That same day I emailed you plans as requested by the correction notice and I stated that I would "assume that your error under which you issued the permit has been corrected unless I hear otherwise." After nearly a month, I have not received a reply from you regarding the correction notice so I assume that your opting not to reply for such a significant length of time is you unique way of affirming that the correction notice has been corrected from your end satisfying the 30 days requirement (1/13/03) for providing a correction. On another note, prior to my waiting nearly a month for you to reply, I did take the time to seek out alternative solutions. I'm attaching two alternative solutions in PDF format to this email. First, you will see a new No. 16 post that is custom cut for height and shorter than the standard No. 16 posts recommended by HPC and approved in permit #1961.2002. Note that the cut No. 16 posts are 44 3/4 inches high which exceeds the fence height of 42 inches by 2 3/4 inches. The top of the No. 16 post is a ball which ball does not provide a mounting point for the walk gate thus the gate must be mounted to the post itself resulting in the ball on the cut post exceeding the 42 inch fence height by 2 3/4 inches. As an alternative to the PDF attachment, you can see the standard, non cut post image at http://www.stewartironworks.com/posts. asp Second, you will see a No. 62 post that is custom cut for height which uses a short pyramid to shed water from the post top rather than the large ball as HPC recommended. The pyramid is significantly less tall than the ball which allows the post to match the 42 inch fence height while providing a high mounting point for the walk gates. The felice is 40 '/2 inches tall and will be under 42 inches when mounted to the posts. 1 also want to reassure you that I clearly provided the height of the end posts and gate posts that 1 proposed for the fence. When HPC rejected the specific posts that I proposed, HPC identified a preferred alternative end and gate post. Though 1 never liked the preferred alternative, I agreed to accept a fence permit using the H PC preferred alternative gate and end posts. 1 placed an order for the specific posts that HPC approved and was shocked to discover that now you are concerned you made yet another error. While a series of errors occurred on the part of HPC including the reliance on sections of the code designed to address replacement fencing rather than a non existent section intended for an additional fencing and HPC created rules for the English language to make code interpretation that are far from what is written, I continue to be more interested in settling this issue than bringing up what has been described as my proposal for 4 posts along Monarch Street that are too historic at next Monday s council meeting. Note that I don't think it is appropriate that you receive a house in Aspen or a contracting job for your husband as partial consideration for certain approvals so I won't be making any such offer and expect that you won't consider that lack of consideration against my approval of 4 "too historic" posts. As you know, I am willing to eliminate about 64 of the 136 feet of fence that I have received approval for. In addition I am willing to eliminate the larger end post south of the driveway and the end post along the southern property boarder and replace them with standard line posts that are almost indiscernible from the fence pickets themselves. The only large posts remaining on my property along Monarch Street would be 2 gate posts for each of the 2 gates. HPC conducted a hearing on October 9,2002, and, at staff' s recommendation, denied the application finding that it was not consistent with the "City of Aspen Historic Preservation Design Guidelines." Please see Exhibit A for a letter from the applicant requesting an appeal of the LIPC' s decision. APPLICANT: Cuthbert L. Myrin, Jr. LOCATION: 218 N. Monarch Street, which is described as the north 38 feet of Lots A, B, and C, Block 78 and all of that part of Hallam Street from its intersection with the Easterly line of N. Monarch Street thence Easterly to its intersection with line 4-5 of the Aspen Townsite, as the same was vacated by Ordinance #8, Series of 1957 for the City of Aspen, City and Townsite o f Aspen, Colorado. PROJECT SUMMARY AND REVIEW PROCESS: Section 26.415.120.D of the Municipal Code establishes the criteria by which the City Council must judge appeals of LIPC Decisions: The City Council shall consider the application on the record established before the HPC. The City Council shall affirm the decision of the HPC unless there is a finding that there was a denial of due process, or the HPC has exceeded its jurisdiction or abused its discretion. The City Council shall take such action as is deemed necessary to remedy said situation, including, but not limited to: 1. Reversing the decision. 2. Altering the conditions of approval. 3. Remanding the application to the HPC for rehearing. The review of Minor Development for 218 N. Monarch Street followed all of the Municipal Code requirements and procedures for a public hearing. Appropriate public notice and affidavit of notice were provided. Staff, the applicant, and the applicant' s representatives were permitted to make sufficient presentations, and the public was invited to speak. The hearing record, including the staff memo, application, HPC resolution, and minutes is attached for Council review. The Commission reviewed the proposal with the correct and applicable criteria with which it has authority, and the Commission acted to deny the case because they found that the standards were not met. The HPC made a reasoned decision in its role as a quasi- judicial body. There was not an abuse of discretion or denial of due process on HPC's part, and the board did not exceed its jurisdiction. Council's role in the appeal is not to determine whether or not they agree with HPC's conclusion in regard to the merits o f the proj ect, but rather to confirm that there is sufficient evidence in the record to support their decision and to determine whether procedures were followed so that the applicant was afforded the same opportunities as all other applicants requiring Historic Preservation Commission review. In order to grant Minor Development approval, HPC must find that a proposal is in conformance with the "City of Aspen Historic Preservation Design Guidelines." One chapter of the guidelines deals with "Streetscape and Lot Features," including fences. There are five guidelines that are relevant to the construction of new fencing, two of which HPC found were not being met in this case. Specifically, the HPC found the following were not met: 1.2 A new replacement fence should use materials that appear similar to that of the original. • Any fence which is visible from a public right-of-way must be built of wood or wrought iron. Wire fences also may be considered. • A wood picket fence is an appropriate replacement in most locations. A simple wire or metal fence, similar to traditional "wrought iron," also may be considered. • Chain link is prohibited and solid "stockade" fences are only allowed in side and rear yards. and 1.3 A new replacement fence should have a "transparent" quality allowing views into the yard from the street. • A fence that defines a front yard is usually low to the ground and "transparent" in nature. • On residential properties, a fence which is located forward of the front building facade may not be taller than 42" from natural grade. (For additional information, see the City of Aspen's "Residential Design Standards".) • A privacy fence may be used in back yards and along alleys, but not forward of the front facade of a building. • Note that using no fencing at all is often the best approach. • Contemporary interpretations of traditional fences should be compatible with the historic context. The applicant argues that the guidelines cited as problematic do not apply to his project because of their specific wording. Staff and HPC have applied these two guidelines to all new fences, whether the fence in question is proposed as a replacement of one that exists now, or of one that may have existed in the past. The applicant states that this fence is not a "replacement" of anything, however, neither staff nor the applicant would be able to definitively prove that there has never been a fence on this site before. The idea is that any new fence substitutes for one that is authentic to the period of the building's construction. Furthermore, the introduction to the design guidelines document explains the format of each guideline as follows: "The specific design guidelines are presented as bold face statements under each sub-topic. These are also numbered to indicate their relative position within the chapter and to aid in specific reference in the review process. Also provided with the design guidelines are supplementary requirements, which are bulleted (·) statements. The supplementary statements clarify the primary design guideline statement and may suggest specific methods for complying with it." The term "replacement" is not generally given emphasis in the bulleted points that support these guidelines. STAFF RECOMMENDATION: Staff finds that the proper and legal procedures were followed in this case, and does not find that the applicant' s request for appeal is warranted. The HPC has been appointed by Council to provide their expertise related to historic preservation. Staff recommends Council uphold the Commission' s decision. Council should be aware that fences for historic properties are normally approved by the Historic Preservation Officer as part of the issuance of a fence permit through the Building Department. A permit has been issued to construct a metal fence on this site that is identical to the one desired by the applicant through this appeal, except that less ornamental posts are to be used, which Staff found to satisfy the design guidelines and their emphasis on avoiding "copying" historic designs and thereby creating a false sense o f the history of any property. The owner wishes to add a fence around portions of the site. Fences are one type of alteration to a historic property that can be approved by the Community Development Department through the issuance of a "Certificate of No Negative Effect." According to Section 26.415.070.B, the criteria for approval are that: a. It is determined that the activity is an eligible work item and meets the City of Aspen Historic Preservation Design Guidelines, and b. Any modifications to the proposed work requested by the Community Development Director are agreed to by the owner/applicant, and c. The proposed work will not diminish, eliminate or adversely affect the significant historic and/or architectural character of the subject property or historic district in which it is located. The Community Development Department was unable to make a finding that these criteria were met by the attached design when it was originally submitted, and approached HPC for suggestions as to what modifications might allow for the issuance of a fence permit. An agreement was reached that included simplified fence posts and the removal of arches as a feature ofthe gates. A fence permit has been issued. Through a somewhat complex agreement negotiated by the City to obtain an easement for a trail that leads to Clark's Market, the applicant has received approval to construct some fencing within the City right-of-way. A segment of that fence does exist within the boundaries of the designated property, and is therefore under HPC' s purview.) Chapter 1 of the guidelines states that the design of fences and similar features on the site are important because they can affect one's ability to interpret the historic structures. This concept is expanded upon within the "Secretary of the Interior' s Standards for the Rehabilitation of Historic Buildings," Appendix B of the guidelines (attached), which are identified as the policies that serve as the basis for Aspen's design guidelines. Standard 3 states that "each property shall be recognized as a physical record of its time, place, and use. Changes that create a false sense of historical development, such as adding conjectural features or elements from other historic properties, shall not be undertaken." Standard 9 says that "new additions, exterior alterations, or related new construction shall not destroy historic materials, features, and spatial relationships that characterize the property. The new work shall be differentiated from the old and shall be compatible with the historic materials, features, size, scale and proportion, and massing to protect the " integrity of the property and its environment. The fence that is proposed is manufactured by a company that has existed since the 19th century, Stewart Iron Works. The products they provide are in many cases identical to those that could have been purchased 100 years ago, and in fact, there are examples of historic wrought iron fences that bear the company's logo within Aspen. Staff finds that this type of fence would be appropriate to install today only when a restoration was taking place, for example, if an original Stewart Iron Works fence needed a certain element replaced that they could still provide, or where there was photo documentation of a 19111 century fence on a particular site that could be exactly replicated by the company. Where no evidence is available about any original fence that existed on a property, as is the case with this site to staff s knowledge, the design guidelines consider it inappropriate to construct something which comes off as being from the same period in history as when the house was built. This is discouraged within the concept of "conjectural" or "speculative" alterations to a site. Since the adoption of the guidelines in 2000, and likely for at least several years before that, LIPC has been consistent in this philosophy for all new construction on historic sites and in historic districts. Fence permits that have been issued have required a fence design to be less ornate than the type that is proposed for 218 N. Monarch. In surveying historic photographs available at Heritage Aspen for images of residential fencing of the Victorian period as part of past discussions on this topic, staff has found that overall, wrought iron fences were far less common than wood, even for properties that contained very high style mansions. For that reason, guideline 1.2 encourages wood as the most appropriate material and metal only if the style is "simple." 1.3 promotes the use of contemporary interpretations of traditional fences. Staff finds that the proposed design does not meet the guidelines. It would be misleading as to the historic development of the site and would detract from authentic 100 year old wrought iron fences that still exist here as rare pieces of our Victorian past. The applicant has asked whether installing a sign with the date "2002" on the fence would adequately address the issue. Staff finds that it would not because that does not meaningfully respond to the overall philosophical issue. HPC does not allow a property owner to construct a building that is too replicative of Victorian architecture in design and then distinguish it as new simply by adding today's date or some contemporary reference to the cornice. The difference in character needs to be carried through the design of all new construction more wholistically than that would accomplish. RECOMMENDATION: Staff recommends that Minor Development for a new fence at 218 N. Monarch Street, City and Townsite of Aspen, Colorado be denied as proposed, finding that the criteria, specifically "City of Aspen Historic Preservation Design Guidelines" 1.2 and 1.3 are not met. Staff present: Assistant City Attorney, David Hoefer Historic Preservation Planner, Amy Guthrie Chief Deputy Clerk, Kathy Strickland MOTION: Jeffrey moved to approve the minutes of July 24, 2002; second by Neill. All in favor, motion carried. Disclosures: Neill will recuse himself on 218 N. Monarch St. 218 N. Monarch Street - Minor Review - Public Hearing Sworn in: Bert Myrin, Hal Dishler, Walt Madden Michael Hoffman disclosed that he was contacted to represent the owner but could not do so because of his representation on the commission. He also stated that he would not be influenced one way or another in this matter. The affidavit o f posting was entered into the record as Exhibit II. Myrin handed out exhibits representing numerous fences throughout town from the 1980's to today. Older fence post tops were screwed on and newer ones are welded. A company called Steward Iron redesigned wrought iron fences to make them stronger and not sag in the center. Myrin said the issues are the two posts. We are asking for a change of the posts. The approval post is Steward Iron Post #16 and the replacement post would be Stewart Iron #5. Hal Dishler, attorney relayed that each choice would be acceptable in L accordance to guideline 1.2 and 1.3. This is a style decision and that should be left to the owner. Obviously, Bert spent a lot of time thinking of the style and what is appropriate and what would enhance his home. He doesn't feel the public will be misIed by the ornamentation of the post. 1 ·El/l LID/4- E ASPEN HISTORIC PRESERVATION COMMISStON MINUTES OF, OCTOBER 9, 2002 Walt Madden said Bert has researched this and presented everything. Amy relayed that HPC reviewed this fence previously. At that time it came in as an exemption and staff concluded that it did not meet the criteria. A compromise position was concluded. Now we are in a minor review process to look at the original proposal. As o f 2000 new guidelines have been adopted. None o f the exhibits presented from the applicant have been approved since the new ordinance was adopted. The guidelines stated that we do not want to confuse the character of historic properties. We do not want to add conjectural features or make them look more Victorian and more decorative than they ever were. Particularly with fences it appears from the photographs that are available wrought iron fences were not used all that often. Wood fences were repeated throughout town, not wrought iron. Bert's presentation on the history of the manufacture of fences is not enough distinction that the average person walking by would understand the difference. They will perceive this as a Victorian era fence. The compromise from the last meeting was used in similar applications where the best thing to do is simplify the design and this is not being achieved by the proposal. Chairperson, Rally Dupps opened and closed the public hearing. Commissioner comments: Michael relayed that the Secretary of Interior standards were not that helpful but there is direction in the code. Initially he felt that the diagram was too omate and did not meet guideline 1.3. After the presentation of the pictures a number of the older fences prove that wrought iron fences can be less ornate. Michael felt that the meeting should be continued in order for the applicant to provide a diagram of what the fence would really look like. Jeffrey relayed that the posts are very distracting and would confuse the neighborhood and some of the historic resources on that part of the half house that are historic. 2 ASPEN HISTORIC PRESERVATION COMMISMON MINUTES OF, OCTOBER 9, 2002 Teresa relayed to the applicant that the research was commendable. She found that the Interior standards were very helpful. They state that each property shall be recognized as a physical record of its time, place, and use. Changes that create a false sense o f historical development, such as adding conjectural features or elements from other historic properties, shall not be undertaken. This is one of those changes. Guideline 1.2 and 1.3 point toward a more simplified style. Guidelines 1.4 also says new fence components should be similar in scale with those seen traditionally. Rally said the proposed fence #5 seems like a conjectural interpretation and inappropriate in the neighborhood. Rally also pointed out that fencing is not the "building" and it is small and can be removed. He felt that the transparency has been achieved. His issue is with guideline 1.2 which says a wood picket fence is an appropriate replacement in most locations. A simple wire metal fence similar to traditional wrought iron also maybe considered. Hal Dishler said it might be hard to visualize what this will look like as far as transparency. The black and white drawings present a somewhat different in appearance than the gray tone picture. One post is coming ~· already and possibly a demonstration could be set up to be reviewed before the decision is made. Teresa said that would not change her decision; #5 is too ornate for that house and neighborhood. Jeffrey said he would like to see the mockup but it wouldn't affect his decision. Michael supports the suggestion and Rally dittoed Teresa and Jeffrey. MOTION: jeffrey moved to approve Resolution #36,2002; second by Teresa. All in favor, motion carried. 4-0. The applicant has approval for the fence with a simple post and ball on top. 3 ASPEN HISTORIC PRESERVATION COMMISSION MINUTES OF. OCTOBER 9. 2002 David Hoefer, assistant city attorney informed the applicant that the appeal would be with City Council under the new ordinance and needs to be filed within 14 days. 720 S. Aspen Street - Request to De-list from the Aspen Inventory of Historic Sites and Structure - Public Hearing - (Continue Major Development (Conceptual) Public Hearing to Dec. 11, 2002 Neill was seated. David Hoefer went over the scoring system. Sworn in: Jack Simmons, Jasmine dePagter, Lisa Purdy, consultant, Hal Dishler, attorney Amy relayed that the process starts out with any property in the 40-year age range goes through an analysis about what it is associated with. The property is clearly associated with the discussion presented in the context paper about the development of early lodges and why the chalet style was used in many instances. The dePagter's are significant in the lodging industry. Jack dePagter is in the Aspen Ski Hall of Fame and founder o f Winterskol. This property is an example of the chalet style. The discussion tonight is about the integrity topic, which is the second major component of the HPC's decision. Amy went over the sequence of construction on the property. Initially there was a lodge on the property that was housed in a Victorian building and has since been moved off the site and down by Castle Creek. By 1956 the one section that is furthest uphill on the house was constructed and in 1963 the addition that comes down the hill as built. Amy went over the scoring sheet and background reasoning for that particular score. The recommendation is to retain the building on the historic inventory. The threshold is 75 points out of 100 and the score was 79 points. Lisa Purdy, preservation consultant. Lisa stated that she has been in the preservation field for 30 years. What is tough about the Holland house today is that when you look at it, it looks like something that is worthy of being presened. It is the chalet style. With the research that we have done there is not much left to preserve. The original Holland House is gone.
