Mill Street tox \49 -sl L_ RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION APPROVING AN APPLICATION FOR MINOR DEVELOPMENT AT 307 S. MILL STREET, ASPEN, COLORADO RESOLUTION NO. , SERIES OF 1997 WHEREAS the applicant, Signature Entertainment, represented by Aspen Design Works, has requested minor development approval for the property located at 307 S. Mill Street. The property is located within the Commercial Core Historic District; and WHEREAS all development in an "H," Historic Overlay District or development involving a historic landmark must meet all four Development Review Standards of Section 26.72.010(D) of the Aspen Land Use Code in order for HPC to grant approval, namely: 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark. 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. 4. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof, and WHEREAS, Amy Amidon, in her staff report dated May 14,1997, recommended approval as proposed; and WHEREAS, the application was reviewed at a regular meeting of the Historic Preservation Commission on April 23, 1997, at which the Commission considered and approved the application without conditions by a vote of 7-0. NOW, THEREFORE, BE IT RESOLVED: That minor development approval for 307 S. Mill Street, Aspen, Colorado, be approved without conditions. APPROVED BY THE COMMISSION at its regular meeting on the day of ,1997. MILL - MINOR DEVELOPMENT Amy Amidon, planner relayed to the board that the request is to replace existing windows with french doors (accordian sliding doors) and to add an awning. A new sign is proposed and that application is in place. Mark Terkin, contractor indicated that the windows would be changed to french doors in order to get to the patio dining. The patio is on City property and requires a mall lease. The doors are vertical frame fur finished natural. MOTION: Mark moved to approve the minor development application for 307 S. Mill Street as proposed: second by Susan. All infavor, motion carried. 218 N. MONARCH ST. DaviJHqefer, Assistant City Attorney stated that the affidavit of notice indicates #roper posting and HPC has jurisdiction to proceed. Amy stated tha~s an amendment to the final approval. The owner does not intend to move ththistorie building and the garage will not be built: Staff recommends approvaN*cept for the waiver of #30 for the garage which is no longer needed. ~1 Chairman Jake Vickery opened the Atte hearing. Katalin Domoszlay from Cunniffe & Assbq~tes represented the owner. She indicated that the owner decided against th~ garage and did not give any specific reason. The west elevation has one te window since the garage has been eliminated. More vegetation will be431~ted to screen the parking. The existing lilac bushes will probably be kept to screen the headlight from cars. RECOMMENDATION: Staff recommends that HPC approve the minor development application for 307 S. Mill Street as proposed. Mill Street, Aspen, Colorado (the "Property") Dear Mr. Terkun: This response is offered to your inquiry regarding the right of J.D. Aspen, LLC, doing business as Pacifica, to request approval from the Historic Preservation Committee of the City of Aspen for certain modifications to the Property. Because I did not carry out a full title search in the land records ofPitkin County, this letter should not be relied upon as conclusively demonstrating the title ofthe Robert Barnard Trust in the Property. However, a review of the public record over the past 11 years demonstrated that Robert Barnard, while he was living, asserted ownership of the Property. After Mr. Barnard's death, William L. Comcowich, as personal representative ofMr. Barnard's estate, conveyed the Property to the trust created in Mr. Barnard' s Last Will and Testament. That trust continues to own the Property. A mongage in favor of The Bank ofAspen was paid in full in 1992. The Property is now apparently owned free and clear of any financial encumbrance. Tavern on the Park Inc. entered into a Lease Agreement with the predecessor to the Trust on July 3, 1985 (the -Lease"). The Lease was filed in the land records ofPitkin Countyon November 13, 1986. By Addendum to the Lease, its termwas extended to June 30,2000. Tavern on the Park, Inc. assigned its interest in the Leaser..AGRh LLC on April 1, 1997. .
