Main Aspen, CO 81611 Re: Development application received for Cantina tree removal Dear Steve: As we discussed today by phone, the Minor Development application I received from you has the following discrepancies: 1. It's not complete, and does not address the Development Review Standards as called for in the application packet 2. It appears that you are confusing the Growth Management Exemption section (8-107) with Historic Preservation Minor Development Review (Sec. 7-601) 3. You have paid $100 for a HP Minor Development Review. We can either: a) Refund this fee and return your incomplete application 2 b) Retain it to apply to a revised, and completed, Minor Development application c) Retain it to apply to the Growth Management Exemption (Planning Director) sign off, or other HP exemption review by me. 4. I see that you have now revised your thoughts for the plaza area, which includes replacing the four planted maples with four potted aspens. I will return to the HPC on April 22 with this revised idea, to seek their direction. IF they find no problem with your plan of replacing these trees with large potted aspens, I will agree to simply signing off as an Exemption from HPC ($50 fee) . I have enclosed the HPC Exemption application form for you to complete and return to me right away. ~ recycled paper .. Steve, please call me with questions. I am giving Kim Johnson a copy of what you submitted to me, along with a copy of this letter. Understand that there are two totally separate processes that must be completed prior to approving your application. One is the design aspect within the historic district, which is the responsibility of the Historic Preservation Committee and me (their staff person). The other is the amendment to the Growth Management approval, handled by Kim, due to changes in landscaping from the original approval. We understand your need to remove the aphid-ridden trees from the plaza, recognizing the fact that this tree "experiment" is now causing problems to outdoor diners. At the April 8 worksession with the HPC, I heard from them that tree removal would be permitted, provided they were replaced with something. HPC MEETING APRIL 8 1992 PROBLEM: THE CANTINA HAS HAD A LONG STANDING PROBLEM WITH AN APHID INFESTATION THAT HAS INFECTED THE FOUR DECIDUOUS TREES THAT ARE PLANTED IN THE OUTSIDE PATIO DINING AREA. DESPITE NUMEROUS ANNUAL TREE SPRAYINGS, THE APHIDS PERSIST AND ARE CREATING EXTREME HEALTH AND CONTAMINATION PROBLEMS TO OUR PATRONS WHO CHOOSE TO EAT ON THE PATIO. SIMPLY STATED, THE APHIDS ARE FALLING INTO PEOPLE'S HAIR AND INTO PEOPLE'S FOOD. WE HAVE TRIED FOR MANY YEARS TO RID OURSELVES OF THIS PROBLEM THROUGH THE RECOMMENDED SPRAYING OF THESE TREES BY PROFESSIONAL TREE SPRAYERS. UNFORTUNATELY THE APHIDS PERSIST. WE HAVE BEEN TOLD THAT THIS HAS BEEN A CITY WIDE PROBLEM IN RECENT YEARS. WE ARE CERTAIN THAT EVERYONE HERE TODAY, WILL AGREE THAT IT IS A FAR GREATER PROBLEM FOR A RESTAURANT THAN IT IS FOR MOST PEOPLE. WE BELIEVE PART OF THE TREE SPRAYING FAILURES RESULT FROM THE DIFFICULTY OF REACHING THE HIGHER TREE LIMBS. THE CRANE THAT HAS BEEN USED SIMPLY CANNOT REACH THE HIGHER LIMBS DUE TO THE INACCESSIBILITY OF THE PATIO COURT AND CONSEQUENTLY ALL OF THE APHIDS ARE NOT DESTROYED. , SOLUTION: THE ONLY VIABLE SOLUTION IS TO REMOVE THE TREES AND CONSEQUENTLY ELIMINATE THE APHID POPULATION. WE COME HERE TODAY TO SEEK YOUR APPROVAL OF THIS TREE REMOVAL. THE PARKS AND RECREATION DEPARTMENT HAS ALREADY BEEN CONTACTED AND THEY HAVE STATED THAT THEY HAVE NO OBJECTION TO THE REMOVAL OF THE TREES AS LONG AS OTHER CITY AGENCIES HAVE NO OBJECTIONS. IN PRELIMINARY DISCUSSIONS WITH ROXANNE ELFIN, IT WAS SUGGESTED THAT WE APPROACH THE HPC WITH A "REPLACEMENT PLAN" FOR THE INFESTED TREES. PROPOSED "REPLACEMENT PLAN": 4/6 THE CANTINA RESTAURANT CONSULTED WITH BILL POSS, THE ORIGINAL ARCHITECT RESPONSIBLE FOR THE DESIGN OF THE OUTDOOR PATIO, AND IT WAS HIS SUGGESTION THAT WE REPLACE THE TREES WITH A MORE EPICUREAN GARDEN AND DINING AREA AFFECT. HE SUGGESTED A VICTORIAN ARBOR WITH GROWING VINES AND HANGING FLOWERING PLANTS. WE WANT TO PRESENT TO YOU TONIGHT A PRELIMINARY DESIGN FOR THE PURPOSED ARBOR. WE WOULD ALSO LIKE YOUR APPROVAL FOR THE REMOVAL OF THE TREES BEFORE THE BEGINNING OF THE PATIO SEASON.
