal will be reviewed for compliance with the Uniform Building Code and zoning regulations. Fees for water, sewer, park dedication fees, and employee housing will be collected if due. Any document, such as a plat, deed restriction, or other agreement which is required to be filed, must be recorded before the building permit will be issued. 5. HPC assigns a member of the Commission to be the "project monitor" for each project. The monitor (and Staff) may periodically visit the site as work is under construction. If any aspects of the project change after the HPC approval, the applicant, Staff, and the project monitor will attempt to address them without returning to HPC. Erection of more that three (3) of the above listed features may be defined as minor if there is a finding that the cumulative impact on such development is minor in its effect on the character of the existing structures. • Erection of street furniture, signs, benches, public art, or similar development which is to be placed throughout the Commercial Core or Main Street Historic Districts. The community development director may determine that the development is to be reviewed as a significant development, pursuant to Section 26.72.010(F). Public hearing requirements will not apply. Galena. We are proposing to remodel the existing Roof Deck. The current Deck is 619.75 SF. It is a raised wooden platform with metal sitting chairs and has an existing gas grill. We are proposing to expand the Deck to 1,112.26 SF with additional wooden platforms. They will be 2x6 redwood decking over 2x 6 redwood joist. Since the roof slopes from East to West and the top of roof elevation varies, we are proposing two platform elevations stepping down 7" in similar relation to the roof. From the existing stair tower we are proposing to build a covered porch of approximately 175 SF. This new porch element will comply with the porch definition in the Land Use Code. It will also be under the 40' height limitation. There will be no FAR increase. Two new planter boxes will be built to surround the deck with green vegetation. Hanging plant boxes will be installed on the North side from the new 42" solid rail. A Hot tub will be placed on the West side of the lower platform. We are proposing to keep the existing gas grill and install a sink cabinet adjacent to it. Overall, we have kept a 3'-0" space between the new deck and the existing 3'-0" building North parapet wall. And we placed the covered porch toward the middle of the deck away from the buildings North side and a possible street vision. This proposed development is compatible in general design, massing and volume, scale and site plan with the designated historic structures located on the parcel because there are numerous other developed Roof Decks on this building. Units 12,14 & 15 have them in addition to the existing one that we are remodeling. 2. The proposed development reflects and is consistent with the charactor of the neighborhood of the proposed parcel. The new Isis remodel, Aspen Drugstore and Independence Square buildings have roof terrace development and one story elements surrounding them. Covered Roof elements are seen in town. 3. The proposed development enhances the historical significance of the designated historic structures located on this parcel because it will not relate to the basic historic building form. The majority of the changes will be hidden by the existing parapet wall. The remainder are set well back from the building face and if seen at all will be a similar cedar shingles look appropriate to its time. 4. The proposed development enhances or does not diminish or detract from the architectural charactor and integrity of a designated historic structure or part thereof. This proposal is 85% hidden by the existing parapet wall and will never be seen. The covered porch element improves the existing stair tower silhouette and adds a wood and shingle element to the existing glass and metal stair structure. New green vegetation will humanize and greatly improve the present bare roof top appearance of rubber membrane,wood packing crates, metal roof top ventilator units, skylights and exposed silver ducts.
