MEMORANDUM To: Aspen Historic Preservation Commission From: Roxanne Eflin, Historic Preservation Officer Re: Conceptual and Final Development and Vested Property Rights approval: 334 W. Hallam St. Date: ~June 26, 1991__ 4.1,7 SUMMARY: The HPC is being requested to combine Conceptual and Final Development review processes for the project at 334 W. Hallam. The applicant is primarily seeking Vested Rights approval for the (previously approved) significant development plans, which expire on July 10, 1991; they are required to re-apply for HPC approval under the standard Significant Development Review process in order to be eligible for three year vested rights approval. Therefore, the applicant may either submit for a building permit prior to July 10, or re-apply for HPC approvals according to the code provisions. They have elected to do both. The same plans that have been submitted last week for a building permit have been re-submitted for HPC Significant Development review. Any and all new code provisions, put into effect since the initial plans were approved, would apply. Staff has reviewed the code to determine if any standards have been left unmet; it appears that the project still meets all the development review standards and Guidelines. We are recommending the HPC consolidate steps, and approve the project for Conceptual and Final development. We are also recommending the HPC approve the Resolution granting vested property rights for three years. APPLICANT: Frank Peters and Marta Chaikovska LOCATION: 334 W. Hallam St. ZONING: R-6, Designated Landmark, determined eligible for listing on the National Register of Historic Place PREVIOUS HPC ACTION: On January 10, 1990, the HPC granted Final Development approval for the property located at 334 W. Hallam. This project originally began in early 1988, when the HPC granted approval for the significant rehab of the alley outbuilding (Phase 1) , and the renovation, partial demolition and expansion of the main house (Phase 2). Vested rights approval was not requested at that Final meeting. DISCUSSION: Staff has reviewed the plans according to current code standards. The only two provisions that have changed since 334 W. Hallam initially came into the HPC review system, is Ordinance #1 0 0 (requiring accessory dwelling units or cash-in-lieu if 50% or more of a structure is demolished), and the partial demolition standards. Ordinance #1 does not apply in this case (less than 50% of the structure is being demolished), and the partial demolition standards appear to have been met. The additions are not original to the structure. ALTERNATIVES: The HPC may consider the following alternatives: 1) Grant approval for the Conceptual and Final Development application, and the vested property rights resolution as proposed 2) Grant approval for the Conceptual Development application (with conditions), and require the applicant to submit a separate Final Development application to meet the conditions of Conceptual approval. The vested property rights resolution may only be approved at Final Development review, which will require re-noticing for the Public Hearing. 3) Table action to a date specific, to allow the applicant additional time to review and restudy specific areas of concern. 4) Deny Conceptual and Final Development approval, finding that the applicable review standards have not been met. RECOMMENDATION: The Planning Office recommends that the HPC grant approval for the Conceptual and Final Development application, and the vested property rights resolution as proposed, for the property at 334 W. Actually, I think they got Final earlier than that, and just came in 1.5 years ago to ask for a amendment to their plans, which DOES NOT start their 18 months Final approval over again... Roxanne: At the last meeting Trish Harris had presented the entire plans which final approval was given and she verbally presented the fact that there was a possibility they might want to increase the size of the basement for storage and possibly lift the carriage house up and move it. That developed into an entire conversation about the encroachment of the parking situation into the right-of-way and all of that and if they are going to move it maybe we should look at an entire new plan for reciting the structure. Frank: We were concerned that there was a misunderstanding. At the last meeting we did say our thinking was that a basement was .e'>·',.t more appropriate in that structure and she came in and said we were going to put a basement in but she was free wheeling as to 0;e·•Fff? how. We don't want to move the house at all but it is impossible UN-:92*52 we are told to do anything with the foundation, to under pin, to t11 put a 4 ft. foundation wall in or to put a regular 8 or 9 ft. basement wall in without lifting it. The minutes I read stated if it is going to be moved or lifted then we have to come back to HPC. It is the view of the architectural firm, engineering firm, excavator and the general contractor that you won't be able to do 2 -- anything with that house if you don't lift it somewhat. We are not going to move it one inch north, south, east or west but it has to be raised and supported in place which something is done to the foundation. To raise it we have to build a plywood match box all around it to make sure nothing happens to it when it is raised. Then we have to have a house mover from Glenwood come in and raise it before we can even touch it. The additional cost after doing all that to go ahead a build a basement for all the , mechanical, washer and dryer was small in comparison to what we 44 already have in it. That is why we said we will do the basement. We are saying we might have to lift it as high as three to four 242% feet for three weeks then put it right down where it was and it .:.3,- will never move during the process and we were hoping you £ wouldn't have an objection to that. Marta: It is a safety issue as well. Frank: When the house was built the existing support is E ~ E- internal not on the outside bearing walls. L -== li 10 .. <--.- HPC. MINUTES JUNE 28, 1988 1 ' Frank: We just need some movement on item #3 that says we can raise it. Georgeann: You are not bringing it any further out of the ground or having anything visually on the outside changing. Frank: Absolutely not. Georgeann: Instead of 4 ft. foundations you are asking for 8 ft. and a washer and dryer. Frank: Visually if you walk by you will wonder if we put a basement in the house. At the last meeting lifting and moving because one clause instead of two separate ideas. Bill D: It was presented that it could be picked up, moved over, the foundation poured and moved back. My idea was if you can pick it up and move it then you don't need variances. Georgeann: From our point of view all we have to do is make a motion allowing them to lift their building up for the purpose of putting in a foundation or basement and the detailing is left up to them. en€040 AUgie: You might want to require a letter from the structural engineer and an implementation plan describing what you are going to do to protect the building. Georgeann: You are saying not just the letter from Ted saying you can't do underpinning but a letter saying what should be done and how it will be done. Frank: If you give us approval to lift it up and put a basement/foundation in you need confirmation from the structural engineers, one that it can be done and that is the way to do it and how it is to be done. MOTION: Augie made the motion approve the addition of a basement underneath the carriage house at 334 W. Hallam noting 7.4 that the building will be allowed to be lifted up in the air to put the basement in and that we need a letter from the structural 4:34- engineer stating that this is indeed the way that should happen and also an implementation plan on how you are going to assure the safety of damage to that building in that moving process and no visible changes to the way the building is now. I want to encourage HPC to get involved in this and it can have a long range dramatic impact especially on the west end. You have water flowing through town the same way it did 100 years ago. ASPEN LEAF JEWELERS-120 S. GALENA/SOUTHERLAND FALLIN Bill: This is an application for an awning. Roxanne: Kathy has noted there was an awning approved on the other side of that same building. Ed from Aspen Awning: They were going to put awnings on the front of Godiva Chocolate and they are not going to do that, instead they put up gold signage. The only awning on this building will be this one. Georgeann: Should we get something from Godiva that discontinues that awning use. We have a year time period. Ed: This is a permanent frame awning. Bill D.: You will need an encroachment license from the Eng. f+ME~ Dept. as this would protrude over city property. I am having trouble with the space on the sides because historically in downtown we do build lot line to lot line and in a residential scheme the architect is trying to get light and ventilation. Georgeann: I do like the verticality of the building. The finishing and tiny details and critical. Glenn: The section and how it relates to the street is critical. I still feel the facade of the building looks like we live in a high crime area where you sneak in the side door to get into your house. Hallam received final development last year and - final development approvals are good for 18 months. Their 18 months has passed. No other changes are taking place except that ~„. they are excavating under the entire historic building instead of . just a portion of it therefore I am requiring that the applicant - submit a letter of guarantee and engineer's report on the r,9 - . 1.- excavation of the basement and a temporary support structure for 2 : €·39?...'2... -.. /3 Historic Preservation Committee Minutes of December 20, 1989 the building. Since the approval has expired if the Board feels changes are needed it is appropriate. One issue of concern is the side entry and competing bay on the second floor with the facade of the house. This building is eligible for listing on the national register. Staff feels the bay should be eliminated that it be very quiet and that the focus point be on the facade of the building. This is particular difficult as the building is on a corner. Georgeann: One thing we discovered is that the pieces of glass are large in conjunction with the main house. In the future we had determined that carriage houses have smaller windows than the main house. I am concerned about the large piece of glass in the middle of the bay, that could be out of keeping. Joe: Does anybody have concern about the green house. Roxanne: The green house was to be simple and not harm any of the original materials on the carriage house. Hallam Street to give the applicant the opportunity to restudy the west elevation to endeavor to simplify it either by eliminating the bay or simplifying the bay. We want to see both. Also that the applicant bring back letters of guarantee and engineer's report on the basement excavation and temporary support structure of the building. RFTA BUS SHELTER - 100 BLOCK E. Since we have no guidelines for public amenities I have recommended approval with two conditions that RFTA complies with Main St. Historic Guidelines (when adopted), should alternatives to the proposed bus shelter design be determined 4 more appropriate in compatibility with the character of the District. Charles: Possibly there is another way to make the gable come down and not come into the intersection of the roof. I would like to see a version of C with a reduced gable.
