MAIN STREET, LOTS D AND E, BLOCK 74, CITY AND TOWNSITE OF ASPEN, COLORADO PARCEL ID NO. 2737-073-28-002 RESOLUTION NO.*; SERIES OF 2000 WHEREAS, the applicant, Katherine Thalberg, represented by Katalin Domoszlay, has requested final design approval for the property at 221 E. Main Street, Lots D and E, Block 74, City and Townsite of Aspen. The project involves adding a conservatory and staircase to the rear of the building; and WHEREAS, all development in an "H," Historic Overlay District or development involving a historic landmark must meet all four Development Review Standards of Section 26.415.010.C.5 of the Aspen Land Use Code in order for HPC to grant approval, i namely: 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area by up to five hundred (500) square feet or the allowed site coverage by up to five (5) percent, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. In no event shall variations pursuant to this section exceed those variations allowed under the Cottage Infill Program for detached accessory dwelling units pursuant to Section 26.40.090(B)(2). 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. 4. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof; and 1111111111111111111111111111111111111111111111111111111 446353 08/24/2000 09:56A RESOLUTI DAVIS SILVI 1 of 3 R 15.00 D 0.00 N 0.00 PITKIN COUNTY CO WHEREAS, Amy Guthrie, in her staff report dated May 24,2000, performed an analysis of the application based on the standards, found favorably for the application, and recommended approval with conditions; and WHEREAS, at their regular meeting on May 24, 2000, the Historic Preservation Commission considered the application, found the application to meet the standards. and approved the application with conditions by a vote of 7 to 0. MAIN STREET - EXPLORE BOOKSELLERS - FINAL, VARIANCES, PUBLIC HEARING Heidi was seated at 5:45p.m. Amy informed the board that conceptual was granted January 12,2000 and there are a few minor modifications from those drawings. Staff is recommending approval with conditions. They have to provide parking for the new construction they are doing but in this case it generates an increment, part of one parking space. They can pay that as cash-in-lieu instead o f providing it on the site but the growth management section of the code requires the HPC to out waive the parking because it is an historic landmark. Katalin Domoszlay was sworn in. The elevator will not be constructed and they intend to close in the side o f the staircase. The conservatory will be of Victorian nature with high quality detailing and double thickness glass. Some changes need to occur in order to handle the snow load with regard to the structure. One of the purposes for the conservatory is to take the food out o f the book store and keep it separate. The existing dining room will remain. All of the windows are operable. 3 ASPEN HISTOAiC PRESERVATION COMMIooiON MINUTES OF, May 24,2000 Suzannah opened and closed the public hearing. Amy asked i f the glass was clear or tinted. Katalin relayed that three sides would be clear and possibly one side timed tan or green depending on the engineering report. Mary stated that the board has reviewed green houses in the past and clear glass is the preferable. Heidi, Lisa and Susan felt that the conservatory was a little too fancy. MOTION: Mary moved that HPC grant final approval for 221 E. Main Street as presented May 24,2000 with the following conditions: l. COOPER AVE. - UNIT D Parking Variance Request Assistant City Attorney, David Hoe fur reviewed the affidavit o f publication and determined that HPC had jurisdiction to proceed (Exhibit III). Sworn in were: Joe Krabacher, Darnell Langley, Bob Langley, Ed Fabb, Marsha Goshorn, Jerry Hatem, Christine Amini and Neil Ross. Amy Guthrie, Historic Preservation Officer, noted that this is the same proj ect reviewed by HPC for a parking variance at the last meeting. Five units are being developed on this site; two of which are historic. The site plan for this proj ect was extremely tight. HPC encouraged the preservation of two buildings on site. Affordable units were created. At the time of approval, everyone thought 5 small buildings was preferable to a massive addition on the old house. During construction some errors were made which squeezed two of the parking spaces, one of which received a variance at the last HPC meeting. The owners of the Unit D which is in the middle ofthe back row are applying for a parking variance. This building on site D has been under stop work order because it was being constructed in the wrong location. The city attorney and the applicant' s attorney have had discussions and have determined there are statutes that allow the house to stay where it is and the stop work order will be lifted after HPC takes action on this parking variance. Ms. Guthrie reminded HPC they are discussing a parking space variance only. The parking variance request is to reduce the width from 8'6" to 8'0". Ms. Guthrie told HPC there were a lot of reasons the city supported this project. The 8'0" space will still function and Ms. Guthrie recommended the 5 MEMORANDUM TO: Aspen Historic Preservation Commission THRU: Julie Ann Woods, Community Development Director Joyce Ohlson, Deputy Planning Directok.*D FROM: Amy Guthrie, Historic Preservation Officer RE: 221 E. Main Street- Final Review- PUBLIC HEARING (continued from May 10, 2000) DATE: May 24,2000 SUMMARY: This property is a locally designated landmark and is in the Main Street Historic District. The applicant requests HPC approval to add a conservatory where an outdoor seating area currently exists and to build a new enclosed stairway and dumbwaiter. The project received conceptual approval on January 12. 2000. The plans are attached and HPC should note that the proposal to add an elevator at the back of the building has been dropped, the plan for the stair has been modified, and a clearstory lantern has been added along the ridge of the conservatory. Staff finds that these changes are not significant enough to require a new conceptual hearing. Initially. staff believed that the additional net leasable space created by this proposal would increase the required on-site parking and require a variance. Seven parking spaces exist along the alley and no more can be accommodated. In fact, the additional parking required by zoning regulations is a fraction of one space and will have to be mitigated for via a cash-in-lieu payment, pursuant to Section 26.515.010.E. APPLICANT: Katherine Thalberg, represented by Katalin Domoszlay, architect. LOCATION: 221 E. Main Street. Lots D and E, Block 74, City and Townsite of Aspen. SIGNIFICANT DEVELOPMENT (FINAL) No approval for any development in the "H." Historic Overlay District, or involving historic landmarks shall be granted unless the Historic Preservation Commission finds that all of the following standards (Section 26.415.010.C.5) are met: 1 - 01 Llo \ 9 /72\ a. The proposed development is compatible in general design, scale, site plan, massing and volume with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an "H," Historic Overlay District, or is adjacent to an historic landmark. For historic landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot, exceed the allowed floor area by up to five hundred (500) square feet, or exceed the allowed site coverage by up to five (5) percent, the Historic Preservation Commission may grant necessary variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood than would be development in accord with dimensional requirements. In no event shall variations pursuant to this Section exceed those variations allowed under Section 26.520.040(B)(2), for detached accessory dwelling units. Response: The proposal affects non-historic construction at the back of the building. It will not be visible from Main Street. will expand the seating area for the restaurant. and will provide somewhat improved access to the second floor from the alley. Staffs only concern is with the very ornate character o f the observatory and round window proposed for the stair. Typically HPC does not support this amount of decoration of new construction because it becomes competitive with the historic resource and creates a more high style character than the building ever had. In this case, the previous remodels have already gone in that direction. so it would be ineffective to begin simplifying the detailing o f this proposal. b. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: Most of the original homes along Main Street have been adapted to commercial use. The remodel provides additional space for year round use and will not affect the character of the neighborhood. c. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels. Response: The proposed development does not detract from the historic significance of the building, which is an example of an 1890's Victorian residence. d. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. Response: There have been substantial alterations to the original building with a new addition and second story towards the back. and alterations to the detailing of the house. 2 The new proposal does not affect the architectural character of this structure, is not directly attached to any original portions of the building, and will not be visible from the street. ALTERNATIVES: The HPC may consider any of the following alternatives: • Approve the application as submitted. • Approve the application with conditions to be met prior to final review. • Table action to allow the applicant further time for restudy. (Specific recommendations should be offered.) • Deny approval finding that the application does not meet the Development Review Standards. RECOMMENDATION AND RECONIMENDED MOTION: Staff recommends that HPC grant final approval for 221 E. Main Street. as presented on May 24,2000, with the following conditions: l. HPC staff and monitor must approve the type and location o f any exterior lighting fixtures added as part of this project. 2. There shall be no deviations from the exterior elevations as approved without first being reviewed and approved by HPC staff and monitor. 3. The applicant shall be required to provide the contractor with copies of the HPC resolution applicable to this project. The contractor must submit a letter addressed to HPC staff as part of the building permit application indicating that all conditions of approval are known and understood and must meet with the Historic Preservation Officer prior to applying for the building permit. 4. Unless the HPC determines that it is unnecessary for this particular project, the General Contractor and/or Superintendent shall be required to obtain a specialty license in historic preservation prior to receiving a building permit. 5. All representations made by the applicant in the application and during public meetings with the Historic Preservation Commission shall be adhered to and considered conditiOnS of approval, unless otherwise amended by other conditions.
