Hopkins Avenue, Rustique- Minor Review, Public Hearing DATE: April 25,2001 SUMMARY: This application affects the new structure on the Katie Reid parcel. The applicants propose to modify doors and windows. APPLICANT: Rustique LLC, Charles Dale and Rob Ittner, owners, represented by Zone Four Architecture. LOCATION: 301 E. Hopkins, Lots A, B, and C, Block 81, City and Townsite of Aspen. PARCEL ID: 2737-073-82-005 ZONING: The property is zoned "CC, Commercial Core," with a historic district overlay. MINOR DEVELOPMENT No approval for any development in the "H," Historic Overlay District, or involving historic landmarks shall be granted unless the Historic Preservation Commission finds that all of the following standards (Section 26.415.010.B.4) are met: a. The proposed development is compatible in general design, scale, site plan, massing and volume with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an "H," Historic Overlay District, or is adjacent to an historic landmark. For historic landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot, exceed the allowed floor area by up to five hundred (500) square feet, or exceed the allowed site coverage by up to five (5) percent, th e Historic Preservation Commission may grant necessary variances afte r making a finding that such variation is more compatible in character with the historic landmark and the neighborhood than would be development in accord with dimensional requirements. In no event shall variations pursuant 1 0,41 i 63 i j- A . to this Section exceed those variations allowed under Section 26.520.040(B)(2), for detached accessory dwelling units. Response: The building on this site was designed to wrap around the historic resource, the Katie Reid cottage. It is contemporary in design and does not appear to draw any specific references from the historic house. Currently, the Rustique space has fixed windows and one awning window on each side. The proposal is to create a pair of awning windows and a new door on the Hopkins side, and two pairs of awning windows on the Monarch side. The new units will match existing materials. (Please be aware that the letter from the owner indicates that the windows will be double hung, which is incorrect.) Staff finds that the changes have no impact on the overall design of the building. There are similar operable windows on upper floors. b. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: The proposed changes will not affect the character of the neighborhood. The goal of the project is to enliven the restaurant space, which is beneficial to downtown. c. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels. Response: The proposal will not affect the significance of ally designated structure. There are not direct impacts on the neighboring cottage. d. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. Response: The proposal will not impact the architectural integrity of any designated structure. ALTERNATIVES: The HPC may consider any ofthe following alternatives: • Approve the application as submitted. • Approve the application with conditions to be met prior to issuance of a building permit. • Table action to allow the applicant further time for restudy. (Specific recommendations should be offered.) 2 I ' • Deny approval finding that the application does not meet the Development Review Standards. RECOMMENDATION: Staff recommends that HPC approve the minor development application for 301 E. Hopkins Avenue, Rustique, as proposed. HOPKINS AVENUE, RUSTIQUE, LOTS A, B, AND C, BLOCK 81, CITY AND TOWNSITE OF ASPEN, COLORADO PARCEL ID: 2737-073-82-005 RESOLUTION NO. , SERIES OF 2001 WHEREAS, the applicants, Rustique LLC, have requested minor development approval for the property located at 301 E. Hopkins Avenue, Lots A, B, and C, Block 81, City and Townsite of Aspen. The property is a designated landmark and is located in the Commercial Core Historic District; and WHEREAS, all development in an "H," Historic Overlay District or development involving a historic landmark must meet all four Development Review Standards of Section 26.72.010(D) of the Aspen Land Use Code in order for HPC to grant approval, namely: 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark. 2. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof; and WHEREAS, Amy Guthrie, in her staff report dated April 25, 2001, performed an analysis of the application based on the standards, and recommended approval of the project; and WHEREAS, at their regular meeting on April 25, 2001, the Historic Preservation Commission considered the application, found the application to meet the standards. and approved the application by a vote of to f . 6 NOW, THEREFORE, BE IT RESOLVED: That minor development for 301 E. The Building Envelope for this building is 22.478 s.f. il[ AL(NIMY OF FOOD The basement of the Katie Reid Building houses one space for Rustique Bistro, The Steak Pit Restaurant, the Gallery, liquor storage for Grape and Grain, two storage units for the employee housing apartments upstairs, a mechanical room, an electrical room, and two public rest rooms. The main level of the building houses the two spaces for Rustique Bistro, Grape and Grain retail, Mesa National Bank, and a small lobby with access to stairs and an elevator. The second floor of the building houses Aspen Small Works and its electrical room, as well as two employee housing units. The third level houses Aspen Small Works. As shown in the attached architectural plans, we propose to replace four of the eight windows on the west side, facing onto Monarch Street, with double-hung windows. This will enable our diners to feel more connected to the outside while dining with us, and improve the atmosphere within the restaurant. AMENDMENT AND CONSENT THIS LEAS#LASSIGNMENT, AMENDMENT AND CONSENT ("Assignment") is entered into this F '4day of September, 2000, by and between GIBRALTER WEST, LTD., a Colorado corporation ("Assignor"), RUSTIQUE, LLC, a Colorado limited liability company, ("Assignee", a "Tenant"), and ASPEN ARCADE LIMITED, LLLP, a Colorado limited liability limited partnership ("Landlord"). RECITALS A. On. November 24, 1993, Assignor and Landlord entered into a Retail Lease concerning Spaces 203,204, 103(A) and 103(B) in the Katie Reed Building, Aspen, Colorado, which was amended by Assignment of Lease dated December 29, 1994 and by Amendment to Retail Lease dated July 15, 1998. Such Lease and all modifications and amendments thereto heretofore made are hereinafter referred to as the "Lease". B. Assignor now desires to assign all of its right, title and interest as the Tenant under the Lease to Assignee; and Assignee desires to assume all obligations of Tenant under the Lease. C. The Assignee and Landlord desire by this document to further amend the Lease. AGREEMENT In consideration of the mutual covenants contained herein, the parties hereby agree as follows: 1. Agreement. Assignor hereby assigns to Assignee, all of its right, title and interest to - the following: 1. the Lease and all modifications and amendments relating thereto heretofore made (a complete copy of which is attached hereto as Exhibit A); and 2. the security deposit under the Lease in the amount of Ten Thousand Dollars ($10,000.00). 2. Assumption. Assignee hereby assumes all obligations for the timely performance of all covenants, terms, conditions and provisions required to be kept, observed or performed by the Tenant under the Lease and hereby agrees to indemnify, hold harmless and defend Assignor from and against any and all liability under the Lease incurred from and after the date hereof. 3. Substitution of Cash for Letter of Credit: Restatement of Article XXVIII. The One Hundred Forty Thousand Dollar ($140,000.00) letter of credit referenced in Sectio n 1 28 of the Lease shall be terminated. Assignor, instead, agrees to deliver to Landlord and Landlord agrees to accept a Fifty Thousand Dollar ($50,000.00) cash security deposit. Article XXVIII is deleted and restated in is entirety as follows: Additional Securitv -"Upon execution of this Lease, Gibralter West, Ltd. shall deliver to Landlord as additional security for the performance by Tenant of its obligations under this Lease, cash in the amount of $50,000.00, which sum shall not bear interest, may be commingled with other funds of Landlord, and may be expended by Landlord in its discretion to cure any Event of Default of Tenant under the Lease. It is expressly understood that such Additional Security is not an advance payment of rental or a measure of Landlord's damages in case of default by Tenant, and that Landlord shall have no obligation to apply said Additional Security or any part thereof to cure a default by Tenant in the payment of rent or other amounts due from Tenant under the Lease, and that Landlord may instead exercise any one or more of its default remedies set forth in Article XVIII of the Lease (including without limitation retaking possession of the premises) and preserve the Additional Security for potential subsequent defaults by Tenant. Should the Additional Security or any portion thereof be applied by Landlord for the payment of overdue rental or other sums due and payable to Landlord by Tenant hereunder, or for any other breach on the part of Tenant, the Tenant shall within five (5) days after the written demand of the Landlord, forthwith remit to the Landlord a sufficient amount in cash to restore the Additional Security to the sum of $50,000.00. In the event Tenant is not in default in the performance of any o f Tenant's obligations under this Lease on August 31, 2004, Landlord agrees to return the $50,000.00 Additional Security (or so much thereof as has not been applied by Landlord to prior Tenant defaults) to Gibralter West, Ltd. within 30 days following that date." 4. Notice Copied to Assignor. Until the expiration of the initial term of the Lease, the Landlord agrees to provide a copy of any notice of default thereunder to the Assignee, to the Assignor at: % William R. During the remainder of the initi al term of the Lease expiring August 31, 2004, and during the first renewal te.rm commencing September 1, 2004 and expiring August 31, 2009, (assuming Assigno r timely exercises such first renewal option), annual fixed minimum cost of living rent increases for each Lease Year under Article III of the Lease shall be four (490) percent cumulatively applied. Such increases shall be effective for the Lease Ye ar commencing January 1, 2001, and for each Lease Year thereafter during the initial term and the first option term of the Lease. 6. Rent Establishment and Increases for Renewal Terms. The following is added to Paragraph 6 of the Amendment to Retail Lease dated July 15, 1998, amend i ng 2 Article II o f the Lease. Tenant shall have a second 5-year option period, until August 31, 2014, as more particularly described in Article II of the Lease. References in said Article II to the "initial term of the Lease" shall be amended to say the "first option period." References in said Article II to the "first year of the option period" shall be amended to say the "first year of the second option period in connection with the 5 - year option period". References in said Article II to the "option period" shall be amended to say the "second option period." References in said Article II to the "final 8 months of the initial Lease term" shall be amended to say the "final 8 months of the first option period." During the second option period, the fixed minimum annual rent shall initially be determined by the provision of Article H (a-d) of the Lease, and annual fixed minimum cost of living rent increases thereafter shall be determined b y the provisions of Article III of the Lease, in both instances as contained in the November 24, 1993 Lease document. 7. Release of Assignor. Except as herein provided, Landlord hereby releases Assignor and each and all of Assignor's guarantors of the Lease, and all of Assignor' s collateral and deposits, (except the $50,000.00 Additional Security herein referred to) from any and all obligations on the Lease. 8. Securitv Deposit Increase. The Security Deposit referenced in Section 8 of the Retail Lease/Summary of Business Terms which forms a part of the Lease is increased to Fifty Thousand Dollars ($50,000.00) from Ten Thousand Dollars ($10,000.00) and the Landlord acknowledges the receipt of an additional Forty Thousand Dollars (340,000.00) from the Assignee. The Security Deposit shall be held by Landlord in an interest bearing Certificate of Deposit at Mesa National Bank with interest accruing as additional security deposit. 9. New Doors: Relief. Landlord hereby grants approval to Assignee to install new double entry doors to the Leased Premises, subject to approval by the Landlord ofthe plans and specifications therefor, which approval will not be unreasonably withheld. The cost thereof will be paid by the Assignee. The doors shall become a part of the Leased Premises owned by the Landlord. Landlord shall partly reimburse Assignee for the expense of the doors by giving Assignee one (1) free month minimum rent. Assignee shall select such month and shall provide Landlord with ninety (90) days advance written notice thereof. In addition, if the Assignee shall exercise it's option for the first five (5) year extension of the term of the Lease, Assignee shall be further reimbursed for the expenses of such doors by receiving from the Landlord another one (1) month of free fixed minimum monthly rent during the first five (5) year option term, as designated by the Assignee by written notice to the Landlord at least ninety (90) days in advance of the selected month. 10. Rent Relief for Second Renewal Term. If the Assignee shall timely exercise its option for the second five (5) year option term, the Landlord agrees to grant the Assignee one (1) free month of fixed minimum rent during the second five (5) year option term, said month to be designated by Assignee by written notice to the Landlord at least ninety (90) days in advance of the selected month. 3 11. Extension of Negotiation Period. The second paragraph ofArticle X of the lease, as previously amended, is restated in its entirety as follows: "If Landlord decides to sell the Leased Premises (as condominiumized), Landlord agrees to notify Tenant in writing of such decision and to negotiate with Tenant during the 90-day period following the giving of such notice as to the price and terms on which the Leased Premises may be purchased by Tenant. If prior to the expiration of said 90-day period Landlord and Tenant have not signed a mutually acceptable contract for the sale of the Leased Premises to Tenant, Landlord shall have no further obligation to negotiate with Tenant in connection with the sale of the Leased Premises, and Landlord shall be free to sell the Leased Premises at any time, to ally person, at any price and on any terms, subject always to all of Tenant's rights under this Lease. The foregoing provision shall not apply if Landlord elects to sell the entire building, in which event Tenant shall have no rights under this Article X." 12. Landlord's Consent to Assignment. The Landlord hereby consents to the assignment herein made. 13. Captions. The captions in this Assignment are inserted only for the purpose of convenient reference and in no way define, limit or prescribe the scope or intent of this Agreement or any part thereof. 14. Governing Law. The laws of the State of Colorado shall govern the validi ty, performance and enforcement of this Assignment. Should either party institute legal suit or action for enforcement of any obligation contained herein, it is agreed that the venue of such suit or action shall be in Pitkin County, Colorado. 15. Attorneys' Fees. Should this Assignment become the subject of litigation to resolve a claim of default in performance by either party, the party who is determined to be in default shall pay the attorneys' fees, expenses and court costs of the non-defaulting party. 16. Integration and Modification or Amendment. This Assignment contains the entire understanding of the parties with respect to the matters herein contained. There are no representations, warranties, covenants or undertakings other than those expressly set forth herein. This Assignment may not be modified or amended except by a writing signed by all parties hereto. 17. Counterparts: Facsimile Signatures. This Assignment may be executed in multiple counterparts, each of which shall constitute an original, but all of which taken together shall constitute one and the same document. Facsimile signatures shall constitute valid original signature for purposes of execution. We lease from the landlord and Baybridge is a corporation that leases from Larry Brooks and we lease the three spaces. We are subleasing to Mirabella Restaurant. Leslie Thomas, representing Mirabella Restaurant: We would like to hav eoutdoor seating alongthe front edge of their restaurant which faces Monarch and along the side whilch faces Hopkins. The side is on private property and the f ront is on private property where we would be do ing the serving. Our problem is that per state law requirements for the liquor permit we have to enclose our serving area which means a fence. Per the Building Department code we have to have 44 inches between the edge of our table and our fence and because of that we end up 15 inches encroaching onto city property. Doug Allen, attorney for Mirabella: We do have to have the area fenced off according to the liquor laws and we have to have 44 inches between thu table and the railing so that people can have access and that is emergency access and I can only assume that is for wheelchair access. It is all outdoor and our tables will be under the overhang of the building and on the property. For 15 inches we are required to push that out to have the access required by some other code. There is over eleven feet outside the railing. Jon: The property line is the edge of the brick so it is 15 inches beyond that which puts it slightly 6 inches beyond the drain. Doug: There is 13 feet of sidewalk leaving 11 feet. Janet Lightfoot: This service is only seasonal due to snowmelt etc . Kathy: They will comply with the mall lease regulations which is usually Until October 1st. Jon Busch: We need to treat this as a mall lease agreement. The Engineering Department felt the CCLC. should review this as it is not permanent. Doug: Being across from the park this will be a nice experience for people in the afternoon. Jon: I do not know why the Building Department has required this . J Leslie: Ron Walker stated because we have over 50 people at the main level then the requirement of the 44 inches kicks in. If we had less there would be a different requirement. Jon: I have no problem with this because the pedestrian walkway is much smaller in other areas of town. Jack Stanford: The 15 inches is not for a commercial venture it is required for ADA access. Doug: We do not need the 15 inches but we are required to have it. Doug: We would like the 15 inches and if it can be worked out without using the 15 inches we would prefer that. Jon: This is extending the business out into the public right-of- way and we have had those requests before. There are also tree wells in that area. You need 8 feet in the sidewalk area. Leslie: There is 6 feet by the tree well and then it gets wider. The tree wells are 12 feet apart also. Doug: We will trim those trees properly. Rebecca: The Parks Department is concerned that everything is secure and that paper products are cleaned up. Taylor: I feel this is a legitimate request. Bill: I feel this is appropriate as mall leases only apply to restuarants. Jack: This would be under the mall lease and granted yearly. MOTION: Jack made the motion that CCLC approve the request for Mirabella to have outside seating; second by Bill. - All in favor, motion carries. Janet Lightfoot: Instead of the black cast iron we would prefer to paint it the color that is existing on the exterior. Taylor: That is appropriate. Jon: Wd don' t dictate type or color of furniture. MEMORANDUM TO: Aspen Planning and Zoning Commission t l FROM: Kim Johnson, Planner RE: Mirabella Special Review for Outdoor Dining DATE: July 5, 1994 SUMMARY: Mirabella Restaurant (soon to open at the Katie Reed Plaza) requests the use of two open spaces adjacent to the restaurant for outdoor patio dining. Pursuant to Section 24-3-101, required open space may be used for a commercial restaurant activity via a review by the Planning and Zoning Commission. APPLICANT: Aspen Arcade, Ltd. and Bay Bridge Investments, Janet Lightfoot LOCATION: 216 S. Monarch ZONING: CC - Commercial Core ; APPLICANT'S REQUEST: To use open spaces along the Monarch Street i frontage and within the courtyard for patio dining. REFERRAL COMMENTS: (memos are attached as Exhibit "B") Engineering - In a conversation with Planning Staff, Chuck Roth stated that the request for 15" encroachment onto Monarch Street right-of-way is not appropriate. He recommends that CCLC should rent the space to the applicant in the manner that mall leases are handled. City Clerk's Office - The CCLC reviewed this use of public property in the context of the pedestrian mall leases. They approved the use of the Monarch Street right-of-way for outdoor dining. Environmental Health - The only concern is that the restaurant must receive a standard food service license and pre-opening inspection. STAFF COMMENTS: The Katie Reed parcel provides approximately 2,300 s.f. of open space, meeting the minimum 25% open space requirement for the CC zone district. It was recognized during redevelopment i approval in 1992 that approximately 650 s.f. of the open space 1 provided did not meet the exact definition of open space from the land use code because it did not encompass at least 50% of the parcel's frontage. The situation was compounded because the parcel is a corner lot and the definition of open space does not treat corner lots in a separate manner. However, this issue has no bearing on the current proposal. i The Historic Preservation Committee did not wish to review the specific designs of the tables, chairs or fencing. The Commercial Core and Lodging Commission reviewed this application because it involves a portion of the Monarch Street public right-of-way. They approved the request. The applicant proposes outdoor dining for lunch and dinner from April to October. They wish to utilize four two-person tables in an approximately 213 square foot area in the plaza between the historic Katie Reed building and the new mixed use structure, and four two-person tables in approximately 138 s.f. adjacent to Monarch Street. The two spaces will be separated from pedestrian ways by 3.5' tall iron fences as required to serve alcoholic beverages. As mentioned in the application, the fence on the 1 Monarch side needs to be placed 15" into the public right-of-way to comply with minimum walkway width requirements for the area , inside the fence. Over eleven feet of sidewalk remains on the Monarch Street frontage. Please refer to Exhibit "A" for a site plan and application information. The property owner has consented to the outdoor dining improvements. RECOMMENDATION: Staff recommends approval of the review for outdoor dining in required open space for the Mirabella Restaurant as proposed, finding that outdoor dining in this location will not inhibit pedestrian movement or emergency vehicle access and the use is compatible and consistent with summer activities found in downtown Aspen. Staff recommends approval with the following conditions: 1. The use of the open space is for outdoor dining with up to ' eight two-person tables. 2. The outdoor dining use may run from April 1 through October 1. 3. This approval may run with the restaurant until such time that the patio use is expanded which shall require an amendment to this approval or the property owners terminate the use of this area for outdoor dining purposes. 4. The fencing and gates shall be in accordance with any applicable Environmental Health, Building Department, or Liquor Licensing requirements. 5. The outdoor dining use shall comply with all conditions of the lease agreement with the Commercial Core and Lodging Commission. 2 6. All representations made in the application or by the applicant at the Planning and Zoning Commission meeting shall be adhered to during development. The basement of the Katie Reid Building houses one space for Mirabella Restaurant, Uriah Heep retail, The Steak Pit Restaurant, liquor storage for The Grape and Grain, the Electrical Room, Mechanical Boiler Room, Elevator Room, public bathrooms. and two storage units for employee housing. The main level of the Katie Reid Building houses two spaces for Mirabella Restaurant, Grape And Grain retail, Uriah Heep retail, Angels Can Fly retail, and a small hall accessing the passenger and freight elevators. The second level contains the Management Office, Aspen Small Works Office and Electrical Room,and two employee housing units. The third level houses Aspen Small Works. The physical address of Mirabella Restaurant registered with the building department is 216 South Monarch, Aspen, Co. The three spaces occupy 3628 s.f.. The basement has a prep kitchen, storage closet and comouter room, private dining area seating 21, and men's and women's bathrooms. The main level has an exhibition service kitchen, dining area, lounge and bar seating 92. Baybridge Investments is the leaseholder of the space which - is then sublet to Club Adventuras dba Mirabella Restaurant. The sole owner of Baybridge is Dr. Tarek Shawaf, President, William Jordan. Adjacent to the North side of the Mirabella Restaurant there is a small plaza in an L snape with aporoximately 1265 s.f,. We would like to use about 213 s.f. of this space next to the restaurant which we would enclose with a cast iron fence 3'6 high, 6' deeo and 35'6" long with one 3'8" entrance gate swinging into the dining area. There would be a 4'6" walkway between our fence and the building housing Angels Can Fly. Adjacent to the West side of the restaurant there is approximately 172 s.f. of private property of which we want to use 138 s.f. along with 37'5as.f. of City property (15" encroachment into the sidewalk). We plan to enclose this area with a cast iron fence 3'6" high, 5'3" deeD and 30' long with two 3'8" entrance gates swinging into the dining area. There would be 11'4" of sidewalk between our fence and the curb. 2. Our patio would be contained within private property except for a 15" encroachment into City property. We are asking for an easement because we are required to have a controlled area to serve alcoholic beverages pursuant to the Colorado Department of Revenue Liquor Enforcement Division. We need to maintain a 44" walkway between the 25" diameter tables and the fence thus the 15 encroachment. The narrow 15" strip will not have anything except the railing located in it and will be used soley for circulation. Refer to The Uniform Building Code Sections 3301-3303.
