In value, it ranked only third in the city, outclassed by the Hotel Jerome and the Wheeler Opera House. It cost $40,000. Built for Henry Webber, one of Aspen's most influential and controversial figures. Formerly a shoemaker, Mr. Webber became Mayor of Aspen. ARCHITECTURAL SIGNIFICANCE: A combination of Frying Pan pink sandstone and pressed brick for the outside walls give the building great detail. You can determine if your application requires that public notice be given by reviewing Attachment 5. Table 1 of that attachment will tell you whether or not your application requires notice and the form the notice should take. Your responsibilities in this regard are summarized in the cover explanation to the table. We strongly encourage all applicants to hold a pre-application conference with a Planning Office staff person so that the requirements for submitting a complete application can be fully described to you. Please also recognize that review of these materials does not substitute for a complete review of the Aspen Land Use Regulations. While this application package attempts to summarize the key provisions of the Code as they apply to your type of development, it cannot possibly replicate the detail or the scope of the Code. If you have questions which are not answered by the materials in this package, we suggest that you contact the staff member assigned to your case or consult the applicable sections of the Aspen Land Use Regulations. appcover ' 0*41 Attachment 5 Public Hearing Notice Requirements - FS CS:S> There are three forms of notice required by the Aspen Land Use Regulations, these being notice by publication in the newspaper, notice by posting of the property and notice by mail to surrounding landowners. You can .determine whether your application requires notice, and the type of notice it requires, from Table 1, which is attached to this summary. Following is a summary of the notice requirements, including identifying who is responsible for completing the notice. 1. Publication Publication of notice in a paper of general circulation in the City of Aspen is to be done at least 15 days prior ·, to the hearing. The legal notice will be written by the Planning Office Administrative Assistant and we will place the notice in the paper within the appropriate deadline. 2. Posting Posting of a sign in a conspicuous place on the property is to be done 10 days prior to the hearing. It is the applicant's responsibility to obtain a copy of the sign from the Planning Office, to fill it in correctly and to bring proof (preferably a photograph) to the hearing that posting took place. 3. Mailing Mailing of notice is to be made to all owners of property within 300 feet of the subject development parcel by the applicant. It is the applicant's responsibility to obtain a copy of the notice from the Planning Office, to mail it according to the following standards, and to bring proof to the hearing (in the form of a signed affidavit) that the mailing took place. Standards for notice shall be as follows: a. Any federal agency, state, county or municipal government service district or quasi governmental agency that owns property within 300 feet of the subject property must be mailed notice 15 days prior to the hearing. b. All other landowners within 300 feet of the subject property must be mailed notice 10 days prior to the hearing, unless notice is given by hand delivery, in which case it must be sent 5 days prior to the hearing. C. Subdivision applications only also require notice by registered mail to all surface owners, mineral owners and lessees of mineral owners of the subject property. Application Types: The following are the Development Applications which are processed in three steps by the HPC, Commission and Council: * Designate Historic Structure 2. Development Review Procedure Summary. The three step HPC/ Commission/Council review procedure can be described as follows. Stage One: Attend pre-application conference. The purpose of this one-on-one meeting with staff is to determine the review process into which your development proposal fits and to identify the materials staff will need to review your application. Stage Two: Submit Development Application. Based on your meeting with staff, you should respond to the appropriate portions of the application package and submit the requested number of copies of a complete application, with the appropriate processing fee, to the Planning Office. Stage Three: Determination of Completeness. Within five working days of the date of your submission, the application package will be reviewed by a member of the staff. You will be notified in writing of whether the application is complete or if additional materials are required. Please be aware that the purpose of the completeness review is to determine whether or not you have submitted what was requested, not whether the information is sufficient to obtain approval. Stage Four: Review of Development Application. Once your application is determined to be complete, a date for its review by the HPC will be set. The submission due date is 25 days prior to the HPC review date, to allow for the required Public Hearing notice, staff review and memo preparation. It is the planner's task to review your application with respect to its compliance with the Code and to write a review memo. In the memo, the planner will recommend approval, denial or tabling of the application and recommend appropriate conditions to this action. The memo is normally available at the end of the week before your hearing. You will be called to pick up a copy of the memo when it is ready, or we can mail it to you if you so request. During the period of staff review, it is essential that public notice be given, when required for your development application. Attachment 5 explains how to go about giving the required notice. Your project will be presented to the HPC at a regularly scheduled meeting. A copy of the agenda showing where during the meeting your application is scheduled can be obtained when you pick up the staff memo. The typical meeting includes a presentation by staff, a presentation by you or your representative, questions and comments by the review body and the public and an action on the staff recommendation, unless additional information is requested by the review body. If an application for significant development is being consolidated with the designation process, the conceptual approval must be granted prior to the designation recommendation being made. Significant development is a two step process: conceptual review followed by final review. Conceptual development review is a public hearing, final is not. Usually final review may be accomplished within one month of conceptual approval, depending upon the scope of the project. Once a recommendation is made by the HPC, a review by the Commission can be scheduled. This review is typically scheduled for the next available agenda, within 30 days of the date of the HPC's recommendation. An updated staff memo will be prepared for this meeting, which will again be made 6 available to you just prior to the meeting. Commission action normally requires a single meeting, unless additional information is requested. Once a recommendation is made by the Commission, a review by the council can be scheduled. This review is typically scheduled for the next agenda, within about 15 days of the date of the Commission's recommendation. Ordinance adoption, however, requires two readings by Council. The second reading is a public hearing. Due to notice requirements, the second reading is generally scheduled 3 or 4 weeks after first reading. If applicable, the designation grant will be included in the Ordinance. Stage Five: Receipt of Building Permit. Once you have received final approval of your development application, you may proceed to building permit review. During this time, your project will be examined for its compliance with the Uniform Building Code. It Will also be checked for compliance with applicable provisions of the Land Use Regulations which were not reviewed in detail during the one step review (this might include a check of floor area ratios, setbacks, parking, open space and the like). Fees for water, sewer, parks and employee housing will be collected if due. Any document required to be recorded, such as a plat, deed restriction or agreement, will need to be reviewed and recorded before a Building Permit is issued. For more information on the Building Permit Stage, please visit the Building Department to obtain handouts on their review procedures. 3. Consolidation: One and two step applications which you may consolidate with a three step application are: * Conditional use * Special review * ESA * GMQS exemption for historic landmark or affordable housing * Significant historic development * Minor historic development If you are submitting any of the above applications along with your three step application, you should also obtain the application package for that type of submission from this office. 3stepsumm 4 rATTACHMENT 2 3 Minimum Submission Contents for All Development Applications All Development Applications shall include, at a minimum, the following information and materials. 1. The applicant's name, address and telephone number, contained within a letter signed by the applicant stating the name, address, and telephone number of the representative authorized to act on behalf of the applicant. 2. The street address and legal description of the parcel on which the development is proposed to occur. 3. A disclosure of ownership of the parcel on which the development is proposed to occur, consisting of a current certificate from a title insurance company, or attorney licensed to practice in the State of Colorado, listing the names of all owners of the property, and all mortgages, judgments, liens, easemqnts, contracts and agreements affecting the parcel, and demonstrating the owner's right to apply for the Development Application. 4. An 8 1/2"x 11" vicinity map locating the subject parcel,within the City of Aspen. 5. Galena St. Aspen, CO 81611 Re: The Elks Building (Webber Block) Dear Michael: Thank you for your patience in receiving this letter to follow up our meeting with Ed Irwin of the Elks. I am extremely excited about this project and intend to give it top priority when an application is received. Many issues face us on the renovation of this marvelous, one-of- a-kind structure. The first priority is, of course, Landmark Designation, of which an application has already been received by the Planning Office. Landmark Designation is crucial to the project, and allows for many benefits that are not available to non-historic structures. The obvious first benefit is GMQS Exemption. The second benefit is directly involved with the preservation incentives incorporated into Ordinance 16 (becoming Ordinance 27, film at 10:00!). Ordinance 16 allows the Planning Director complete authority to sign off on the development activities you are proposing. Change of Use is exempt from impact mitigation and P&Z review (for Landmarks); payment-in-lieu for parking is eliminated, and affordable housing impact fees and requirements significantly lessened! In this case, no affordable housing mitigation is required due to no enlargement of net leasable floor area. The majority of your efforts in obtaining approval for the development activity, therefore, involve the HPC. As the development exceeds 250 sq. ft., the proposal is considered Significant Development, requiring approval at both Conceptual and Final Development stages. The public hearing is held at the Conceptual stage. I would suggest that we combine both the Landmark Designation and Conceptual Development public hearing notices in one mailing to save the Elks time and money in noticing. I am anxious to schedule Conceptual review before the . 6 , HPC when you are ready; your application would need to be in the Planning Office no later than 5:00 p.m., Friday, three and a half weeks before the scheduled meeting to allow for noticing and staff memo preparation. Again, my suggestion to you in designing the exterior elevator shaft is to follow in the steps of the Wheeler's, which works quite well. I am very interested to see how yours works in elevation. Beyond the benefits associated with local Landmark Designation are those associated with the National Register listing, which the Webber Block is eligible. I strongly recommend the Elks consent to listing; commercial historic structures are afforded significant benefits, such as federal tax credits and deductions for facade easements. I have already passed along to you information on the National Register of Historic Places, which I trust you have shared with Ed Irwin. The new non-profit Aspen Historic Trust is in the process of formalizing its incorporation, and Will be able to receive facade and conservation easements as charitable donations very soon. I am very excited about examining all the innovative incentive methods we can, taking advantage of the Webber Block's historic landmark status. These numbers do not include Esprit and Shooters, as they are not affected by the remodel. I couldn't remember what we said about whether to include the basement in the calculations so I have tabulated it both ways. Among our stops thatday buying supplies for the ranch, we visited the local implement dealer, He had on display a new McCormick reaper which was on the floor of the of the old bank lobby. Henry's business enlarged, he was generous with his new wealth, becoming "among the leaders of charitable and public enterprises". Webber also built the "Webber Building" on Hopkins Avenue, in Aspen's commercial district, how the Isis Theatre. Henry Webber left Aspen in 1904, bound for Utah. The structure had steam heating, electric lighting and "waterworks" in every room. A large open space on the third floor provided a "society hall" for dances and dance school. Allan's Drug Store opened in one of the storefronts in August, 1891. March 21, 1892, Webber block sold to the Molly Gibson corporation, then transferred hands again in May, 1892, being purchased by the Aspen National Bank (President, J.J.Hagerman, owner, Colorado Midland Railroad) purchased the building in spring, 1892, and moved in. The structure became known as the "Bank Building". The interior was described as incorporating the finest quality mahogany woodwork, handsomely carved and surmounted by elegant and unique wrought iron work in Japanese copper finish. Long panels of beveled French plate glass were placed and has the appearance of being frosted. The floor is blue and white tile. October, 1891, the newly formed Aspen Athletic Association leased rooms in the structure. A number of different local businesses occupied the structure: Frank D. Howe, Civil Engineer; D. E. Lutz & Co. (boots and shoes ) ; W. E. Rhode, Justice of the Peace; John H. Bean, Constable and Collector, Aaron Stein, Attorney at Law; Meeting room (called Carpenter Hall) hosted Aspen Trades Assembly, United Brothers of Carpenters and Joiners of America, From 1926 to 1959, the Post Office occupied the building. The encroachments are: (1) An existing entry way step which encroaches into the right- of-way and which needs to be increased in size in order to meet building code entry requirements. The existing step encroaches about one foot into the right-of-way. The proposed new entryway steps would encroach about four feet into the right-of-way. Normally we would prefer not to entertain such a request, but in this instance, there is an existing approved encroachment of the stairway well down to Shooters. The new, expanded entryway steps would be in the " Slladow" Of that encroachment and would not encroach any further into the sidewalk that the stairway wall. We discussed with the applicant the possibility of installing a railing on the steps, but the architect said that it was not a code requirement and that HPC did not favor a railing. (2) There is another existing set of steps in the sidewalk along Galena Street near the alley which was the historical entrance to the Elks Club. The applicant wishes to relocate those steps further up the street towards the corner of Hyman Avenue, towards the proposed extended steps discussed in (1) above. These new steps are proposed to extended 2.5 feet into the sidewalk and right-of-way. This would be a half a foot further into the right-of-way than the existing steps, but since it is less than the other four foot encroaching steps, and in light of the previous favorable reception to Elks Building encroachments by Council, the engineering department would not advance any objections. Galena St., Lots K, L, and M, Block 94, City and Townsite of Aspen APPLICANT: The Elks Club #224, represented by Ed Irwin APPLICANT'S REQUEST: Landmark Designation for the 1891 Webber Block, now known as the Elks Building, located at 210 S. Galena. HISTORIC EVALUATION RATING: Exceptional, eligible for listing on the National Register of Historic Places SUMMARY: The Elks Will be submitting an application for Significant Development in the near future, which will include a proposal for an exterior elevator shaft, similar to the Wheeler Opera House, and some minor exterior renovation work. The Elks Club will be relocating to the third floor; the remainder of the building's use will remain virtually the same. PROCEDURE FOR REVIEW: Landmark designation is a three-step process, requiring recommendations from both HPC and P&Z (public hearing at P&Z level), then first and second reading (public hearing at Final reading) of the designation ordinance by Council. An application for GMQS Exemption is required to be submitted, which may be approved by the Planning Director (Ordinance #16, Series 1989). HISTORIC LANDMARK DESIGNATION STANDARDS: The Standards for Landmark Designation are found in Section 7-702(A) of the Land Use Code. Any structure or site that meets one (1) or more of the standards may be designated as a Historic Landmark. Staff finds that the application meets all six (6) of the Landmark Designation Standards. Standard A. Historical Importance: The structure or site is a principal or secondary structure or site commonly identified or associated with a person or an event Of historical significance to the cultural, social or political history of Aspen, the State of Colorado, or the United States. - Response: The Webber Block was considered the third most important structure in value to be built in Aspen during the silver mining era. It was built for $40,000 by Henry Webber, who came to Aspen from the east as a shoe and boot merchant. As his business grew, so did his prominence in the community. Webber was also responsible for the construction of his home, Pioneer Park (400 W. Bleeker) and the Webber Building (now the Isis Theatre). 210 S. Galena was the location of many of Aspen's service-oriented businesses, including the 1892 Aspen National Bank, Allan's Drug Store, attorneys, engineers, etc. The Post Office was located here from 1926-1959. The Elks purchased the building in 1912 for back taxes. Standard B. Architectural Importance. The structure or site reflects an architectural style that is unique, distinct or of traditional Aspen Character. Response: The Elks Building has long been considered one of Aspen's finest Victorian-era structures, massive in form and material, eclectic in design, and unique in detail. The Elks Building is a significantly distinct historic resource to Aspen's Commercial Core Historic District, and a visual landmark since its construction. Traditional Aspen materials (red brick and Peachblow sandstone) speak clearly to its heritage. Standard C. Architectural Importance. The structure or site embodies the distinguishing characteristics of a significant or unique architectural type or specimen. Response: While traditional in Victorian massing and form, this structure embodies unique eclectic details making it one of a kind! The prominent corner entrance, topped with a projecting turret and corner dome with balustrade, and the lunette arch centered at the west elevation parapet are elements which best illustrate the structure's unique style. The masonry craftsmanship is excellent; unique brick detailing (corbeling and "checkerboarding") appear between the upper floors at the predominant southwest corner. The cornice and parapet detailing are also significant details. The structure is a three-bay design, with a balanced fenestration pattern to enhance each bay and provide the upper floor rhythm. The storefront design is relatively unchanged, with the exception of the new windows recently installed for the main floor Esprit retail space. Standard D. Architectural Importance. The structure is a significant work of an architect whose individual work has influenced the character of Aspen. Response: We find the historic Webber Block clearly meets 2 . this Standard. The structure was designed by architect William Quayle, who also designed the Italinate Pitkin County Courthouse, two of Aspen's most significant historic resources. It is interesting to note that both interiors have also remained relatively unaltered in 100 years. Standard E. Neighborhood Character: The structure or site is a significant component of an historically significant neighborhood and the preservation of the structure or site is important for the maintenance of that neighborhood character. Response: The Commercial Core Historic District's integrity consists of magnificent structures such as the Webber Block. Aspen's very image is founded on these irreplaceable historic resources. We find that the preservation of this building speaks to the heart and soul of our community, and are very encouraged with the pending renovation plans. Standard F. Community Character: The structure or site is critical to the preservation of the character of the Aspen community because of its relationship in terms of size, location and architectural similarity to other structures or sites of historical or architectural importance. Response: Aspen's Commercial Core has a distinct character which is unmatched by most other resort communities. Galena Street contains eleven of Aspen's most significant historic resources; their preservation is essential to the character, image and vitality of our entire community. The Planning Office commends the applicant for seeking Landmark Designation, and encourages the sensitive and careful renovation of the structure to insure its preservation for decades to come. The Elks propose to add a new approximately 864 square foot stair and elevator tower. The Club also intends to reconfigure the existing interior spaces by moving all the Elks functions to the third floor, all professional offices to the second floor, all retail to the first floor, and all storage for the club and retail uses in the basement. FINDINGS: Pursuant to Section 8-104 the Planning Director may exempt an enlargement of an Historic Landmark intended to be used as a commercial or office development which increases either the building's existing floor area ratio or its net leasable square footage, but does not increase both. It is staff's determination that the rearrangement of uses within the building does not increase the net leasable square footage. The addition of the elevator and stair tower does represent an increase in floor area by 864 square feet. The elevator is necessary for club functions that are being moved to the third floor. The Elks building is already over the height limit of the CC zone. It is recommended that the elevator tower not exceed the roof line. The conceptual development review of this addition to the Elks building is being reviewed by the Historic preservation Committee at their November 8, 1989 meeting. RECOMMENDATION: Staff recommends GMQS Exemption for the approximately 864 square foot elevator and stair tower, subject to HPC review, with the condition that any addition shall not exceed the roof line. It was agreed that the method of cleaning the building would be the water and detergent method. The approved sandstone was "Mesa Red" from Utah, a sample of which I will retain at my office. The approved brick for the tower is "Delaware" by Robinson Brick. I will also keep a sample panel of this at my office. Remaining samples to be approved are the 8x8 infill brick at the tower and the color of the metal cornice. We will investigate the cornice to see if we can identify the original color. Galena - Height variance for elevator tower Date: ~ March 15, 1990 * On March 14, 1990, the Historic Preservation Committee granted Final Development approval for the Webber Block (Elks Building). The proposal included a west elevation storefront renovation, window replacement, masonry cleaning and repointing and the addition of an elevator/stair tower along the east elevation, near the center of the building. The historic landmark is approximately 46' in height, exceeding current height limits in the CC zone (40'). To access the third floor of the building, the tower's minimum height is 42.5 ', as presented by the applicant. All mechanicals will be incorporated within the structure; none will be higher than cornice height. The HPC and staff support the applicant's request to the Board of Adjustment for the height variance for the tower, finding its design compatible with the historic resource. All historic encroachments have been approved by Council. Galena. The two proposed changes which have significant impact on the original historic structure are one, the new elevator/stair tower and two, renovation of storefront where the Elks Club currently resides. 1. New Elevator/Stair Tower. Since the Elks Club is proposing moving to the 3rd. floor and many of its members are elderly, a new elevator/stair tower is required. In concept, we would propose a similar solution to that employed at the Wheeler Opera House. That is a tower, slightly detached visually, using similar sized and colored bricks as the original structure. The fenestration is of similar sizes and aligns to the openings on the historic structure. The tower would be set back from Hyman St. to align with the adjacent Mason and Morse Building. 2. Renovation of storefront along Galena Street. Since this portion of the building will be returned to retail, we propose removing the existing painted plywood and returning to a storefront similar to that of the rest of the buildings ground level. In addition to these two major items, the entire building will be cleaned and checked for crumbling mortar, etc. The attached block structure in the alley will be cleaned up as well as the loose wires, etc. in the back. Galena St., Lots K, L, and M, Block 94, City and Townsite of Aspen ZONING: CC - Commercial Core, "H" Historic Overlay District Designated Landmark APPLICANT: The Elks Club #224, represented by Ed Irwin HPC MONITOR: To be assigned at this meeting APPLICANT'S REQUEST: Conceptual Development approval for a new elevator/stair tower at the east elevation, and the renovation of the Galena Street storefront (excluding the previously renovated Esprit space). A "vest pocket park" greenspace will be created at the east elevation between the Hyman Street sidewalk and the elevator tower. PROBLEM DISCUSSION: The Development review standards are found in Section 7-601 of the Land Use Code, and are reviewed below. The applicable Guidelines are found in Section IV. Commercial Buildings - Renovation and Restoration, beginning on Page 19 of the Aspen Historic District and Historic Landmark Development Guidelines. The technical brief: Exterior Stair Tower Additions, as an interpretation of the Secretary of the Interior's Standards for Rehabilitation, is included as information in the packet. This is a potential ITC (Investment Tax Credit) project, therefore, careful review is required in accordance with the Secretary of the Interior Standards for Rehabilitation (please refer to your blue manual). We commend the applicant on the future renovation, restoration and preservation of this National Register eligible landmark. 1. Standard: The proposed development is compatible in character with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an H, Historic Overlay district or is adjacent to a Historic Landmark... · m Response: (TOWER) The Elk's need for an exterior elevator/stairway tower are due to the relocation of the club from the first to the third floor, to allow for retail/commercial utilization of the first floor. The project is very similar to the Wheeler Opera House's tower, whose design was utilized as the basis for this one. In reviewing the technical brief attached, we find that the proposal generally meets the Secretary of the Interior's Standards, and Standard #1 stated above (with the exceptions as noted below). Our concerns focus on the width and proposed height (43'), which is 3' above maximum allowable, and approximately 5' below the existing height of the building. The applicant has stated the proposed height is as low as they are able to design to access the third floor and provide the mechanicals, and states they have kept the interior width at a minimum. The HPC may consider ways to reconfigure the interior stair and elevator to reduce the width. Also, provided the HPC is not able to work with the applicant to determine ways to further reduce the height, the Planning Office recommends that the HPC recommend the Board Of Adjustment approve a variance request from the applicant. The tower sits 25' to the north of the Hyman St. sidewalk. The plans include a "vest pocket park"/landscaped area. This may be changed slightly to accommodate the existing 1st floor opening (3' or so to the south). We recommend that the Final Development approval include a landscape plan for the greenspace, and indicate parking and trash areas. The front entrance to the tower is canopied with a suspended, arched glass covering, similar to the covering over the "Shooters" stairs on Galena. One alternative to this may be to incorporate a coordinated awning design for portions of the storefront level. Signage should also be addressed. We recommend that the Final Development approval include a detail of the tower entrance and landscaping. The materials indicated appear compatible to the existing landmark. The rusticated sandstone banding aligns horizontally with the banding on the landmark. We recommend compatible brick though not exactly matching. The required vertical break between structures is treated as stacked windows on the south elevation. The north elevation indicates a very narrow transition between old and new, which appears to meet the Guidelines, however, the transition element should be restudied to provided a slightly more pronounced break. (STOREFRONT): Galena Street storefronts are among Aspen's most pronounced character defining feature. Their 2 preservation (and restoration) set standards throughout the community, certainly in the Commercial Core Historic District. The careful review and approval of this portion of the proposal is critical to not only the historic integrity of the Webber Block, but it may determine whether tax credits may be taken or not. The proposal does not disclose enough information on the existing Galena Street storefront elevation in order for staff to recommend approval. The existing conditions drawing (west elevation) does not include the original sandstone base elements. Original windows and other materials, especially those hidden beneath plywood, have not been thoroughly examined for preservation purposes. Preservation of original materials is required over replacement. Staff recommends that a proiect monitor be assigned to review the storefront preservation issues with the applicant. architect and staff. It might also be noted that the "new" Esprit storefront is beginning to show signs of chipping paint and rust. 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: We find that the proposal generally meets this guideline, and refers exceptions to this in the response comments above. 3. Standard: The proposed development enhances or does not detract from the cultural value of designated historic structure located on the parcel proposed for development or adjacent parcels. Response: The cultural value of this exceptional Aspen Landmark will be enhanced with the implementation of an on- going maintenance plan for this building. We find that a restoration of the Galena Street (west elevation) storefront will greatly enhance the building's cultural value to the community through the removal of inappropriate materials. Due to the placement on the east elevation, we find that the elevator/stairway tower does not detract from the cultural value of the Webber Block. 4. Standard: The proposed development enhances or does not diminish or detract from the architectural integrity of a designated historic structure or part thereof. Response: Tower: We recommend the HPC study the transition/break between old and new very carefully, utilizing the 3 Guidelines and information provided by the National Park Service; we find that the proposal generally meets this standard. Storefront: We find that the proposal for the storefront does not meet this standard, as discussed fully in staff's response to Standard #1 above. The removal of original features does the diminish the architectural integrity of the landmark. Handicapped ramping should also be addressed in the proposal. ALTERNATIVES: The HPC may consider the following alternatives: 1. Approve the Conceptual Development application as submitted 2. Approve the proposal with the conditions (staff's recommendations for conditions are stated below) 3. Table action to allow the applicant further time to study the proposal, incorporating the comments and guidance from the HPC in a revised proposal. 4. Deny Final Development approval finding that the application does not meet the development review standards. A denial would constitute a re-notice of the public hearing. The fenestration is of similar sizes and aligns to the openings on the historic structure. The tower would be set back 25 ft. from Hyman St. to create a vest pocket park. 2. Renovation of storefront along Galena Street. Since this portion of the building will be returned to retail, we propose removing the existing painted plywood and returning to a storefront similar to that of the rest of the building's ground level. In addition to these two major items, the entire building will be cleaned and checked for crumbling mortar, etc. The attached block structure in the alley will be cleaned up as well as the loose wires, etc. in the back. We feel these proposed changes maintain the integrity of the historic structure and will benefit not only the building, but also the surrounding neighborhood. Reversibility of New Alterations/Additions (nonconformance) Subject: EXTERIOR STAIR TOWER ADDITIONS Issue: Creating two separate means of egress from the upper floors of commercial buildings is a fire code requirement that generally must be dealt with in rehabilitating older buildings. Only in a very limited number of cases are variances given for this important life safety feature. In a historic rehabilitation project, this code requirement often makes it necessary to construct a second stair, either within the building or as an exterior addition. When such a new interior or exterior fire stair addition is required to meet code requirements, its construction and detailing must be in conformance with Standards 9 < and 10. These Standards address the important issues of retaining historically significant building material during rehabilitation and designing contemporary new additions that are compatible in scale, color, and material with the historic character 7 of the building. Finally, the new additions should be attached in such a way that future removal will not impair the essential integrity and form of the historic structure. If it is determined that locating the new fire stair within the building would result in the destruction of significant interior fabric, the required stair should be redesigned as an exterior addition, preferably on a secondary facade. NPS certification that an exterior fire stair is necessary to avoid loss of significant interior fabric means that the owner's construction costs are eligible for tax benefits under IRS regulations 26 CFR Parts 1 & 7. If, on the other hand, the owner chooses to construct an exterior fire stair rather than an interior fire stair solely to avoid losing valuable interior rental spaces the cost of the new construction may not be included in the overall rehabilitation expenses. Application: A 1909 two-story stone building, formerly a town hall and individually listed in the National Register, was being rehabilitated for use as professional offices (see illus. 1). The interior had been altered several times and there was little remaining original fabric. The exterior, however, was almost in its original configuration and the owner was taking great care to clean the stone and replicate any deteriorated features. . 82-037 addition resulted in loss of less historic fabric; and the addition was clearly contemporary in design, and of a scale, color, and material appropriate to the historic structure. Applicant shall work with staff and HPC monitor to investigate storefront and at-grade window restoration of Galena Street elevation Don Erdman, Project Monitor, and staff met on-site with the architect to discuss Condition #9; the Final Development application addresses those findings. PROBLEM DISCUSSION: Please refer to the applicant's letter attached. We find that conditions of Conceptual have generally - been met, however, the Planning Office feels that the following issues must be reviewed and approved at this meeting: a. Tower entrance: The applicants have proposed a rigid glass awning at the tower entrance, which was approved in concept. However, the HPC Guidelines state (page 25): "Awnings or canopies made of aluminum, fiberglass or other rigid materials are not encouraged." Staff finds that the proposal may not meet the intent of the Guidelines, and recommends that the HPC reconsider the use of a rigid awning. A canvas or acrylic awning more closely meets the Guidelines. This material could be light and translucent, and still meet the goals to provide protection from the elements at the entrance door, and focus attention to the entrance. b. The HPC asked the applicant to restudy the transition between the historic building and the tower. The applicant has added details which should be carefully considered, as well as the south elevation window design on the tower. We are recommending that the details and first floor windows on the south elevation of the tower be restudied for compatibility. These three vertical windows above the entrance are a different design than the 2nd and 3rd floors. A more compatible solution may be more appropriate. All proposed signs should be discussed with Zoning Officer, Bill Drueding, for code compliance. C. Maintenance of building: A letter from Shaw Construction has been included with the Final Development application, stating the masonry cleaning methods proposed. Shaw also states that bricks that have deteriorated past the point of preservation shall be replaced. This letter does not sufficiently detail this critical maintenance and brick replacement issue. Staff is requiring that the Department of the Interior guidelines be strictly adhered to in both cleaning and repointing. These Technical Briefs are attached, and clearly explain the approved methodology. The lowest possible p.s.i. (400-800 max.) shall be used in water cleaning the masonry, onlv after a test section or two has been completed and reviewed bv the monitor. Repointing of the mortar joints shall match in color 2 and consistency exactly, however, the "addition of 5 percent white portland cement for not more than 20 percent of the lime Will improve workability or plasticity without adversely affecting the desirable qualities of the lime mortar." No discussion was given by the applicant regarding the maintenance of the south elevation storefront. The new Esprit storefront is in need of painting and maintenance, which we are recommending be done this year. Bare metal is showing through. d. Staff requests that the HPC carefully review the proposed storefront changes for the west elevation. We find that while the beadboard kickplate is not original, this theme has been established by the Esprit storefront renovation a few years ago. We have no significant concerns about this storefront renovation/remodel, and feel that the removal of the existing plywood panels on the west elevation will greatly enhance the cultural and architectural value of the Webber Block. Additional Staff Comments: The applicant did not present the complete window replacement of the upper stories at Conceptual, which they have done now at Final. We find that the removal and replacement of the non-original three-part windows with traditional double hung wood windows is highly desirable. All historic windows shall remain. The improvement to the building is exceptional. However, the wooden replacement windows are proposed to be clad, which the HPC should consider carefully. Please refer to staff's recommended condition below. The applicant is also proposing that the cinder block addition to the north side of the building (encroaching into the alley) be reroofed and painted. Roofing materials have not been clarified on the plans, but shall be at this meeting. The CCLC and the Engineering Department are recommending this encroachment be removed from the alley. Approximately 1/2 of this cinder block addition covers the historic stairs that lead to the basement. Staff does not support the removal of century old elements that encroach. One alternative may be to eliminate as much of the addition as possible (which provides some liquor storage and covering for the new electrical service), and retain that portion that covers the stairs. The issue of an encroachment license is coming before Council March 12. ALTERNATIVES: The HPC may consider the following alternatives: 1. Approve the Final Development application as submitted 2. Approve the Final Development application as submitted, 3 subject the conditions (as stated below in staff's Recommendation) to be approved by staff and the Project Monitor. 3. Table action to allow the applicant further time to study the proposal, incorporating the comments and guidance from the HPC in a revised proposal. 4. Deny Final Development approval finding that the application does not meet the conditions of Conceptual Development approval. RECOMMENDATION: The Planning Office recommends that the HPC grant Final Development approval for the proposal at 210 S. Galena St., subject to the following conditions which shall be met by the applicant, and shall be approved by staff and the Project Monitor, unless otherwise stated: 1. The replacement windows shall be reviewed and approved prior to a building permit being issued. An actual sample window or manufacturer's spec sheet shall be approved by the HPC. These windows shall replicate the original, historic windows of the Webber Block. 2. The rigid glass awning at the tower entrance shall be restudied for compliance with the Guidelines. 3. The specifications of the Department of the Interior (attached) for exterior masonry cleaning and repointing shall be strictly adhered to. The lowest possible p.s.i. (400-800 max.) shall be used in water cleaning the masonry, only after a test section or two has been completed and reviewed by the monitor. 4. Repointing of the mortar joints shall match in color and consistency exactly, however, the addition of 5 percent white portland cement for not more than 20 percent of the lime shall be used. 5. The framing for the windows is not constructed to accommodate side trim, nor does it accommodate the step from the original sandstone base to the base of column elements. The windows appear to have been eliminated with the addition of electrical, plumbing and heating systems which dropped the basement ceiling height, thus eliminating this lighting option. The retention of the lower ceiling height is necessary. I have reviewed our findings with Don Erdman our HPC Monitor. He felt either our proposed solution which continued the sandstone base across with beadboard kickplate and windows above (see attached), or installation of windows as found would be appropriate. But he felt our proposal was more appropriate for reasons mentioned and in view of maintenance. We also reviewed our finding and proposal with the Elks who voted unanimously for our proposed solution as attached. We all feel our proposal is the best solution for restoring this storefront in a historical manner appropriate for Aspen. The new window frames and storefront would match the scale and profile of the frame work existing at Esprit, but they be constructed of wood and painted gray to match. As discussed in our Conceptual Development Plan and during our presentation the Elks Club wishes to renovate and refurbish parts of its building at 210 South Galena. The proposed changes will have an impact on two parts of the original historic structure. First is the addition of a new elevator/stair tower on east side of building. Second is the renovation of the storefront currently servicing the Elks Club. As explained during our Conceptual Development Plan the elevatodstair tower is necessary to provide service to second and third floors. The new storefront will service retail space plus bring the building back to resembling its original condition. As part of our Conceptual Development Approval eight conditions were to be addressed. The following is a point by point response to each of these conditions: 1. Partial demolition (east elevation) shall be detailed. The attached as-built drawing A4.0 shows the existing conditions on the east elevation. The drawing also notes changes proposed. These changes are minor. Restudy tower design transition/break between old and new to enhance appearance or separation between the old and new. This transition has been studied and improved. On the north side (rear) the inset space between the tower and the existing building has been increased and the materials at inset changed to 8x8 brick for a more perceptive separation. Please see attachment #2. On the south side (front), Hyman Street elevation of the tower, the glass panels acting as a visual separation between parts have been reorganized and set back in the building face to further emphasis the separation. See attached drawings A4.2 and 7.1. 3. All mechanical equipment shall not exceed respective roof height. No new major mechanical equipment will be located on tower roof. New equipment on existing roof will not be visible from street. 4. All mechanical equipment shall be clarified, i.e. relocated ground floor equipment, east elevation, and shown as to size and location for final. Attached drawings A4.1 shows all mechanical equipment locations visible on exterior including mechanical grilles. 5. Tower entrance detailed drawings, including canopy, windows, door and signage to be provided. The attached drawing A4.2 shows the scope of the tower entrance. All the elements are designed to be compatible with the historic building. The windows will be wood and will align with replacement windows in existing building. The windows are set back into the face of the building approximately one foot to visually divide the tower addition from the existing building plus reflect the original building treatment. The new entry doors are also set back and are detailed with a historic flavor. The entry doors include transom glass above with the building ' ~ address painted on the glass. Above the entry is a glass canopy ' covering both the new entry and back exit of Esprit. This canopy will be detailed similar to canopy over Shooters on west side of building. Between the windows on each floor is a 8x8 brick infill band. This infill will be slightly darker in color and tone than the new brick to emphasize the sepration between new and old. See attached drawing A4.2. Letter to Ms. Roxanne Eflin February 12, 1990 Page 3 In addition to the address over door on the transom glass, the building name will be located on the tower in carved sandstone as shown on drawing A4.2 and lit at night by a concealed light source as shown in detail on attachment #3. 6. Exact material representation, including sample of brick and sandstone. The materials will be presented in our meeting. 7. Maintenance plans for entire building, addressing external surface cleaning, brick repointing, storefront system repainting, etc. See attachment #4 for information addressing external surface cleaning and brick repointing. Storefront at existing Elks Club and Galena entry will be replaced. Color scheme for this area, tower and rest of building will be shown in our presentation. 8. Consider fenestration on north elevation of stair tower at landings. We have studied this option and feel it is not appropriate particularly considering the "alley" view. In reference to the second motion regarding investigation of existing storefront on Galena Street, with our HPC monitor we found the following: After removing the existing plywood kickplate panels below the storefront windows and exploring the existing upper glazing we have determined with our HPC monitor and yourself to replace the wood and glass storefront with new materials to replicate the historic. Please reference the attached drawing A4.3. The storefront will be reconstructed of wood in appropriate sizes and proportions to existing. The sill heights of the glazing, the kickplate details, and trim colors will all reflect the historic character of the building. The existing recessed entry will also be restored to a historic flavor as shown. New side walls at the recessed entry will match the storefront as will the new entry door with sidelights. Again please reference attached drawing A4.3. Also as represented during our conceptual presentation the stone base will be infilled with matching sandstone for a continuous base element. A new more historically accurate door will also be added. This door will be wider per code requirements and will fill the opening creating a better frame to door detail.
