HomeMy WebLinkAboutordinance.council.039-07ORDINANCE NO. 39 Series of 2007 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, AMENDING SECTION 2.12.060 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN TO AMEND FEES RELATING TO PARKING. WHEREAS, the City Council has adopted a policy of requiring consumers and users of the miscellaneous City of Aspen programs and services to pay fees that fairly approximate the costs of providing such programs and services; and WHEREAS, the City Council has determined that certain fees currently in effect for parking on City streets need to be revised as part of the City's overall Transportation Demand Management Program. NOW, THEREFORE, BE IT ORDAIIVED BY THE COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 2.12.060 of the Municipal Code of the City of Aspen, Colorado, which section sets the applicable fees for paid parking, is hereby amended to 2.12.060 Parking fees. The Transportation and Parking Department shall charge the following fees for pazking: I. Rio Grande Parking Plaza Fee Options. A. Hourly pazking rates $1.50/hour Maximum daily fee $15.00/day B. Validation stickers $ 5.00 per visit C. Unlimited use monthly passes $200.00/month D. Lost Ticket Fee $15.00 F. Special Events Pass $5.00/day G. Access Replacement Cazd $20.00 II. Commercial Core Pay Pazking Fees. Between the hours of 7 a.m. and 6 p.m. First hour $2.00 Second hour $2.00 Third hour $3.00 Fourth hour $4.00 Single Space Meter fees $.50 per 15 minutes Between the hours of 6 p.m. and 3 a.m. Free III. Residential Permit Pazking Program Fees. Residential Day Pass Fee $7.00 Space Rental Fee Per Day $10.00 per day Resident Permits: First 2 permits for residence and guest is free. Third permit: $25.00 Fourth permit: 50.00 Fifth permit: 100.00 (No more than five permits shall be issued per residence) Resident Guest Permit free Lodge Guest Permit $2.00/permit High Occupancy Vehicle Permit Free Business Vehicle Permit $500.00/6 month period Host Guest Permit Fee $25.00/replacement The Residential Permit Pazking Program restrictions shall be in effect from 8 a.m. until 6 p.m., Monday through Friday, (official holidays excepted), unless otherwise specified. Two 6-month periods aze established for the Business Vehicle Permit: Winter Season, November 1 through April 3Q and Summer Season, May 1 through October 31. N. Miscellaneous Pazking Fees. Delivery Vehicle Permit $ 100.00/yr. Service Vehicle Meter Fees $50.00 deposit/meter $25.00 admin fee/meter $1.00 first hour $.50 each additional hour ($4.50 daily maximum) Construction Vehicle Permit In Residential Permit Pazking $40.00/month Commercial Core $25.00/day Handicapped Parking Free Permit Replacement Fee $25.00 Tow Truck Cancel Fee $25.00 Boot Fee $35.00 In-car meter fee $75.00 Ticket Late Fee $10.00/each Towing Fee (including processing) $120.00 Towing Fee (to impound) $150.00 Neighborhood Electric Vehicles"` Free ' Neighborhood Electric Vehicles (NEV's) are defined as follows: A low speed electric vehicle that does not exceed speeds of 20-25 mph. The vehicle must have seat belts., headlights, windshield wipers. safety glass, tail luttps, and front and reu tum signals and stop lamps. These vehicles must have a ve- hicle idemificationnumber (VIN} and be state licensed. NEV's ue only permitted witlin the City of Aspen limits and on roads that have speed limits less than 40 mph. Section 2 The effective date of this ordinance shall be December 1, 2007. Section 3 This ordinance shall not have any effect on existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances amended as herein provided, and the same shall be construed and concluded under such prior ordinances. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions hereof. A public hearing on the ordinance shall be held on the 9th day of October 2007, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
